captioned by closed captioning services, inc. good morning i'm kristen sze. and i'm cheryl jennings. >> a crash killed a 17-year-old boy in petaluma a little after midnight. >> katie marzullo joins us with what is happening now. >> reporter: the suspect is in custody being interviewed here at the office in roanoke park identified as michael harmon. the other driver 17-year-old was kill in the crash. take a look at the scene this was around midnight at lakeville highway near old

lakeville road number one. chp says the teenager was driving the red pick-up truck north when the southbound driver of the white truck swerve out his lane, the trucks collided and the teenager was killed. the other driver michael harmon left the scene. i want to a chp officer joining us live. you have your man. >> we do. this morning we put out mr. hard man owes name as a person of interest because he was registered own of the truck. the description matched the description. witnesses and he must have gotten word word of this because he contacted our office. >> reporter: there was take he might be injured? >> he does not appear to be injured no indication in the vehicle that he suffered any injuries. >> reporter: and the investigation interview is ongoing? >> it is continuing as we speak. >> reporter: officer, thank you for joining us.

michael harmon likely faces vehicular manslaughter and felony hit-and-run no word on why he fled the scene. katie marzullo, abc7 news. in san francisco this morning peninsula assemblyman hill and the parents of a testimony died after drinking on a so call party bus urging legislation to hold bus companies responsible for unaged drinking. he died when he crash into a sound wall on highway 101 in san mateo after hours of drinking on what is called a booze cruise. the bill would require bus operators to check to see if passengers are under 21 bus drivers could face fines of at least $2,000. closing arguments underway in the trial of a man accused of beating a former priest revenge for alleged childhood molestation. william lynch was on the stand

defending his attack on father lindner. katrina rusk is live at the superior court in san jose with where things stan. >> reporter: there -- there is not an empty see the in -- empty seat in this courtroom foreclosing arguments. the district attorney is occupying one of those seats. his deputy is arguing to the jury that vigilanteism is not allowed in a -- democratic society and thus, they must convict will lynch in this assault case. lynch did take the stand stand last friday and testified strike father lindner may 10th, 2010 and hit him more than once. he also told the jury how the former priest viciously raped him andolested his little brother when they were 7 and 4-years-old. the prosecutor says she has proven, beyond a reasonable

doubt, lynch is guilty of felony assault and felony elder abuse. those two counts that if a conviction comes back, carries up to four years in prison. lynch told the jury he did not intend on beating father lindner when he confronted him. but childhood memories of the rape flooded back when the former priest leered at him as he had prior to this sexual assault in 1975. the jury could find lynch guilty of misdemeanor assault and elder abuse. the defense will be arguing that and more in their final arguments. will lynch did not accept a plea in this case in court because he wanted his attorneys to be able to publicly cross-examine father lindner. because of a series of legal rulings in which lindner took the fifth amendment against self-incrimination that cross-examination never took place. but lynch has successfully focused attention on this issue. in his jury instructions, the

judge told the jury that they must not consider sympathy in rendering a decision in this assault case. katrina rusk, abc7 news. meantime, a church pastor in fairfield accused of multiple molestations dating back to 1994 will make his first court an rear court appearance this afternoon. robert ruark committed lewd acts on at least six victims. they say many of the molestations happened at the church. the victims, now adults were as young as 13. investigators still trying to identify other victims. battle over the estate of thomas kincade will remain public. the artist's girlfriend and his widow are fighting over millions. amy hollyfield joins us

outside court. >> reporter: the widow wanted this discussed in private so the judge handed the girlfriend a small victory today. thomas kincade's will and%o last intentions weren't even discussed today. get ask about them outside of court. nanette kincade's attorney told us what she thinks of the handwritten will that reportedly came from her estranged husband painter thomas kincade giving property and millions to his girlfriend. >> everyone seems to have the same reaction when they see those documents, pretty visceral. and that reaction is that either it is not tom's hand or we was in a state where he couldn't understand what he was doing. it is pretty much chicken scratch. >> reporter: the handwritten will has landed kincade's widow in court against amy pinto, kincade's girlfriend fighting for 10 million

dollars and kincade's home and studio which she says he left for her. the validity of that handwritten note wasn't decided today but the judge did deny kincade's widow's request that the matter be moved to private arbitration. >> obviously, we are pleased that the judge is going to keep this matter in the probate court. we think it is the right place not only for miss pinto but also for the public interests. >> reporter: pinto can't comment because of a confidentiality order. she was in court today. nanette kincade was no >> there's no requirement she be here. number two, she wants to keep things as private as she can for herself, her family, her girls and that's what tom wanted. >> reporter: there's concern if the girlfriend that kincade's home and -- studio could be headed for default the judge thinks the property will be fine until they all come back to court again in

august. the girlfriend says kincade's wish was for her to take that money and build a museum on the property. this battle looks like it going to be long, nowhere near being over. it will continue in august. amy hollyfield, abc7 news. alarming new assessment by pg&e regarding its natural gas transmission lines. the chronicle reports pg&e has identified 239 of its lines as being at risk the same type of fail caused the san bruno explosion in 2010. the report commissioned by pg&e also points to more than 500 trouble spots on those lines spanning 48 miles. some of them are old, others were pressurized beyond legal limits withouting testing after. the lines pass through parts of the peninsula and east bay between sunol and livermore. emergency help is going to come faster for folks after their neighborhood fire station reopened today.

crews moved back into station 25 within the past few hours. budget cuts forced the city of vallejo to close that station. now it going to reopen at least to years thanks to a grant from the federal government. >> what this means to the community is that response time are reduced within the area north vallejo. we've had greater response times when two an joining fire stations had to respond up into this area. >> that federal grant will allow vallejo to hire 10 new firefighters it will cover their salaries and benefits for the next two years. big move for silicon valley adventurers and entrepreneurs. commerce department award satellite patent office to san jose. silicon valley long known as ground zero for inknows with 25% of all patents in america coming from this region. new offices are being built in denver and dallas ft. worth.

weekend storms battered the mid-atlantic region and midwest killing 16. relief will be slow in coming. >> reporter: the mid atlantic region is sweltering temperatures in the upper 90s. adding to the misery, hundreds of thousands are still without power after friday's nasty storms. last night it was chicago's turn to get soaked winds up to 70 miles per hour torrential rains and hail. temperatures in the windy city dropped 20°. unfortunately, there's little relief in sight for much of the country. 16 states unheat warning or advisories three million homes are still without power across seven states, including higher in virginia. no power of course means no air conditioning. >> we've already been to ikea which is air conditioned. >> reporter: he took his family to the library to escape the heat. >> we are here to cool off.

justice department announced largest health care fraud settlement in u.s. history. glaxosmithkline will pay three billion dollars, pleaded guilty to promoting two popular drugs for unapproved use as. the settlement says the company failed to report important safety data about
