dozen protestors in and around the school. few of them aggressively controlling access to the building preventing anyone from getting anywhere near the campus. police put up fliers telling people to leave medley but it doesn't appear that die hard will budge. this is the start of night number 4 outside lake view elementary school. protestors camping out again intent and wondering if police will bring the demonstration to an end. >> they will do what they feel they need to do. police have a job to do. we have a job to do to stand up for public education and we think, this incident we feel that we are right. >>reporter: earlier in the dai day a sergeant from oakland pd and several police officers from the school district entered lake view after demonstrators got into the building and setoff alarms. >> we are not doing anything with the tent right now. >> you are not going to secure the building. it will remain open overnight. >> that remains to be seen. we are making sure everything is on up and up. >>reporter: this afternoon dozens of protestors including

parents community members and occupy oakland supporters crowded in front of the school on grand avenue. ft now fact they left now doesnt mean that it's over. we can't trust them at all. >>reporter: lake view is one of 4 oakland public schools not reopening this fall. another one is being converted charter. charter. district says it has too many schools for its size and the closure will save closut two million dollars. >> part of the thing is that some of these buildings they arenoney on them to change them into administrative offices. if they have the money to do that then they have the money to keep the schools open. >>reporter: immediate concern for the district is getting its building back. peacefully. if certain elements of the movement were to im bed themselves to fortify themselves, that would mextractt for both parties. we want this to be resolved to negotiations without conflict. >>reporter: but for now the protestors maintain control of

say tim hand began stealing money for the important toll valley school district months after appointed superintendent and chief business officer two years ago. all of this came to light when auditors began checking the district books after hand was charged in april for misappropriation of fund while workingide elem the woodside elementary school district. investigators say the audit revealed suspicious invoices that totalled 100,000 dollars from the district solar panel escrow account. >> what they found 6 of the invoice were his not devoted to solar panel for the school. they were renovation at his own personal home yet the school district money was being charged for that, invoices run through the solar account. >>reporter: pictures of his home can be found on his architect web site. according to the contractor the renovation included work on the foundation, basement and kitchen. the superintendent is out on bail and has been charged with 7 felony counts of embezzlementbezzlement >> i think you need to leave. >>reporter: we tried giving
