>> announcer: right now breaking news. right now alameda road shutdown after a car slams into a tree overnight. all passengers injured are under the age of 18. >> amy hollyfield joins us live from robert davie, jr. with the investigation. i found out the driver is 15-years-old, does that mean unlicensed? >> reporter: definitely unlicensed. we have learn he was driving the car of the parents of one of his passengers. they took the car out, without permission. here's what is left of it. you can see the investigation team is here taking a look at what is left of this car trying to figure out how it ended up crashing into this

tree. what cause this. now six teenagers in the hospital. total of six kids in the car, five of them were 15-years-old or are 15-years-old, one is 13. the driver who is in the life-threatening condition facing life threatening conditions in critical condition. the others were taken to various hospitals. their injuries are not as serious as the driver's. this happened about 1:30 this morning in alameda. investigators are now looking into why? they don't know whether speed was a factor or alcohol or drugs. they are trying to figure that out but they did emphasize it was a single vehicle crash, no other cars involved. this happened on island drive in alameda. this is at robert davie, jr.. this area is going to be closed for a while while investigators look into this accident.

gilroy police department with details. >> reporter: the gilroy police department here vowing to do two things this morning, one is a thorough investigation to find out how it was that 3-year-old was shot by a handgun and killed. it is also vowing to provide all support it can to the san jose police officer and his family. the officer who lost his son last evening. take a look at the scene where it happened this is about 5:00 last night 7500 block of kentwood court. report came in of a 3-year-old boy shot. the son of a san jose police officer. emergency crews came out, were unable to save his life. police say family members were at the house, at the time the shooting happened. gilroy police say the investigation continues into how he was shot. they are not saying who shot him or fit was the san jose police officer's service weapon that -- that kill the boy. we are told investigators are -- that killed the boy.

we are told investigators are going to be looking into how first arms are stored at the residence. perhaps you can read into that, it was the case the 3-year-old or some other child got ahold of a gun in that house it was not stored properly, fired it, it went off now the 3-year-old is dead. continues. terry mcsweeney, abc7 news. prosecutors will have to rethink their case after a jury acquitted a san francisco man of beating a priest of all felony counts. will lynch was smiling as he left the courthouse yesterday. he was on trial accused of the beating father jerry lindner two years ago. lynch says the priest raped him when he was a child. prosecutors say they have no doubt lynch was molested but say beating lindner was felony t. the jury acquitted lynch on misdemeanor elder abuse but could not agree on misdemeanor assault leading to a mistrial on that count. it is unlikely prosecutors

will want to retry him on that. the questions about possible perjury involving sworn testimony by san francisco mayor lee are growing. the examiner reports former supervisor kin contradicts the story the mayor presented last week during official misconduct proceedings against suspended sheriff mirkarimi. lee testified that he never offered mirkarimi another john if he resigned and did not authorize a third-party to do so. the have adviser says he was asked to offer mirkarimi an alternative job. the i-team has confirmed mirkarimi's wife will testify on his behalf in person. --

. family of a man who faces charges in connection with a shooting accident on the lower deck of the bay bridge denying he had a weapon. he is on parole for human trafficking. investigators say erased this cadillac past officers at 1:30 yesterday morning and crashed east of yerba buena island at the s-curve something that tied up traffic all morning yesterday. officers say they fired after he flashed a weapon. nobody was hit by the gun fire. as we showed you yesterday, this incident caused massive traffic back up for hours on the lower deck of the span. all but one lane eastbound closed for eight hours. half the country is sweltering under heat. we are going to get our share. the operative phrase is little bit. >> right now this morning starting out with a picture of cool. mike good morning. >> good morning. not all of us are going to get

cleaning up this morning after severe weather moved in. a tree fell on top of this home yesterday evening outside of knoxville. no one was hurt but now thousands of people are without power. the storm turned deadly last night in the great smokey mountains national park. a woman died when a tree fell on top of her in a camp ground. another man died after crashing his motorcycle. several other park visitors are now trapped in the park. workers worked throughout the night to evacuate visitors. organizers of the san diego 4th of july fireworks show that went bust is apologizing to the city and offering to do the show for free. which should have been a 20 minute show wednesday night turned into a 30 second massive fiasco when all the fireworks went off at the same time. the show organizer is blaming the mistake on a computer glitch and says this has never

around it by the golf course we have amy hollyfield live at the scene with this accident involving six teenagers, one car, clearly they weren't even wearing seat belts either. >> reporter: well, we don't know about that yet frances. it doesn't look good. look behind me the scene investigators say they are making good progress on trying to figure out what happened. now that the sun is up they are spotting things like skid marks that they didn't see before they think they will be out here for several more hours. they did tell us it was a 15-year-old driver who crashed this car at 1:30 this morning. he's in critical condition, facing life-threatening injuries. he had five passengers, four of them are 15-years-old, one is 13-years-old. they are all in the hospital. it is the driver who is in the most serious condition. the car belongs to the parents of one of the passengers. as you can guess they took the car without permission.

none of the kids is old enough to each have a drivers license. the car came to a rest facing traffic so it did a 180 sounds like it woke the neighborhood. police received several 911 calls. no other car was involved. i asked investigators if they suspect drugs or alcohol or speeding? they say it is too early to tell. of course they emphasize this was a single-vehicle crash. obviously, i was a young driver at the wheel, very inexperienced, if any experience at all, driving this car. they do think that island drive at robert davie, jr. will be closed for several more hours they say they have a lot of work to do trying to figure out how this happened. amy hollyfield, abc7 news. 6:33. developing news, horse racing industry is mourning the loss of a jockey killed during a race yesterday in pleasanton. 33-year-old hooray herrera was thrown, this video is courtesy

of the california authority of facing fairs. the horse morito clipped heels with another horse stumbled, causing the jockey to fall. he was taken to the hospital with massive head injuries where he died. fair organizers say this is the first time a jockey has died at the track since 1975. more excepting news police in santa clara county investigating the -- more developing news in santa clara county. police investigating a shooting of a 3-year-old boy around 6:00 last night. the boy either accidentally shot himself with a handgun or was accidentally shot by a friend who was playing with the gun. police confirmed the boy was the son of a san jose police officer. scott peterson is appealing the guilty verdict received for the murder of his wife. he was sentenced and sent to

san quentin's death flow march of 2005. his attorney filed with the state supreme court yesterday. he argues the trial should have been moved out of san mateo county after 95% of prospective jurors said they had been exposed to publicity about the case. peterson claims the overwhelming publicity, incorrect court rulings and other mistakes deprived him of a fair trial. prosecutors filed charges against five members of the same family accuse them of neglecting residents of the care home they ran. you can see four here, they all remain free on bail. police say the home operated without a state license. investigators say the 12 residents of the home were dependent, nonenglish speaking asian immigrants who were beaten, malnurished and forbidden to use toilet paper. >> this type of offense is really tragic because you are taking van of the most vulnerable segment of our , people who cannot take care of them -- of our come muni

people who cannot take care of themselves and then you -- subject them to deplorable conditions and take advantage of them. >> adult protective services have found other care arrangements for the victims. sfo reporting someone shined lasers into the cockpits of two aircraft last night. airline officials say the laser strikes came from the vicinity of palo alto and were pointed at a flight from chicago and a flight from calgary. no arrests, no one was hurt. the lasers are dangerous if pointed into the cockpit they can blind the pilot. the fbi and faa are looking into the incidents. today the state senate will decide whether to prop -- front rate nearly five billion dollars for high speed rail. yesterday the state assembly approved the legislation which could get the first segment

nonfarm jobs did increase last month by 80,000 according to the labor department. that was below expectations it is still very slow job growth be what we need to bring the unemployment rate down. what is down stocks. in re to this report, the dow down about 120 points -- 130 at the moment, s&p and nasdaq also lower. bloomberg index trading down 1%. bad news for people depending on food stamps, they could be cut as much as 16 billion dollars over a decade part of the farm bill that would also cut subdegrees from growers of corn, cotton and other crops by 14 billion dollars. the cuts the house is proposing are four times bigger than what the senate approved. amazon developing smartphone to compete amazon is working with foxconn the chinese manufacturing giant that builds apple's products.
