investigators once again are still inside. officers have not released name of either the deceased over the suspect. >> we have learned that testimony will never be heard in the trial of a man accused of beating a priest he says molested him as a child. william lynch being frird assaulting the priest. >> there is the judge denying request for a mistrial. any motions are running high. testimony did resume in the case but the real stories here is people the jury will not hear from. tamara is father lindner's niece and says she was molested by him as a child. the judge ruled she cannot

testify in this case. >> this has been my life with this man. just seems like he's getting away with something. again. >> in a dramatic opening statement the prosecutor admitted father lindner abused lynch decades ago but lindner denied it and refused to answer anymore questions. in a surveillance series of twists the judge has thrown out the former brief's testimony and will not allow other molestation victims to testify. lynch's attorneys say their defense strategy as to the 2010 confrontation has been gutted. >> and there is a man who is a rapist who allowed to go free. >> the judge ruled without lindner's testimony there is no reason to attack his credibility on the molestation issue and both sides must focus on the assault. >> the question for the jury is going to be is this a justified assault?

that laumpbled the search. >> there are many challenges. if the current is running fast he could have been pulled out quite a ways. when dark, it's difficult to locate anyone. now they may be able to get a better idea if he could have gotten snagged on something. >> the search was made more difficult by dark clothing. dark blue jacket, blue jeans and water logged clothing is no help. cruise scoured much of the bay before calling off the search. there is no suspicion of foul play. mode now switched to a recovery. and they still have not released the name. his family lives in southern california. they're holding out hope.
