"good morning america" will have more at 7 a.m.. in a few hours ross mirkarimi will be in court for a progress report on his domestic violence counseling. at 5 p.m. the city's ethics commission begins hearings on whether he should be removed from office on misconduct charges. mayor lee suspended mirkarimi after he pleaded guilty to a

misdemeanor false imprisonment charge after a domestic violence incident new year's day. this will be his chance to defend himself against the mayor's action. the commission will make a recommendation to the board of supervisors. the supervisors will decide whether to remove or reinstate mirkarimi to office. mirkarimi is planning to visit venezuela where his wife eliana lopez has taken their son. i-team reporter dan know yes, sir traveled to caracas for an interview with lopez. a judge ruled yesterday she can extend her stay there until august 19th. and mirkarimi can visit his son as long as he stays away from his wife. san jose man who worked with special needs kids for years is expected to be in court on child molestation and rape charges. police arrested the 33-year-old last week. he's accused of sexually molesting two young girls in his care and raping an 18-year-old woman with the

elementary school prompting more action today. katie marzullo is there live. this is the fifth day? >> reporter: correct fifth day and they promise more of the same. right now it is quiet there are a couple of protesters one parent awake. most of the tents, all of the tends are behind the signage on campus and across the street there are two police officers parked in a strip mall parking lot across the street making sure there is no trouble here keeping quiet. i saw one parent speaking with the officers he says they are friends and all is well here this morning. as far as what you can expect later today we have video of the protests that happened yesterday. a lot of signage, dozens of parents, at issue not only the closing of this school but four other schools and turning a fifth into a chart are school. parents contend that is due to

mismanagement and they could keep the schools open if they wanted to. the district says there aren't enough students to support having all these schools there's been declining enrollment and they are in the case of lake view going to use the campus for administrative offices. the spokesman for the district said yesterday they would give parents a grist period and they were welcome to be out here and protest but eventually they would have to leave and closures are moving forward. yesterday there was a brief incident with police officers coming on the campus apparently alarm was going off they wanted to make sure nothing was being vandalized, it was not. they did tell the parents they would have to leave. parents say short of being arrested, they are not going to lee they've opened a summer school here. they have -- to leave. they've opened a summer school here. they say community members joining in support and donating food and water and

off. deliberations could begin thursday in the jerry sandusky child molestation trial. defense testimony began yesterday with character witnesses who defended the reputation of the former coach. one former coach testified that he knew sandusky took boys into showers but never saw him do anything wrong. he told jurors it was not unusual for grown men to shower with boys in the penn state locker rooms. sandusky faces 50 counts of abusing 10 boys over 15 years. list are using cell phone video in their hunt for a man who vandalized a picasso at a houston museum. the vandal spray painted a picture of a bull and the spanish word for conquer. it happened last week. authorities just releasing the video now. a museum patron shot it while
