good thursday morning. thank you for joining us i'm kristen sze. and i'm terry mcsweeney in for eric thomas. breaking news in berkeley. a house fire has claimed a life. katie marzullo at the scene. >> reporter: good morning. the fire broke out around 2:36 you can see how many crews are on scene. they are still worried there could be fire in the walls at this old victorian home. we have video you can see how the fire was burning. this was a fatal fire in this home. the chief describes it as a three story home the basement, main floor and attic space which appears to have been converted into a lot of area where the young woman was who did not make it out alive. >> they did find one patient

on the third floor attic space. they were able to retrieve her out and bring her out to the air. once she was out of the structure she was being assessed, cpr initiated, later the patient was determined to have passed. >> reporter: the deputy chief couldn't tell me the cause of death he did tell me two others were hurt and have been taken to the hospital treated for burp and smoke injuries. they -- for burn and smoke injuries. they don't know where fire started or how. that's what investigators will have to determine. investigators looking into whether or not there were working smoke detectors in the home. there were eight people living or staying inside this home. there are five others remaining who the red cross is on scene helping them find shelter. katie marzullo, abc7 news.

developing news, san francisco fire investigators will be sorting through the debris this morning after yesterday's massive fire along the waterfront at a pier that will be developed for the america's cup race. amy hollyfield is live at pier 29. we were able to drive up the embarcadero this morning. >> reporter: you can drive on the embarcadero this morning. but, there's a good chance people are going to slow to look at what is left. they have fenced off the area. there are still huge chunks of the facade lying on the sidewalk they roped that off during the fire and called it the collapsed zone. today firefighters will concentrate on what is left looking for the fire's cause. the fire was huge, pier 29 has 115,000 square feet of warehouse space. firefighters used every water source that was available, including water from the bay to knock this down as quickly as they could. the building was empty, no one

was hurt during this fire. several tourists and a lot of locals gathered to watch and take pictures of the fire. the embarcadero was shutdown in both directions which caused a huge traffic problem in the area. firefighters dealt with this four alarm fire. >> crews did a phenomenal job containing the fire to the front building it didn't spread to the adjacent buildings or the rear structure. we have a fire boat in the rear of the structure. >> reporter: this pier is being converted into a center for spectators for next year's america's cup race. welders were in the building earlier, no one was here at the time of the fire. a spokeswoman says the fire will not impact plans they look forward to moving ahead with the construction of the america's cup village here at piers 27 and 29. here's a live picture of the embarcadero things are moving

without problems. they've opened up all lanes. this bike lane, a section of the fence is spilling on to the road a little it could be an issue for bikers later today and looky lous might pause the fence does jut out the chunks are something to see lying in a heap what is left. amy hollyfield, abc7 news. in a few hours testimony in the trial of a man charged with bating the priest he says molested him and his brother when they were children will resume in a san jose courtroom. 44-year-old william lynch is accused of beating the father in 2010 at a retirement home for priests. yesterday the prosecutor said evidence will show the father abused lynch when he was

7-years-old. she said the priest would likely lie about it. later the priest was call to the stand and denied molesting the two boys. >> not only did they give us a warning they were going to put on perjury testimony, then lindner denies he molested mr. lynch or her brother. >> the district torn says the molestation did not give lynch the right to track down his abuser and punch him repeatedly. this morning closing arguments set to again in the jerry sandusky child sex abuse trial. the defense rested yesterday without calling the former penn state assistant coach to the stand to dispute charges that he molested 10 boys over a decade. sandusky's consisted of character witnesses who dreaded his reputation including his ex-wife who said she never saw her former husband do anything inappropriate with children. sandusky faces 51 criminal counts.

if convicted he could be sent to prison for rest of his life. family of a berkeley man killed by intruder setting stage for lawsuit widow and children of peter cukor filed a wrongful death claim against the city. he was killed in february after calling 911 to report an intruder. the family claims he was told by a dispatcher that help was on the way but the dispatcher never intended to send it and told an officer not to spoken. city of berkeley has not responded to requests from abc7 news for comment. this morning, oakland mayor quan's office is admitting the city's crime epidemic goes well beyond the 100 blocks she has repeatedly claimed were the most dangerous. mayor quan's top aide says the key statistic the mayor used to sell her program was inflated. recent study found quan as 100 block plan only covers 17% of

welcome back. looking out from the roof cam at bay bridge, one of the longest days of the year cooling trend on the the way. sue has traffic. here's kristen. first full day of summer. >> yeah. more news. governor blount backing down from his controversial proposal to protect the bullet train project from injunctions requested by environmental groups. brown's staff indicated he would scrap exceptions for the high speed rail project. the governor is asking legislature for six billion dollars to start construction as early as december. lawmakers will decide early next week. it appear the stand was jeopardizing support for the project from environmentalists as well as labor unions and big engineering firms.

a judge has decided not to overturn suspend shuns of dozen of -- suspensions of dozens of students the judge rule the right to due process for the 67 seniors was not violated but call the punishment by the district harsh. the judge says he could review the case again if the high school doesn't allow students to make up missed final if they are denied college admission for loses scholarships. they were not allowed to attend graduation because they were suspended for spraying the school with graffiti. bay area lawmaker stopped his efforts to regulate how personal information collected by license plate scanning technology is stored. according to california watch, unit of the center for investigative reporting. the high-tech cameras are used by law enforcement agencies to scan license plates for stolen cars. palo alto senator has proposed a bill in march after an

a coma but off life support. new poll shows president obama opening a significant lead overhis likely republican opponent mitt romney in the presidential race. poll shows 53% of likely voters support mr. obama even though the public gives him low marks on handling the economy. 40% support rom the former massachusetts governor has yet to repair damage done to his image during the gop primaries. more than half surveyed say romney is more out of touch with average americans compared with 36% who say the president is more out of touch. florida police chief who was strongly criticized for his handling of the investigation into the killing of trayvon martin has been fired. city manager says chief bill lee lost the respect of city officials and confidence of the community. he was criticized for not immediately arresting george zimmerman for shooting martin. the teenager's family says they respect the decision.

one of america's most iconic artists has died. painter leroy neiman passed away in manhattan yesterday. best known for miss mustache, broad strokes and painting some of the world's biggest sporting events. cause of death has not been announced. leroy neiman was 91 years of age. new study challenging long held belief that pregnant women should not drink any alcohol. more than 1600 pregnant women drank one to eight drinks a week the study looked at children five years after they were born and found kids did not perform any worse on organizational and i.q. tests than children whose mothers did not drink at all many doctors disagree and recommend expectant mothers to be better safe than sorry. >> we know alcohol is a toxin
