they are working filling up a pipeline. they're dodging questions about a critical state safety report. and we'll get to that package in just a moment. let me tell you about the report. it said they violated so many state code violations over the years that fines could be $200 billion. here is the story. there are dus digging into the pipe that failed two years ago in an implosion that rocked the community and utility companies. and investigations revealed they racked up 3,000 safety code violations. and that state fines are ordered the company will have to fork over $200 million.

january, los angeles police began an investigation after receiving cyber tips from the national center for missing and exploited children. aol reported that a user with an e mail address had been communicating with another user with a yahoo address arks tachments showed children two and three years old being sexual assaulted and performing sex acts on adult men in, may, lapd turned the case over to san francisco police after learning the suspect with a user name zach 3737 was larry brinken of san francisco. investigators here then found that brinken belonged to several discussion groups exkmaimpk -- exchanging stories about sexual assaulting young boys and girls. he retired after working for the human rights commission.

he was known as a hard working senior staffer whofá headed many high profile civil rights investigations. in 2008 describing his job for abc 7 news. >> we wait until information is brought to us or someone files a complaint discrimination is going on he was best known for work for equal rights for gays and lesbians helping right the equal ben fence ordinance which became a model for equality in the work place. abc news profiled him 12 years ago, when receiving counseling and treatment to deal with a stress of his work at the human rights commission. he had just gone through double bypass surgery, learning to cope with a demands in his job. >> so again when prosecutors finish reviewing kpulter evidence they'll decide whether to charge him, he's a free man and did not return our calls but his attorney

and nick smith is live with the latest. >> not much has changed we have watched different investigators come and go from the home behind me most of the day. but arriving here just this afternoon. and what we know is that police are calling it a murder. they're saying the death of a woman in her early 50s by the hands of someone she nu. a call became this afternoon by a man in his 90s described as a neighbor. police say the neighbor was calling police to report a murder but that he couldn't give information about who, what, or where. that is when they say dispatch could hear a second voice behind the caller giving additional information including address of the crime scene. and police say they knew it was not an accidental death but a murder. >> this is a domestic dispute ends up being, we think is a murder. and we're confident that we have the suspect. there no one in orinda who

we're looking for. we have who we're looking for. >> investigators were able to recover the weapon near the neighbor's home. police say that the murder is domestic and there is no threat to the community. they say the couple lived together 10 years and at this address since 2006. the chief tells me they're working with other agencies because they're a small department. they expect to have it wrapped up within next day or so. >> there is a man who died in a fire in the maxwell park neighborhood earl tli morning has been identified. the 30-year-old was a transient staying at the house. there are firefighters called to the home about 4:30 this morning and put out the fire within 10 minutes. the house was destroyed.

today defense attorneys say the jury will never hear the truth. >> there is a man who molests children. and he's allowed to go free. >> the prosecution admits lindner sexually molested limpbl and his brother but since the former priest deny that had and refused to answer questions, the judge has thrown out lindner's testimony and told the jury to disregard it. >> and by informing the jury this testimony is to be ignored the church pulled him off the stand, hidden him away. justice system is kol you'ding with that. >> both sides must now focus on the assault. the prosecution without the victim and key witness and the defense with ut out being able to cross examine their client. witnesses included a paramedic and two sheriff deputies
