good morning. 5:01. thanks for joining us i'm eric thomas. and i'm katie marzullo in for kristen sze. evacuation has just ended and a shelter in place has been lifted. a driver ran into a bank of gas meters at an apartment building pg&e crews had to dig into the ground to shut off the gas. we are following breaking news napa. firefighter suffered minor injuries while battling a commercial building fire this morning around 1 a.m. on jefferson street at the pueblo plaza. the fire department sent these pictures showing how big the flames got, seven businesses are located there it took firefighters an hour to get the flames under control. investigators are trying to determine what started the fire. bart crews have been

testing the tracks overnight and into early morning hours making sure repairs are holding up after yesterday's transbay turmoil. we have live team coverage starting with terry mcsweeney who is live at the west oakland bart station. >> reporter: what a difference a day makes. yesterday at this time the flames were still lapping up towards the tracks at the west oakland bart. they did damage, bart train gone overnight inspection into this early morning. they looked at what they've done and they are saying it is now all systems go full speed full load look at the crews that did the repairs working on the damaged parts that kept bart shutdown for 12, 13 hours yesterday, 100 people working nonstop they got the job done fire at a structure next to the tracks destroyed 45 insulators which hold up a third rail which was warped, 400 feet of communications cable damaged, a lot had to be

done it got done. >> we were testing whether the repairs that we made yesterday were still intact and whether everything was good to go for increased train speeds and everything looks good. the people who worked on it yesterday morning and early afternoon did an awesome job. >> reporter: yesterday we found out what it is like without bart another reminder of how crowded things can get this morning we are going to be finding out what it is like when all systems are rolling as they are expected to be. we've seen trains on the tracks already rolling along, everything looking normal, what a difference a day does make. terry mcsweeney, abc7 news. meantime, federal arson investigators have joined the probe into the cause of the huge structure fire that shutdown the transbay bart service yesterday. amy hollyfield continues our live team coverage with that

part of the story. >> reporter: federal investigators can't get in yet, the building has been red taped they have security guards here watching it overnight making sure that no one gets inside. officials say it is not safe in there yet. but, local investigators want federal investigators to take a look at this case. agents from alcohol tobacco and firearms bureau will be going in as soon as it is deemed safe to try and figure out if the fire was set on purpose. arson team thinks that's a possibility with for two reasons, one because the fire spread so quickly and secondly, because the security guard here reported seeing three young men here right before the fire and says they were harassing him. investigators want to find those men. this building caught fire yesterday at about 2:15 in the morning. it was going to be an apartment complex for low income seniors it was under construction fire destroyed it.

the superintendent or the project superintendent told me he is just devastated that this happened. and he says he can't imagine why anyone would want to set this building on fire. he says it was going to be an asset to the neighborhood. amy hollyfield, abc7 news. of course the big question is where does all of this leave the commute? we head to frances. friday light? thank goodness. bart reporting no delays now. earlier around 4:30 they reported minor 10 minute delays due to track maintenance that could happen later today, so far no big delays everything on time they are on schedule. bay bridge toll plaza, quiet looking like friday light we are hoping it stays that way i am following an overturned injury crash berkeley westbound 80 at university looks like the lights are off now possibly right lane might be blocked no major delays yet

smaller welfare cuts to balance a 15 billion dollar deficit. republicans in the minority, boycotted a hearing complaining negotiations were held in secret. lawmakers risk losing pay if they do not approve a pwaoeubt the deadline. new report issued by california department of education shows 3/4 of the public schools in san francisco maintained or improved their state rankings, rank be -- rankings based largely on test scores from the previous year. 43% of the schools were above average, 43% below. victory this morning for elementary school kids and parents in oakland. alameda board of education has veted to allow lazear elementary school's charter conversion to continue that overturns a previous ruling to shut it down. lazear is one of five elementary schools on the closure list as part of the downsizing plan. it is 5:07 time for a

coast, five mile visibility half moon bay a little cool there 52 oakland 52 livermore good morning antioch 62 for you 50 napa. we are looking at temperatures this morning cooler to start out. we had that radiational cooling with three degrees cooler in oakland and redwood city warmer towards antioch and the trend will be for a pretty warm day this afternoon. if you like it warmer today is your day many tomorrow getting a little uncomfortable we'll call it hot with numbers near 100° inland valleys and warm at the coast 70s for beach weather, that includes high fire danger. high pressure nosing into the pacific northwest that means the wind shift today starting out breezy at the coast out of the west then shift north northeast and with that relative humidity will drop into the teens perhaps single digits add to that more warmth tomorrow it going to be hot

and dry inland for the next couple of days, we'll include today and then at the coast here's your relief with temperatures in the 60s and a bit of a breeze today. tomorrow, still comfortable there and we are looking at numbers today in the 90s inland 76 in oakland. good morning. just got off the phone with chp officer and he said everything was all cleared on westbound 80 at university and sure enough it is, no delays at all the accident was right here, everything cleared westbound 80 traffic flowing well, drive time 18 minutes from the carquinez bridge to the maze. earlier overturned crash not a problem. i am picking up a lot of slowing northbound 880 through oakland with the waze traffic app. it is moving northbound 880 at about 11 miles an hour just north of hegenberger. and we can't figure out what is going on because no

good morning. is 5:30 i'm katie marzullo in for kristen sze. and i'm eric thomas. the repairs appear to be holding at the west oakland bart scene of that fire yesterday that shutdown transbay service. will things get back to normal this morning? we have live team coverage beginning with terry mcsweeney in west oakland where engineers tested the tracks overnight. what did they find? >> reporter: they found really good news for commuters that is that all the repairs that were done look like they are holding, everything should be full tilt, full speed, full load today, neat picture as you look up there different scene you wouldn't know there

was any flames shooting up there yesterday doing the damage and interfering with the commute that went on all day long the problems as a result of no bart service through the transbay tube. take a look at the crews who did all those repairs, did about 12 hours yesterday the bart transbay tube was down, 100 people knocking -- working nonstop got the trains rolling again by 4:00 yesterday fire at a structure next to the tracks destroyed 45 insulators which hold up the third rail. the third rail was warped, also several hundred feet communications cable damaged by the flames inspection early this morning after the trains got rolling yesterday showed it looks like everything is holding. >> for the morning commute we'll have business as usual all the trains are expected to be on schedule and so it should be like this never

happened although it is a vivid reminder of what life is like without bart across the bay. >> reporter: fire yesterday burned started 2 a.m. by 5:15 p.m., 60 trains were rolling normal for a thursday afternoon. good news is all systems go full tilt this morning. terry mcsweeney, abc7 news. federal agents have joined the investigation into what 5 the massive fire thatwhat caused yesterday's transbay turmoil. officials believe it could be suspicious. amy hollyfield continues our vé+ >> reporter: federal and local investigators think they are making progress. they think they've narrowed down what part of the building the fire started in. the big question remains why did this fire happen and was it intentionally set? arson is a possibility, they are looking into. the security guard who was here said three young people were harassing him right

before the fire started. investigators are wondering if they could have set this. they think it is suspicious how quickly the fire spread. agents from the bureau of alcohol tobacco and firearms are here they haven't been able to get a close look yet. >> the scene is currently red tagged by a structural engineer until the engineer says it is safe to work atf will be on scene we will assess the scene and examine and determine what type of resources are needed to work this investigation. >> reporter: this huge fire started at 2:15 yesterday morning. the building was just a frame under construction the wood frame provided great fuel for this fire the flames shot 100 feet into the air and lit up the night's sky. firefighters say it was huge and hot. the building was going to be an apartment building for low income seniors. investigators say they don't know why someone would want to

remains in jail accused of stealing more than a million dollars from his elderly neighbor over 13 years. officers searched judge paul seeman's berkeley hills home last the case involves his 97-year-old neighbor who died two years ago. documents filed in court accuse seeman of taking over  home, investment accounts and safe deposit boxes after her husband died in 1999. seeman offered to help them with their legal issues that year. neighbors were stunned to hear about his arrest. >> he's a top notch stand up guy. he contributes to the community. >> you think the allegations are true? >> they sound surpriseing to me. >> court documents say seeman invested 1.4 million dollars in 40 local properties and did not report it on his tax forms. later this morning, occupy protesters are planning a rally and march in oakland

against evictions of homeowners facing foreclosure. the protest one day after an independent report commissioned by the city was released about the police spwopbs to occupy protesters who tried to -- response to occupy protesters who tried to reoccupy frank ogawa plaza last october. it all many of the policing methods outdated. police chief jordan says he's working to improve tactics. >> these are things we can't do overnight. these are long range changes i intend to implement not something we are going to do right away >> panel made 68 findings and recommendations. the report was prepared by the group which is made up of people with a background in law enforcement. new this morning, san francisco's ethics commission will begin misconduct hearings against ross mirkarimi tuesday.

it is part of mayor lee's effort to remove the suspended sheriff from office. the examiner reports the legal bills are starting to mount and will likely cost taxpayers something in the six-figure range. the city attorney's office says the current cost is confidential because the case is ongoing. in 2007 the city's legal fees into fraud allegations against former supervisor cost taxpayers $380,000. mirkarimi was suspended after he pleaded guilty a misdemeanor in a domestic violence case. time for a look at the forecast for this friday and warm weekend. is that accurate, warm? >> hot. getting into the first part of the weekend certainly hot tomorrow but today warming up and we'll have that cool down by the last per -- latter part of the weekend. clouds around the bay, some of the higher clouds in the north bay visibility pretty good out there, there is a bit of haze in the atmosphere five mile visibility half moon bay if

you hud out -- if you head out this morning, in the 50s low to mid 50s mainly clear by noon 60s and 70s we will warm up rapidly today the winds are going to shift from onshore to offshore component that will increase fire danger in the north bay mountains tonight into saturday morning hot inland with those mid 90s returning and with that offshore flow, some of those winds could be gusting to 30 and 40 miles an hour today. the hottest day of the week will be tomorrow when we see numbers top out in the triple digits perhaps in our inland valleys. then a cool onshore flow returning for father's day. frances has a few minor things with the traffic. good morning. bart reporting a few minor delays, 5 to 10 minutes. we just got word of new crash fairfield westbound 80 waterman injury crash we'll keep you posted on that. so far traffic moving at 63

authorities are still trying figure out what caused a garbage truck to lose control and smash into a home. the waste management truck was making rounds when it lost brakes and rolled backward didn't a hill. the 24 ton truck first hit a parked suv sending the vehicle into a house. the truck kept rolling and smashed into another house the truck came within four feet of hitting a man inside the home. no one was injured in the unusual crash. in richmond the suspect in the hit-and-run murder of a man in a wheelchair is in jail first ladying a nine month investigation. 25 year -- following a nine month investigation. the 25-year-old was charged. an undercover drug operation led federal authorities to barnett who was linked to the car and the fatal crash. good samaritan being

called a hero for helping pull a boy out of the bay in san francisco he helped save the boy as his family struggled to get him out of the water. people saw a family leaning over the edge and throwing a life ring into the water yesterday that's when aaron washington got involved. >> noticed a small child in the water he wasn't able to grab the life ring on his own at that point in time i took a life jacket from one of my crewmembers and jumped in to assist him. >> washington nonchalant about the incident after jumping into the water helped the boy hang on to the life ring and threat to an area where they could climb out of water. paramedics say the boy is just fine. 5:45. is our cell phone safe to use? that's what the government wants to find out. bloomberg business report is straight aide had. political showdown on the number one issue facing the country.
