>> and firefighters appear to have the upper hand now on a brush fire, flames broke out about an hour and 15 minutes ago no. homes were threatened. the fire seems to be out, but firefighters will stay on the scene and there is no word yet on what cause that had fire. >> and police used deadly force following a domestic violence call. the fourth officer-involved shooting in six weeks, police responded to reports of a man with a gun in a parking lot on lincoln road west. and police ordered him to put the gun down but they say he refused. and nick smith has more on the story. >> the police say their training is top notch but the family of a victim shot and killed by a officer is asking if more could have been done to save him.

>> they didn't have to kill him. they could have shot him in the leg. >> the sister of a man killed by a police officer and mother of his daughter grieving his loss and asking questions. before 3:00 a.m. police were responding to a domestic violence call with the suspect found in this parking lot. officers say they approached the suspect and he got out of the red nissan, he was distraught and they can see what appeared to be a handgun. officers called out to the suspect. >> and i heard show me your hands. >> a witness that did not want to go on camera says he saw it play out. >> the guy was agitated. he woke up the whole house here. >> and officers told them to place his hands on his head, one officer fired a taser but it failed to take tobin town. the officers say the suspect

grabbed a handgun. >> this subject went for the waist band ask officers discharged weapons. >> the police department has been hit hard with losses and there has been heavy scrutiny in what appears to be a heavy rate of officer-involved shooting. one suspect was accused of pointing his weapon at officers. a 42-year-old shot after trying to elude capture. >> i can't speak to the space of the recent officer-involved shootings but they have the right to defend themselves. and they have been armed with handguns and officers defended themselves. >> our training is top notch. >> and this officer tells me

they are operating less than peak and you'll remember officer caput was shot and killed in the back and that weighs on the minds of officers here. >> and thank you very much. >> in oakland there is a toddler with severe injuries caused by abuse is in critical condition. the search is underway for his missing teen-aged sister. police say a baby-sitter called 911 from the apartment on 63rd street. the kids were found this morning in a town with a relative. the baby's mom, step dad and baby-sitter are under arrest. police say they opened this investigation because of the extent of the toddler's injuries and evidence of past abuse. authorities are still trying to locate the 16-year-old. >> san francisco medical

examiner says the body recurred this morning is that of a yolo county man, victor morillo disappeared after attending a giants game june 25th. friends believe he fell into the bay. and this morning fire department divers pulled the body from the bay just north before 8:00. and there are several searches organized hoping to find him. >> a short chase ended in oakland with the driver crashing into a fire hydrant. officers tried to pull him over and the pursuit lasted about three minutes ending when the car crashed into the hydrants. and two people were hurt no, officers injured in this chase. >> one cupertino woman hit in her home, two burglars broke in and stole jewel rism a neighbor called the county

sheriff's office yesterday morning to report the robbery and progress. two got in through a side door and they were never found despite a search of the neighborhood. >> and the parades and fire works are the things 4th of july is made of, as we know. and recent years cuts can turn into celebrations but cities found a way to bring them back. there is a city with the will and found a way. david? >> well, 10,000 people are expected to crowd this field at the sports complex today to watch fire works from the baseball field. they're being charged $3 per person, almost a sellout and a new model, perhaps of how it's going to be celebrated during tight budget times. with 35,000 lining streets and a thousand participants, this

mayberry up there today, very small town americanna. and in mill peed yags, fire works have been a tradition over 30 years but the city's deficit wasn't able to support the show this year. and. >> remaining a,000 will be raised by charging $3 per person. having a fire works show may prevent grass fires set off by residents. >> there has been a lot of grass fires in the south bay. they've been small ones so there is a fear. especially with hills so close. >> and you can see the hills above the city of milpitas. there are other cities reinstituted their fire works. they went to private industry to raise money and so their show is on for tonight.

and tenants in san francisco paying 15% more this year over last. demands for rentals grew, as more folks lost their homes to foreclosure and began looking for rental properties. >> hot weather doesn't compare with deadly heat waves. this could cost more zwrouft say cool because of the coolant used in air conditioners. epa is phasing out a common coolant that is used in air conditioners that are at least two years old. be ready to pay big buck autos what happened is that the average call has gotten $200 more expensive. >> and some air conditioners

the bay area every 4th of july, there are two locations they'll set up fire works. and there is abc 7 news with a preparations involved with putting on this show. >> that is right. you can see many of them laying out blankets there. there is a mob of people over there at the far end which is going to be a prime spot for the fire works. some launched from the pier and some from a barge. there is folks going to keep showing up until after the rockets go up. there is a fire works display, 22 minutes long but taking about a no get ready for it. into final preparations crew is wiring up two to three thousand pounds of explosives but the designer says he calls them packages of entertainment.

the weekend. across the country now we have a sweltering heat wave going on. and there are hot conditions over easternern three quarters of the u.s., here in the nation things just mild to warm and there is fog pushing through 8:00, 9:00 and we'll have fog around again for the display beginning at 9:30. so at 5:00 in the morning we'll end up with wide spread fog. lows will be into mid-50s so it will be mild. there is fog starting to burn back to the coastline and will be a cooler day and this is mainly 60s around the bay. low 80s inland. there are highs 80s in santa rosa.

researchers at stanford, determining the genetic makeup of an unborn child with a simple blood test. scientists say it allows families to screen without the risk of miscarrying. the test, they say is 99% accurate ask could be available within three years for $3,000. this genome testing development is outlined in the journal nature. >> considered the missing link in physics. often called the god particle. scientists searching for it's exist yens may have finally found it which could unlock mysteries of the universe. researchers celebrated as this is made and they say they found evidence of a new subatomic particle looks like the one believed to give matter size and shape. >> this discovery will take us closer to the big bang.
