good morning. 5:01. i'm katie marzullo in for eric thomas. and i'm kristen sze. parents of an oakland elementary school are camped out now determined to force the district to reopen their school this fall. sue thompson is live at lake view elementary. >> reporter: good morning. this protest is now entering into its fourth day here at lake view elementary parents are not happy with the district. been camping out for the last four days 20 or so tents continues on people angry that oakland elementary school has been shutdown. demands of parents took center stage over the weekend with a rally. they say their request is simple, reopen lake view. they say they will not go away until that happens. the district says the school and four others were shutdown

because of budget cuts and declining enrollment. lakeview elementary the district says is slated to become administrative offices. parents say that won't happen without a fight. families say the money is in the district. they have the money to keep the school open and they feel they are targeted because the school consists mostly of african-american and latina children. >> what is happening is we are taking our school back taxpayers, parents, teachers, students are taking the space that belongs to them back. the school does not have the right or power to close schools. every neighborhood deserves a school in it. >> reporter: so far the oakland unified district says the parents that have been camping out since friday can stay at least for now. parents say they have a press conference scheduled for later this morning at 10:00 to talk more on this issues bye say

they will do whatever they can they are trying to save the school and their children's education. sue thompson, abc7 news. developing news in oakland. police are investigating a freeway shooting that critically injured a man and shutdown eastbound 580 for flee hours overnight. officers received the call before 11 last night witnesses say five shots were fired and victim seen limping from the car which was near the fruitvale exit. the chp kept eastbound direction closed until 2:00 this morning to investigate, no suspect information has been released. amy hollyfield will update this story in a live report coming up. a 62-year-old mentally ill homeless man set to return to court today suspected of starting a fire near a castro district home last week. investigators trying to determine if hes involved with

several arsons -- last year. the 62-year-old pleaded not guilty friday in connection with last week's fire. investigators say last week's fire was similar to three suspicious fires that damaged homes during a 24 hour period beginning february 3rd, last year. later today crews will take part in a three-day wildfire training session. the exercise will be held at the lexington reservoir south of los gatos. the event allows firefighters, police officers, medical volunteers and other emergency reponders to work during. san mateo police looking for someone who tried continue tension ali run over three cyclists before -- tried to intentionally tried to run over three cyclists at east 4th and south grant. you can see the tire tracks on the sidewalk where the vehicle jumped the curb no one was hurt and police are still

looking for more witnesses. in the north bay the 68-year-old driver suspected in a hit-and-run that injured a bicyclist this month is expected to enter a plea this morning. he was arrested 10 days ago after an off-duty police officer spotted a pick-up truck with front damage that matched the description of the suspect's vehicle the crash injured 68-year-old retired state university professor. he says he left the scene because he was late for work. a judge is expected to decide if dozens of suspended seniors at heritage night brentwood will be allowed to make up finals they missed. graduation day was nine days ago. 67 seniors weren't allowed to attend after they were suspended for a prank. they graduated off campus at an alternative party hosted by parents of the suspended students. starting tomorrow the

ethics commission will begin hearings to decide whether suspended sheriff ross mirkarimi should lose his job. last week a key witness provided a contradictory account of the dispute between mirkarimi and his wife and the bruise on eliana lopez's arm. the neighbor wrote about her conversation with lopez who described the couple's fight the night before. madison writes ross grabbed, pulled and pushed her violently specifically she said he slammed her against a wall while grabbing her arm and refused to let her go >> it is a 22-page declaration most has nothing to do with official misconduct. i'm shocked by it. >> mirkarimi said publicly the argument happen in the car and the bruise was inflicted while mirkarimi was trying to prevent lopez from leaving their vehicle. alameda council will consider a plan for more open spaces.

the driver is in critical. he's in the hospital. he did survive this attack. witnesses thought they heard five shots. this happened around 11:00 last night. police had a crime scene to protest on the -- crime scene to process on the highway that section was shutdown until 2:15 this morning. they haven't found the shooter, they haven't gotten a description of the suspect to release to the public. at this point, the investigation continues. amy hollyfield, abc7 news. oakland police are looking for clues in the stabbing death of a well-known artist this image shows michael thorn bradley in his studio in 1980. the 62-year-old was found dead in his home on market street last thursday a $10,000 reward

is being offered for the information that lead to the arrest of bradley's killer. in oakland police believe a man was trying to break up a street wife when he was hit deliberately officers arrested the woman they believe was driving the car the victim died after being hit. witnesses say the woman was involved in the fight. two east bay families grieving the loss of two fathers over the weekend, while most families celebrated father's day. ace moore one of three who went fishing friday night on this boat which he just bought he and his cousin johnny johnson drowned when their boat capsized early saturday morning. yesterday searchers recovered both bodies. >> my uncle grabs on to the boat and my cousin and father didn't grab on quick enough. his sister came to my mom's house in the morning saying ace left his life jacket at

the house. >> sheriff investigators say wearing life jackets would have saved both lives. the defense is about to take center stage in jerry sandusky's child sex abuse trial. prosecutors could rest today. sandusky's signaled they will put on a case and suggested that sandusky may testify. the 68-year-old former penn state assistant coach is charged with the sexual abuse of 10 boys over 15 years. he denies the allegations. jurors have heard from 20 prosecution witnesses including eight young men who say sandusky sexually abused them as children. an autopsy is scheduled today for rodney king whose beating in california lead to the state's worst race riots.
