toll minor back-up for the cash-paying lanes. developing news in san francisco. police are trying to figure out who shot and killed a young man in a neighborhood with a violent history near city college. terry mcsweeney is live at the police station. >> reporter: investigators went to ingleside to investigate this homicide not far from city college it happened shortly after midnight. take a look at pictures we have from the scene this is the same street where five bodies were found inside a home in march, you might remember that suspect in that case arrested that was a robbery gone bad. in this case, investigators don't have a lot to go on, just saying that someone called in 12:20 saying they heard gunshots, three shots, a pause and then five more. police arrived on the scene they find a man on the sidewalk attempts to revive him were unsuccessful. they do not have an id on the man they are releasing. he is a man in his 20s found

near niagara. the investigation in its preliminary stages, he they don't have anything along the lines of a motive and no suspects. again, one man found dead in the ingleside district of san francisco, two blocks away from where those five people were found dead inside the same house in march during a robbery that went wrong. terry mcsweeney, abc7 news. :03. new this morning, antioch family homeless after a fire destroyed their home. fire officials say the blaze started in the garage of the house on blue jay drive late yesterday night it quickly spread to the attic. everybody inside, including four children, managed to get out unharmed. firefighters think the blaze was caused by the parked car in the garage. the owner of the home said she was having problems with the car when she bought it two weeks ago. sheriff ross mirkarimi

witness in the high profile priest beating case in san jose. will lynch is accused of beating father jerry lindner in 2010. lynch is expected to testify tomorrow. he claims he and his brother were raped by the former priest when they were children. there was a dramatic break in testimony yesterday when the judge abruptly cleared everyone from the courtroom except for the jury and the attorneys when the judge went back on the record he admonished spectators to say an -- to stay away from jurors. later this morning, two men who took part in a deadly jewelry store robbery in san ramon are expected to appear in court to enter their pleas. they are charged with murder for their involvement in the may 30th, robbery. their co-conspirator, was shot and killed by an employee at the gold in treasures jewelry store in self-defense. the surviving robbers are being charged under the provocative act doctrine where

defendants can be convicted for actions that provoke a killing even if they didn't do the killing themselves. residents in one peninsula city warned about mountain lions after a sighting near a popular park. police believe yesterday's report after adult mountain lion walking with her cub near stulsaft park is credible the park is popular with children. police say mountain lion sightings in the neighborhood are not rare, still urging residents to stay cautious while outdoors. county and state fire officials will be conducting a controlled burn in the south bay between 8 a.m. and 5 p.m. today the will take place eight miles east of san jose off mount hamilton road. smoke could be ability in the sand jose area and south santa clara valley the will help protect the area from large fires control noxious weeds and enhance wildlife protection. 6:06. see the sunrising there in the east what a pretty picture

>> reporter: like you said, just about 30 minutes, the face of health care in america could change dramatic -- until the supreme court announces ruling it is speculation. several scenarios the high court could strike down the entire law plenty would applaud that as i new poll finds only a third of americans have a favorable opinion of the law. two, the justices could uphold the in thing, 50 million uninsureed american would be the winners covered starting in 2014, but high health care costs would still be an issue. or three, the court could strike down parts of the law like the require that every american have health insurance. dean john -- dean johnson thinks that is the way it going to go. >> what is likely to happen is the most controversial provision of obamacare the individual mandate is going to be struck down. the less clear question is whether if the individual mandate goes, does the entire

legislation go? i think probably it will. >> reporter: because he says, the mandate is so intertwined with the rest of the bill and the mandate is the funding mechanism the affordable care act is president obama's defining achievement. speaker boehner says if the court doesn't strike down the entire bill house republicans will move to repeal what is left of it. stay with abc news this morning, special report immediately following this morning's ruling which we expect in half an hour. suspended sheriff ross mirkarimi finally gets his chance today to explain why he should keep his job when he tests before the ethics commission. mirkarimi spoke with the i-team. amy hollyfield is live at city hall. >> reporter: good morning. mirkarimi says he hasn't had opportunity in this kind of forum to tell his story from the beginning. he does tell the i-team

exclusively, that he's ready to go. mirkarimi did publicly admit that he did bruise his wife's arm during an argument on new year's eve. he did plead guilty to a misdemeanor charge in the domestic violence case. but, he says, he should be able to keep his job. the ethics commission will make a recommendation on whether he should remain sheriff. i-team asked him in an exclusive interview what he would do if he lost his job? >> well, i'll get back to you on what plan b or plan c is. but i was elected by the people of san francisco. i'm determined to fulfill what i was elected to do. >> reporter: his wife eliana lopez issued a written statement to the commission earlier this week defending her husband. she is in venezuela visiting family. she also lashes out at ivory madison the next door neighbor who called police about
