closed captioning by closed captioning services,inc good morning, i'm cheryl jennings. kristen sze is off today. a frightening tack long highway 580 in the east bay. highway patrol says it happened east of the fruitvale exit last night. katie marzullo joins us from oakland. how is the victim doing now? >> reporter: i just come from inside oakland police department. a spokesperson tells me the victim is still in critical she used the word grave. as for the suspect police department not forthcoming not releasing any kind of

description. it sounds like they might have good information to work with. there was a passenger in the victim's car. that man was not hit or injured. he should prove to be a good witness. police department has cameras in that area so it is possible they will have surveillance video. it was about 11:00 last night when there were officers in the area who heard the sun fire. they knew it was coming from the an 0 fruitvale area. when they arrived -- a man approached and said he was the passenger in an eastbound car and another eastbound car pulled up along side them and opened fire and the driver was hit. >> our victim vehicle was traveling eastbound 580 fruitvale avenue area when another vehicle came along side and fired several rounds at the victim vehicle. one of those rounds did strike the driver of the victim vehicle. the driver is currently listed

in critical at a local hospital. >> reporter: oakland police are not revealing much of this investigation at this hour. they will not say whether the parties in either car knew each other or have some kind of confrontation ahead of this shooting or if they know of any possible motive. katie marzullo, abc7 news. detectives looking for missing south bay teen sierra lamar want a dive team to rescan a reservoir. the new search is not based on tips or leads. investigators are hoping the new sonar equipment might uncover new evidence. 15-year-old sierra disappeared three months ago on her way to school. antolin garcia-torres is charged with kidnapping and killing her based on dna found in his car and her discarded clothing. this morning a judge ruled the wife of ross mirkarimi can extent her stay in venezuela.

she will be age to stay in her hometown until august 19th this is video of dan noyes when he traveled to caracas for an interview with lopez. she left san francisco with the couple's 3-year-old son march 25th. mirkarimi pleaded guilty to a misdemeanor after a domestic violence incident. he face as ethics investigation that could result in his removal from office permanently. that hearing starts tomorrow. oakland parents and teachers protesting closure of their children's school are being told to leave by school police. parents camped out overnight. sue thompson joins us with that story. they were going to hold a news conference this morning. >> reporter: yeah, things got turned around here you might say this morning. lakeview elementary in oakland has been the site of protests for the last four days.

police officers issued a warning. >> you take that for being aggressive. i don't know where your bar is set. >> six officers walking to an elementary school. >> reporter: exchange of words between a parent and oakland district police early this morning officers gave the order that everyone on the campus must go. >> this is an official notice saying please vacate the school district prompt. >> reporter: the last four days parents have camped out here in protest, angry this oakland school and four others were shutdown. >> these public buildings belong us to, we are taxpayers they have no right to be taken away it is not okay we want parents and teachers and students and community members to take back their schoolses across the country. >> reporter: lake view will be the new headquarters. the district offered to move the students to three other

schools. many families here lack transportation. and the district offers no bus service. >> we are not going to send an 8-year-old or 7-year-old across town on public trance. >> >> reporter: the unified district blames closings on declining enrollment and budget cuts. a teacher says, her former students worry now about their safety. >> now they have to go to other schools and some back to neighborhoods that are not so great and they've talked about shootings and all. i know that they felt safe here itch >> reporter: in all, -- 900 students are impacted by the closures. minutes ago i spoke to the oakland unified district spokes person he told me police didn't issue that warning they would like people to leave. they will move people out and escort people out, if necessary.

the protesters say they are here to fight for their child's education and they are going nowhere. sue thompson, abc7 news. breaking news in martinez. a judge has ruled all students at brentwood heritage will be allowed to make up exams. graduation day was nine days ago, 67 seniors were not allowed to attend because they were suspended for a prank that school officials say was vandalism. the students graduated off campus at an alternative party hosted by parents of the suspended students. autopsy scheduled today for rodney king whose beating by los angeles police led to the nation's worst race riot. king was found early yesterday morning at the bottom of the swimming pool at his home. police say there are no signs of foul play they are treating his death as drowning. he became known around the world in 1991 when a tape

showing him being beaten by los angeles police officers was shown. since then king has struggled with addiction and repeated arrests. rodney king was 47. >> first defense witness took the stand today in the trial of jerry sandusky. the former assistant told the jury he and other coaches were present in team showers when sandusky brought young boys into the showers. he testified he never saw anything inappropriate and it was not unusual for sandusky to shower with boys at the ymca. prosecutors rested their case after the mother of one of the accusers testified her son's underwear was frequently missing from the laundry. also today, prosecutors dropped one count against him, he has maintained his innocence. president obama and the leaders of the world's top 20 economies are meeting right now in mexico. the president arrived last night. president obama and the other leaders may be breathing a collective sigh of relief

memoir detailing what edwards' mistress says really happened in an interview airing later this week,-er tells chris cuomo she wrote the book for their 4-year-old daughter, quinn. this morning in quotes from the new memoir purchased by the associated press ahead of its june 26th, release date she reveals details of a call with edwards days before his indictment. if you to jail what kind of jail would it be, one of those country clubs? he said, yeah. where she asked? probably virginia he replied. so quinn and i will move to virginia. virginia is a great state. prosecutors dropped all charges after his case ended in a mistrial in may. prosecutors accused edwards of scheming to use one million dollars in funds allegedly funneled through his campaign to hide a then pregnant hunter from the public and his wife.

in much of the memoir hunter describes her relationship with edwards before she went that hiding as well as now and discusses his role as a father to quinn. he is a great dad to her, when he is with her. our relationship, a choked up edwards talked about moments after his trial ended. >> my precious quinn, who i love more than enough you could ever imagine. and i am so close to and so, so, so grateful for quinn. i'm grateful for all of my children. >> you can watch chris cuomo's interview with rielle hunter this friday on 20/20. she will talk about the current status of her relationship with edwards.

hockey mom stepped out on the ice to stop a fight. it started when a fight broke out in the middle of this youth hockey game. one referee blew the whistle but didn't intervene. so she took matters into her own hands stormed on to the ice with her purse in land to shout at the rev to get things -- to get -- the ref to get things under control. >> initially he thought he was going to be grounded for fighting. and he was a little embarrassed that understood the reasoning why i went out there to stop it. and he knows it is not something that we encourage him to do. >> the fight broke up as the two left the ice she later apologized for using colorful language. >> lisa argen in for mike. we don't want to know what those words are. we have clouds in the city, east bay in the 70s, beautiful

oakland kicks off free summer lunch program today for children in the city it helps feed 20,000 kids who depend on free and reduced meals during the school year. the meals are available to anybody under 18, no requirements or paperwork. the free lunches will be served at more than 130 sites including schools, libraries and community locations. to find a site near you go to abc7news.com under see it on tv. grey service. it was fog -- great service. >> was foggy when i got up.

solstice first day wednesday. look how much cooler, 16° cooler right now than yesterday in santa rosa, livermore, concord elsewhere not as dramatic because we had a lot of cooling around the bay with the winds yesterday. today southwesterly winds gusting to 33 miles an hour through the delta, signal into the east bay valleys you are going to have a nice day. if you like it warmer we have that on the way. here's the rest of the bay, clouds continue to erode back to the coast, partly cloudy downtown fog still along the shoreline. despite the fog from the north coast to southern california, we have red flag warnings in the sierra nevada with windy conditions and also in southern california. really, our weather around here is pretty nice. weak disturbance that will continue to push north of us as we get on the back side, that's when our wind shifts and we will see pretty nice

600,000 toyota camries and other vehicles to an investigation of fires in power window switches. the safety administration says the investigation now clouds -- includes more than 1.4 million vehicles from the 2008 and 2009 models. the camry is the top selling car in the united states. also affected 2007 to 2009 yaris subcompact and all 2008 highlander hybrid suv's. the investigation began in february so far the problem has caused 161 fires and nine injuries. the vehicles have not been recalled. >> microsoft is expected to make a major announcement a few hours from now. speculation about the los angeles event is the company plans to sell a new tablet computer or a system that uses an upcoming version of windows to access tv and movies could give the company a better chance to compete with ipad.

efforts to send sure internet searches. those -- censure internet searches. police in san francisco took their turn carrying the special olympics flame of hope it just ran down the embarcadero this morning's run covered eight miles of the torch passed to officers along the way. it is making its way to davis for the special olympics which begin this friday. the law enforcement torch run is now a global event. last year it generated more than 42 million dollars for special olympic programs around the world. such a great cause. that's going to do it for us. who wants to be a millionaire is next have a great day.
