i complied, gave him my wallet and he still, still pulled the trigger. >> for whatever reason the gun never fired. >> i looked up. the guy was right there with a gun in my face. >> what did he say? >> he just said basically brace yourself, give me everything you have, and i complied. i gave him my wallet and i gave him my wallet, he pulled the trigger and it locked up and clicked. >> gilbert said the gunman still wasn't satisfied. >> i walked over the truck. gave him my hat on the ashtray, he wasn't satisfied. threw it down and he mentioned he was from a city called oakland and he wanted more. >> the ordeal ends when the armed robber tried and failed to get into the house. >> he again squeezed the trigger, and at that point i put the key into the lock, trying to get into the door. and he squeezed the trigger again. and i opened the door, i ran in, closed the door, locked it.

>> gilbert then called 911. he thinks the gunman followed him home in a white honda accord. it was only about a month ago he installed surveillance outside his home for safety and peace of mind. he never imagined they would capture him becoming a victim. >> not in a million years. you always think it's going to be the other person. never you. >> the homeowner says he wanted to tell his story on television to get the word out that things like this can seemingly happen to anyone and that people should be aware of their surroundings. in antioch, abc7 news. a pregnant woman is recovering this morning from a beating while traveling on bart, and she said there were a lot of people there but no one tried to help her. 26-year-old emma has a black eye and bruises while she said a man and woman attack her while traveling home from concord. she said the man beat her while the woman tried to grab her i-phone and she said at least 15 people stood by and watched. >> you need to protect yourself. people will see you, they are in

a public area, they see you but they wouldn't get your back. they will just watch you until that person kills you or something. >> well, finally someone did step up and pulled her into another car. bart police say passengers claim they tried to help her, but backed off when the male suspect reached into his waistband , perhaps reaching for a weapon. the suspects were caught at the bay point station. the chp has alerted san francisco police to watch for a car they believe was involved in a fatal hit-and-run near mountain view. >> judgment before 4:30 yesterday afternoon police say a white toyota camry caused this car to swerve off an off-ramp on north bound 85. the driver of the audi, a female mountain view resident in her 20s, drove into a tree and died at the scene. the license plate of the suspect vehicle is 5jnm 316.

a sacramento man is back home this morning after his 50-foot boat was struck by a whale during a sailing trip off the western coach of mexico. he was on the final leg of his trip from the east coast to emeryville when it happened last tuesday. the 67-year-old retired high school teacher said the whale seemed to come up out of nowhere, hit his boat and sent him nearly flying overboard. >> i didn't like the idea of drowning. i accepted the fact that this is not going to -- it is not going to work. >> well, five hours after the accident, young was rescued from his sinking boat by a freighter which went off course to help him out and save his life. >> coming up next, details about presidential candidate mit romney's weekend-long retreat to boost fundraising. also the fight against school closers in oakland. parents and students hit the streets to keep those schools open.

fewer people. all signs are point to go a victory by the candidate of the muslim brotherhood. but there is an increasing speculation that the last prime minister backed by the ruling military council could be instead declared the winner. this morning republican presidential candidate mitt romney is at a private retreat in utah where much of the talk is about campaign money. romney is hosting a gathering with gop fundraisers, donors and possible vice presidential candidates. security is extremely tight. no cameras allowed. romney is not releasing the names of his fundraisers, but one did talk to the media, reflecting a very enthusiastic attitude. >> i'm going to do everything i can. bundle every penny. >> they said romney has a chance to equal or maybe better president obama when it comes to fundraising. today the president released his weekly message and marked the 40th anniversary of title 9 which promotes high school and college sports for women, calling with a springboard for

success. coming up on abc7, a showdown over the fast and furious scandal. the president claims executive privilege. the attorney general faces contempt. today the man leading the charge faces tough questions. california congressman darryl issa on "this week" with george stephanopoulos coming up at 8:00 on abc7. in oakland the battle to stop four schools from closing continues this morning. parents and other protesters have been camped out at lakeview elementary school for more than a week. now marching is part of the protest. lisa explains why the district refuses to budge. >> the school board shut down five schools and foreclosed on 1,000 of our children. >> hundreds gathered at the plaza to demand change and then they marched. [chanting] >> parents, teachers, students and people who are simply concerned with the direction of

education, united. they want the oakland unified school district to reopen five elementary schools. the board voted to close them. the outrage has prompt add sit-in at lakeview elementary where parents and children set up tents and have been camping out since last friday. on monday police posted warning signs ordering occupiers to leave. they refuse to budge. >> the board needs to revote and be hero instead of standing in our way so we can improve public education. >> as for revisiting the school closure discussion, that's a decision the board would have to make, but i think it's extremely unlikely. >> the district insists white now there are way too many schools in a city of this size and student enrollment is dropping. officials say consolidating will make the school system for efficient and it will save the district $5.7 million. >> could we keep these schools open if we wanted to keep limping along the same way we have or only make small

rain to northern california. from the sutro camera, what a pretty shot. talking about lots of sunshine today but the air mass remains a little bit below average, on the cool side. live doppler 7 hd. we are looking at very little in the way of low clouds. but some fog has been floating around is the shoreline. don't be surprised if you see some of that. look at the numbers. 43 in santa rosa, 46 in san rafael with mid-50s from around san carlos. 52 fremont and 50 half moon bay. temperatures this morning cooler than we were yesterday. as much as 5 degrees cooler san jose with 3 degrees cooler between now and yesterday morning in santa rosa. and the coast, as well. so with the clear start, temperatures are definitely kind of chilly out there. but sunshine this afternoon. we will recover, only into the 60s and 70s, though. we have warmer weather in the affing. but today take a look where we should be. we should be seeing more low and

mid-80s from redwood city to livermore and san jose, but with only low 70s forecasted anywhere from 11 to 12 degrees below the average. also north end ever the bay in santa rosa, same deal with low to mid-60s, san francisco and oakland today. so area of low pressure continues to spin to the north and west of us, bringing some rain into northern california yesterday. and today really not making much in the way of in roads out of here. so as it sits here, we will continue to see the northwesterly winds throughout the afternoon increasing and allowing for the temperatures to stay within that range of, oh, about a 15-degree spread. so with that, we will look for just 70s around most of the bay, but a couple 80s popping up from sacramento, mid-60s in the syria, and upper 70s in yosemite. if you are med to the a's game, once again, we will see the 60s in the afternoon. but with the northwest wind up to 20 miles an hour, it can get a little cool later on in the

afternoon. lots of things going on today. the a immediate da county jail. but in san francisco with numbers starting out in the low 50s right now. upper 50s about 10:00 and low 60s in the middle of the afternoon. and into the north bay we go, just low 70s for sonoma county, nascar. but a beautiful afternoon with mostly sunny conditions. temperatures from milpitas to san jose today, santa clara valley anywhere from 70 there to 70 sunnyvale. 68 menlo park with numbers in the 60s with sunshine at you are beaches. but a breezy wind out there. north bay numbers, 68 in san rafael with 72 in calistoga. more mid-60s for oakland with about 6 in fremont. over the hills, the 75 in antioch and down by the monterey bay, nice and clear. no mist and drizzle. just plenty of sun. we will keep it cool again tomorrow. warming up tuesday, wednesday and thursday.

>> good morning. on friday the giants staged a ninth inning rally to get by the a's. last night oakland tried to return the favor. let's go to the coliseum where madison bumgarner got a shaky start for san francisco. in the first josh reddick goes deep with a man on. the team leading 17th homer of the season makes it 2-0. giants come back. pablo sandoval's base hit gets by jonny gomes and allows posey to score from first. san francisco would tie the game at two. the a's retook the lead. gomes helps make up for his error with the solo shot off bumgarner. he was 4-2. the wheels would come off for oakland in the fifth. the grounder goes past moss, who slips. two runs score. moss had two errors on that play, three in the inning. this two run blast made it 6-4. giants scored three more in the seventh. two on this shot by posey. san francisco led 9-4 going to the bottom of the ninth. the a's would not go down without a fight with the score 9-6. brandon hicks delivers with the bases loaded but the ball bounces into the stands for a ground-rule double. two out, bases loaded for weeks. it's flared to shallow center and caught by ryan theriot to

commit on building the high-speed rail project. it is expected to easily pass the assembly, but face a different vote in the senate. gov. jerry brown is seeking approval to build 130 miles of track from bakersfield to modera. by there is growing skepticism the train could end up being a train to nowhere. alternative plans are being set up to get initial funds to high ridership areas, such as the bay area or los angeles. the 49ers and the city of santa clara will huddle this week to figure out what to do now that st. claire has pulled back $30 million from the team's stadium project. our media partner reports the county property tax board voted friday to spend the money on schools instead, and found a loophole in the law that lets them do it. changes in redevelopment funding now give counties total control over how that money is spent. the money amounts to less than 3% of the total cost of building the stadium. county leaders expect the 49ers to absorb the loss, and many expect lots of lawsuits.

an 11-year-old florida boy kept his cool when three people broke into his house while he was home alone. he's being called a hero after alerting police by calling 911. >> what did they yell? >> i don't know. i'm in my room under my bed. >> do you know how he got into the house? >> he broke the glass. >> what's that noise in the background? >> i'm trying to hide. >> wow. the thieves tossed a hammer through a window. they ransacked the house, taking jewelry and tearing up the boy's school certificates. police arrived quickly and pull the boy and his dog to safety. three teenagers were taken into custody. all the jewelry was recovered. boating season is now in full swing at lake tahoe. extra safeguards are in place to make sure invasive species don't get into the lake, but some unwanted are creatures are already there. the good news, experiments on getting rid of at least one harmful species appear to be paying off.

here's dan ashley with this morning's assignment 7 report. >> you might call this the unwelcome matt. this uc davis video shows researchers spreading sheets of rubber on the bottom of the lake tahoe. the rubber is intended to smother an invasive species call the asian clam. >> this is the material that blocks the oxygen and the clams are underneath it. >> asain clams are tiny, but they have the potential to cause big problems. so a multi-agency task force is trying to control the clams before it's too late. they took an abc7 news crew out on the lake to show us how it's going. in some areas the clams are easily visible through a scope. >> every white dot we are looking at here is a dead clamshell. there are a lot more live ones underneath. >> we sped up the video so you can see how the clams bury themselves in the sand. there they go. they were first discovered in tahoe ten years ago and they spread fast. >> these guys can grow faster and more efficiently than the native clams.

>> the clams encourage algae, by which clouds the waters. their shells are sharp and makes beaches dangerous for the feet. but the most serious threat may be that the clams change the water chemistry so it's easier for other, even more harmful species to survive. ted is with the tahoe regional planning agency. >> the combined effects on the invasive species on lake tahoe could be as much at $22 million a year in lost property values, increased maintenance of boat and water intakes. >> this shows how thick the infestation is in some spots receipt now. so far the clams are mostly in the southeastern part of the lake. but a small colony is beginning to grow at the mouth of emerald bay. emerald bay is one of the most popular and beautiful parts of lake tahoe and it is the site of a pilot project that started a year ago. divers put down 2,000 square feet of those rubber mats that we showed you earlier.

>> it's a lot of work down there. these rubber mats are heavy and they have a lot of rebar on them to keep them in place because there's a lot of currents that flow back and forth across the bottom of tahoe. >> we were there as researchers pulled the entire experiment out of the water piece by piece. the divers also took clam samples to send to a lab for analysis. after a few weeks the news is good. >> it was very effective. >> the mats killed about 80% of the clams by cutting off their oxygen. that result, combined with earlier research, is leading the team to recommend a much larger project, putting temporary rubber mats on five acres of emerald bay. it would cost about $800,000. >> the invasive species team is reminding anyone who wants to bring a boat to lake tahoe that it must be inspected before it goes into the water and the best way to keep an invasive species from getting into the lake to make sure your boat is clean, drained and dry when you arrive.

>> this morning a lesson for us all. it has to do with the handsfree cell phone law and just exactly what you are and are not allowed to do with your phone while behind the wheel. here's abc7 news reporter heather ishimaru. >> the state transportation commission official lucy dunn was pulled over in southern california when a police officer thought she was texting at a red light. instead she was checking to make sure her smartphone is charging. he explained that's illegal too, but let her out of the ticket if she would agree to post her experience and the lesson learned on facebook where she has 1300 friends. the officer suspected dunn isn't the only one who didn't realize that, in the eyes of the law, checking for charging may as well be texting. did you realize that? >> no, i didn't. >> no, i didn't know that. >> do you feel like you understand what it legal and what is not? >> not necessarily. >> the only purpose that you can use your phone while driving is for making a handsfree call. >> the u.s. department of transportation says in 2010

>> you clearly need to wear sunscreen but you might have a tough time picking out exactly which one you should be using. here's michael finney with the results of the test of a top selling brands. >> whether you are relaxing on the beach or enjoying the waves, it's critically important to protect yourself from the harmful effects of the sun. consumer reports have tested 18 sunscreens, mostly sprays and lotions. from names like banana boat and coppertone to neutrogena and avena. >> we check to see how they protect against two types of radiation, uvb which causes

sunburn, and uva, which penetrates deeper and ages the skin. >> both types contribute to skin cancer. it's important to use a sunscreen that tests against both. to test they apply sunscreen to panelists' back anden expos them to the rays. they also check water resistance. panelists sit in water up to 10 -- 80 minutes, depending on the product's claim. >> we also performed a new critical wave run test mandated by the fda which determines it a sunscreen concerns a sufficient level of uva protection. >> two studies show both failed the test. banana boat kids and albert botanica. but for fun in the sun without the worry, consumer reports found two very good inexpensive sunscreens. no ad spf 45 and walgreens continuous ray sunscreen sport spf 50. both rated very good against uva and excellent against uvb radiation, making them a great option for your next day at the

live doppler 7hd and we don't have anything to show you ton right now, not even the low clouds are being picked up. we are just looking at cool temperatures. 43 santa rosa, 46 in san rafael with mid-50s from san carlos. but plenty more 40s this morning than we had yesterday. that brings us anywhere from one to five degrees cooler than 24 hours ago. the cool air mass had a chance to settle on in. we will be maintaining that for the next couple days but featuring plenty of sunshine in the afternoon. cool nights. we are looking at a warmer pattern. it will take a couple days. so 60s and 70s today. a carbon copy of yesterday, but normally we should see 83 in santa rosa. 11 degrees below the average with 4 and 5 degrees below where we should be. san francisco and oakland, redwood city, livermore and san jose. wow. much, much cooler. than you should be for this first full week of summer. no 80s today or tomorrow. it's going to take a little bit of time. this area of low pressure

brought rain to northern california. today it sits here and tomorrow it begins it's move to the east. and once it does that, when we get on the back side of it, that's when we will see some change. but not today. so if you liked yesterday, you are in luck. we have more of that with temperatures very pleasant. in fact, plenty of 60s and 70s for the inland valleys. just 80 in sacramento with today in oakland we will see mid-60s once again. but did you notice the breeze kicked up in the afternoon yesterday. so once again that will be happening and throughout the afternoon numbers will drop to around 60 degrees later on towards, say, four, five o'clock. but in san francisco today, low 60s, on the cool side but who is going to contracts, right? plenty of sun there. and up in sonoma we will be looking at low 70s today. more like spring than summer. but we will get there. and back home into the south bay temperatures very comfortable. no low 80s, but 72 in campbell,

73 in los gatos. peninsula numbers, half moon bay, low 60s. 68 menlo park and the richmond and sunset district nice and sunny, about 60 there. a little bit of a breeze up toward calistoga and cloverdale this afternoon. low 70s. 68 union city with fremont at 9/11. over the hills about 70 for the try valley. pittsburgh, though, 74. a little bit of a west wind, keeping you very temperate with 69 in watsonville. and our look ahead today and tomorrow and yesterday. kind of blending together. we will look for the numbers to come up five, six degrees tuesday. but very little change on the coast and around the bay. at least we will burn back the fog and have sunny averages. >> and 80s is where we should be? >> yeah. >> thanks a lot. nintendoing is secretive about it's new next generation game. they won't even say how much it is going to cost. but business and technology

reporter david louie got a sneak preview and tells us why nintendo has to win with the new wii-u.. nintendo is playing a comeback claim in the video industry. after losing $460 million last year, it's counting on this new console of the wii-u. to put it back in the black and betting on a new-style controller with a built in 6.2-inch color screen. >> there's a new term that comes with the new wii-u. and the game pad. it's called asymmetrical game play. >> the person with the game pad is having a completely different experience than the person playing with the wii remote. >> they gave us a demonstration playing super mario-u.. >> i can play it on the big tv and see the stuff on the big tv. i'm using the game pad and the touch screen to help them along by putting down these blocks. as they go along you see i can help them get to higher places or help them get these are block
