will and hand it to his live-in girlfriend? that's the question. that girlfriend was in court this morning. take a look at her this is amy pinto walsh. the woman who lived with thomas kincade for a year plus until his death a couple months ago in april. kincade known for his wildly popular paintings died of alcohol and valium poisoning. she says he left her a piece of paper handwritten that reportedly says she should get 10 million dollars, plus the mansion. kincade's estranged wife says pinto walsh is a gold-digger and the case should not be in open court in any case rather in arbitration to keep it private and protect kincade's recommendations on his reputation. pinto's attorney says otherwise. >> we need to let the judge make his decision that's the only fair thing to do. >> you think it will go into arbitration? >> we need to wait for the

side still. but, cooler air is headed our way, 69 now in san jose, plenty of 70s around the bay. along the coast, 60°. that marine layer intact here around the monterey bay cloudy in watsonville. we will continue to see westerly winds pick up throughout the day. compared to yesterday we are 10° cooler at this hour in the south bay than we were yesterday. we are headed in the right direction, the winds will kick up today that will allow for low clouds and fog to continue to push across the bay later this evening. breezy at the coast, the fog will move in that will bring cooler temperatures. winds now light out of north san jose. these are going to veer more westerly and that is going to bring cooler temperatures. details in a few minutes. more than 150 goats and 120 sheep are being put to work to clear vegetation along the banks of walnut creek concord the district is trying

to figure out the most effective and environmentally friendly and economic way to manage the grass and brush. it is a test between the goats, sheep and herbicides. research is going to take two weeks. brush and -- massive wild fire burning through 68 square miles of colorado has killed a woman in her home, one of several fires burning. diana perez has more. >> reporter: frightening sight in colorado from the sky bright orange flames cut through the forest, smoke billows 100 feet in the air stretching to nebraska and wyoming. on the the fire has destroyed 100 structures, many homes. one person found dead in a cabin. >> we managed to get up there to cool often remnants of that building. ultimately, they found what is believed to be human remains.

>> reporter: home video captured the moments before kyle's home was engulfed. >> pretty much have to start over. >> reporter: across from the flames dozens wait to hear if they will have to do the same. >> it is really difficult to sit and wonder if you have to start your life over again. >> reporter: some progress has been achieved. by monday this wildfire charred 41,000 acres. making this a david vs. goliath battle. the fire was sparked by lightning saturday and fueled by dry conditions and wind. those same conditions have sparked more than 100 other smaller wildfires across the west. in new mexico, 435 square miles burned, thousands forced to evacuate last weekend in the state's largest fire in history. that fire is not even half contained. break in the hot weather in colorado and new mexico has

given firefighters an opportunity to make some progress today. diana perez, abc news, new york. investigations underway in two bay area cities after suspicious fires last night one martinez at a mouse in the 400 block of h street it went from a smokey attic fire to flames shooting out of the home. that home is in foreclosure. officials say there had been problems with squatters. the house was empty, nobody injured. damage estimated at around $60,000. livermore firefighters trying to figure out why a house fire spread so quickly last night it put one woman in the hospital. crews discovered a gas leak that pg&e had to seal. the battalion chief stopped short of calling the fire suspicious but did note it burned unusually fast. investigators could not examine the scene until this morning because of the safety issues.

southwest airlines investigating a mysterious odor onboard an oakland to burbank bound flight that prompted the pilot to turn the plane around. amy it started with a flight attendant's complaint. >> reporter: that's right. i spoke with the flight attendant's fiancee. she was feeling nauseous the pilot decided to turn around. the pilot got all the people off of that plane, all 137 passengers off of this southwest airlines flight and the five crewmembers they pulled the plane out of service they are checking it out now trying to figure out the source of the smell. the flight attendant was taken to the hospital. he told us about how he got the news that her flight was involved in an emergency landing. >> smell in the cabin in cockpit. felt nauseous and shakes. i said are you okay? she said i'm with paramedics now. then i read on the -- on your

news channel on the internet said one hospitalized. i texted her laughing, tell me you are not the one hospitalized? she said yep, it's me. >> reporter: south west spokesman told us everyone is okay. -- they still don't know what the smell was. i asked if this happened before? he said yes, not common. i asked what kind of smell was it in the past? he said sometimes coffee will spill on to the burn ter that creates a smell. they don't know what it is at the time so they turn the plane around for that they have no idea what the smell was today. passengers and crew got on another plane, went on to burbank they should be there by now. everyone went except for that flight attendant she's here in the hospital her fiance says she is being released right now. amy hollyfield, abc7 news. right now a woman who caused a bomb scare and evacuation of a north beach residential hotel last night is undergoing psychiatric

evaluation. residents were allowed back in the hotel around 2:00 this morning. police closed that area off around 7 p.m. and call the bomb squad when officers found suspicious explosive devices. a resident suffered a psychiatric episode. she told them she fired a gunshot earlier in the day. officers found a bullet hole in the door they forced their way in and took her into custody. the bomb squad found possible explosives inside and removed them. muni riders and commuters should prepare for delays today work begins on a section of the new central subway line to chinatown. crews will start digging up 4th between bryant and harrison expect lane and sporadic off-ramp closures off i-80 it is a 1.6 billion dollar project getting underway even though the city has yet to receive 942 million dollars in federal funding. >> >> still ahead, medical community's concerns about spray tans and cancer.

second accuser gave graphic testimony in the trial of jerry sandusky. the now 18-year-old accuser is known as victim one. he cried as he described the abuse he said happened in sandusky's basement while his wife remained upstairs. he testified a guidance counselor didn't believe him because sandusky was known for having a heart of gold. the victim started the investigation into sandusky. during cross-examination the defense questioned whether the teen had financial motive for making those accusation. sandusky has phaeufrpb tainted his nance -- has maintained his innocence. yacht explosion in the atlantic ocean report turned out to be a hoax. one man identifying himself as a yacht captain claimed his craft exploded and sank 17 miles out at sea and there were mass casualties. the coast guard launched a

massive rescue operation, including several helicopters. >> it is always dangerous to launch a helicopter in the middle of the atlantic if for a search, particularly when several helicopters are converging on the same point in the ocean. >> search on for five hours. crews did not find any sign of a vessel or wreckage. authorities have now determined the call came from land somewhere in new york or new jersey. a $3,000 reward is being offered for any information. happy ending for a florida teenage totalled his car last week after accidentally driving into a flooded canal. todd dixon became disoriented diving in downpour and made a wrong -- driving in a downpour and made a wrong turn. unfortunately, not only did dixon lose his car but he's a pizza delivery driver so he also lost his means of financial support. a local car dealer came to his rescue presenting dixon with a new car, free of charge.

yesterday we had widespread mid 90s and we are looking at numbers coming down as much as four to six degrees today. fremont 90 yesterday, 82 today. san francisco coming out of the mid 70s about 70, where you should to be for this time of year. strong high pressure, built into the pacific northwest we have a trough of low pressure north and what that is working to do is weakening that stronger high. that weakens the high in response the fog moves up from the south that southerly surge cools us off tonight. if you are headed to the u.s. open, 50s now, low 60s later with that wind kicking up, have the jacket, it will be sunny, but cooler tomorrow. in the south bay today, upper 80s improvement from yesterday, still nice warm summer like afternoon 84 sunnyvale, 80 redwood city, 60s at the coast. the fog, patches of it later this evening with mid 60s in the sunset it should be a nice
