amy hollyfield is live at the san mateo county courthouse. >> reporter: prosecutors will start spelling out their case in the courtroom. they believe he was using school district money to renovate his home. tim hanretty faces seven felony counts of embezzlement. he's out on bail. trouble for him starred in april when he was charged with misappropriation of funds while working for the wood side district. auditors started looking into the books at the portola valley district where hanretty was working as superintendent. that audit shows he was using money on his house that was supposed to be used for the district's solar panel expenses. parents find the charges very upsetting. >> really nice guy that's partly why it is shocking. big disappointment. like really? these are kids that's really what everyone feels, find some

place else to finance your home. >> reporter: hanretty was having work done on his home's basement, foundation and kitchen. he and his attorney are not commenting. he's due in court this morning. if convicted he could go to jail for up to eight years. amy hollyfield, abc7 news. this morning it appears push may come to shove at lakeview elementary in oakland where parents have been camped out since friday demanding the district keep that school open, a few dozen or so protesters around the school this morning. police told them to leave immediately it doesn't seem they are willing to budge. lakeview one of four oakland public schools not reopening. katie marzullo will have a live report in the next half hour. man convicted in fatal shooting of a man outside a san francisco nightclub faces sentencing this morning.

the shooting took place two years ago following an argument. last machine a jury found the 22-year-old guilty of first degree murder. davis was shot and wounded by a security guard at the scene. a second suspect was never caught. davis faces 50 years to life in prison. this morning a military judge will consider with whether to delay the trial of the army psychiatrist charged in a shooting rampage at fort hood. whether major nadal hasan will be at his hearing is unclear the judge has said he would bar hasan from the courtroom if he still had a beard which violates army regulations the judge postponed the hearing this month when he showed up with a beard. hasan is accused ever opening fire in november of 2009, killing 13 people and injuring more than 30. the former rutgers university student accused of spying on his gay roommate was just released from a new jersey jail. dharun ravi fist faced 20 days

on ,lw 30/1a day sentence. -- he recorded his roommate's intimate with another man the roommate committed suicide after the recordings went public. 9:00 this morning, suspended sheriff ross mirkarimi will be in court for a progress report on his domestic violence counseling. at 5:00, he will be there for the start of ethics hearings on whether he should be removed from office. this will be mirkarimi's chance to defend himself against mayor lee's decision to suspend him without pay that happened after mirkarimi pleaded guilty to a misdemeanor false imprisonment charge. the commission will make a recommendation to the board of supervisors will decide mirkarimi's fate. in san mateo this morning two men under arrest facing charges of trying continue ali run down cyclists with their truck. the two teenaged boys were riding their bikes in the area of 4th and grant sunday,

department is the lead agency we'll try to get more information. new this morning, new york lawmaker asking google to blur out images of people from its map feature. he says that violates your privacy. senator schumer made the request after discovering the latest batch of data includes images captured from planes. he fears the new data violates privacy because it could show people in their homes doing private things such as sunbathing in their own backyards. google says the resolution of the images aren't clear you have enough to identify images the company says it won't comply with the request. facebook required high-tech israeli company hoping to further mobile market face.com's product allows users to click a picture of their facebook friends and tag it automatically before posting on facebook. the technology works only on the iphone right now. facebook has been using it for two years.

protest. if you take a look behind us, you will see the signage covering the fence around the school and the parents are sleeping in tents just beyond that signage. other signs read, 4 p.m. rally today this group, based on signs and what they've told me are moving ahead. here's what it looked like yesterday. a lot of parents gathered here, protesting the fact that the district is closing this and four other schools turning one into a charter school. they accused the district superintendent tony smith of mismanaging the money. one of signs out here reads, tony smith reopen or resign. the district says there are not enough students to fill these schools and closures will save two million dollars a year more than two million dollars a year. the district has asked parents to leave. they say this camp out will have to end that is not what the parents are saying. >> we are pointed how the district is handling all of
