the judge just left with his attorney. he made a court appearance and he faces charges of looting his neighbor of her financial fortune. this 57-year-old judge accused of stealing $1.6 million from his neighbor appeared in superior court with nothing to say. >> there is no dmonts make. we haven't seen the discovery or had a chance to read the complaint or amended complaint. >> court papers filed by the district attorney accused him of siphonning his neighbor of her fortune. the 97-year-old who died two years ago lived in this house. according to documents he befriended the neighbor in 1998 and by 2004 had taken over almost all of her finances, adding his name on her bank and investment accounts, at the time, totalling $2.2 million.

prosecutors are also charging him with perjury with failing to disclose annual income required by law. the district attorney says that the alleged conduct of the judge is both disturbing and disappointing. his alleged conduct is in no way a reflection of the outstanding calendar of -- caliber of judicial officers serving alameda county. the judge did not enter a plea. the next court appearance is july 3. >> thank you, investigators have not been able to begin collecting evidence from the scene of yesterday's big fire near west oakland bart station. that site just too dangerous. and abc 7 news is there live now with the hatest on this investigation. >> so investigators spent the day collecting other evidence from around the scene, like surveillance video from nearby businesses or interviewing people who might have seen

something suspicious. just a half hour ago an engineer arrived and they're able to go inside for the first time since this fire was put out and that deemed the structure unsafe. and this early morning fire damaged the elevator tracks causing the terrible commute but the fire damaged the first floor but what was supposed to be a five-story apartment building. the oakland fire department called in the federal atf in part because of the scale of the blaze and after an engineer looked at the scene atf agents and investigators will not likely begin work for a few more days. >> that with sure a process could take three to four days. there is a large platt form, want to make sure we don't miss anything. >> and the engineer has to recommend how to shore up the structure, we're looking at
