san jose. most areas today coming up anywhere from two to four degrees. but here's the rest of the day to plan it out. we are looking at sunny skies by noon. numbers in the upper 50s at your coast to the mid-60s in the inland valleys. by the afternoon we are warming up around the bay and inland into the mid-90s around the tri-valley. a sea breeze up to 15 miles an hour will keep the coast very comfortable but there are changes in store for the rest of the weekend. terry. >> thanks very much. a vallejo woman faces charges this morning after police rescued a quadriplegic plan from the back of a moving van. nick smith said neighbors called 911 out of concern for the man in the summer heat. >> vallejo police say this woman of north vallejo locked the 57-year-old quadriplegic man for whom she worked as primary caregiver in the back of a moving truck and left him unattended. >> it was a relatively warm day. the man no access to ventilated air, no access to water, and we believe that that was

inappropriate. >> james told police she left the victim so she could go to the bathroom. but a man walking a dog heard someone calling for help from the back of the locked truck and immediately called police. >> they opened up the doors and located a 57-year-old male quadriplegic victim and two dogs and a mattress in back of the truck. >> i just seen a u-haul sitting there. >> this woman didn't want to appear on camera but she knew there was something odd. >> it was very odd because there's no u-haul truck just sitting and that was kind of odd and caught my attention. >> after questioning james, they learned she was also wanted for felony burglary. she was taken into custody and arrested on suspicion of elder abuse. police say that the victim is doing well, just suffering some dehydration issues. although he is not 65 or older he may be considered the victim of elder abuse simply because he falls under the legal definition of a dependent adult.

in vallejo, nick smith, abc7 news. >> this morning the police are investigating two separate fatal shootings in oakland. one is in east oakland. an argument between two men in a garage end in gunfire. one suspect was arrested. about the same time on the other side of town another shooting. this one on 11th street in west oakland and that left a man dead. crime stoppers are offering ing $10,000 reward in a case. we have new details on a police shooting last evening in downtown oakland. here's a video of the scene at 7th and clay street. two officers were in the area. a woman comes running towards them waving her arms trying to get their hi tension. -- get their attention. a car then drove up on to the sidewalk in what appeared to be a deliberate attempt to run her over. that's when one officer drew his weapon, shot at the car, who was then struck a police car.

nobody was struck by the gunfire. investigators say the suspect was injured in the crash and taken to the hospital. the first phase forecast of the high-speed rail project is moving forward with the state senate narrowly approving funding. it allocated $8 billion to build the initial segment between bakersfield and modero. by 2028 passengers could ride a bullet train to los angeles and san francisco with speeds up to 220s miles per hour. john alston has more. >> now caltrain zips down the peninsula. if and when the high-speed rail line is finished, the trip from san francisco to los angeles would take about three hours. >> i would be in favor. if the price was right, i would absolutely take the train. >> the first phase of the rail line is now off and running. construction could begin early next year on a 130-mile stretch through the central valley. the state senate gave final approval to spend nearly $8 billion to get pro project going.

it was a tough sell in a tough economy passing with only the bare number of votes. >> the only conclusion i come to is this is the wrong plan in the wrong place in the wrong time. >> they thought it might doom the governor's tax initiative. hurting education and social programs. the package approved by lawmakers includes $2 billion to upgrade local train service in the bay area. 700 million will go to electrifying caltrain. burlingame mayor was against the high-speed rail line. that was if it involved build an elevated track through his city. now he's satisfied the tracks will be below ground in a partially covered trench. >> look down these tracks and imagine thousand it would be to have the embarcadero freeway to go through the middle of our town but that's gone. >> they called it a gold-plated construction project even though he likes the high-speed trains in europe. >> but in california high-speed rail is so expensive, the

sticker price wouldn't cover the cost and the taxpayers would have to sub dies it. -- would are to subsidize it. >> a one way ticket would cost $85 in today's dollars. despite the vote and the governors support, the state still needs billions more to extend the line all the which from san francisco to los angeles. in san jose, john alston, abc7 news. the fbi is investigating laser attacks thursday night on planes approaching the san francisco international airport. a virgin america air bus and sky jet reported being flashed by lacers a few minutes apart during the planes approach to the airport. they were tracked about 14 miles southeast of palo alto. lacers can blind a cockpit crew creating a situation so dangerous it's a crime punishable by up to five years in prison. neither of the planes experienced any difficulties.

prosecutors say new video evidence suppose a san francisco couple conspired in kill a man they say pimped out their teenage daughter. district attorney said gary, and his cousin and alfonso williams planned out the shooting beth of 22-year-old calvin. they said surveillance video from an unrelated federal investigation shows the three men meeting on a san francisco street shortly before the murder and driving off in a rented car armed with a 40 caliber handgun. >> it shows the three individuals coming together, there's a weapon, it's taken out of the vehicle. and then we know through telephone sites that we placed the three individuals near the place of the murder. >> they called it a premedicated shooting. attorneys say they are innocent. >> this morning police are on the lookout for a

a person escaped from a medium security jail in watsonville yesterday. the man was part of a detail cleaning the cafeteria at the men's facility thursday night. they say he escaped through a door he rigged so it wouldn't lock. he's facing charges including mugging a santa cruz woman back in november. state and federal wildlife trackers may be getting closer to finding a mountain lion who malled a man last weekend. the game and fish warden with tracking dogs found fresh tracks. cougar, including the remains of a domestic cat that appeared to have been attacked. they are searching the area along a river where a 63-year-old camper was mauled in his sleeping bag. he was bitten and clawed around his head and arms but he is expected to be okay. a sample of lion saliva from his clothing confirms he was attack by a female lion. that's extremely rare. only 15 attacks have been confirmed since 1890 and six were fatal.

the buzz among san francisco's bee keeper is the attack that killed hundreds if not thousands of bees two weeks ago. today they report the details of the construction caused by vandals. take a look at a similar attack that occurred two years ago this month. some 200,000 bees were killed when vandals sprayed pesticides at the farm. that was on laguna street. nobody ever arrested in that case. the latest attack occurred at a farm run by volunteers. wooden beehives were smashed. and others were simply knocked over. the surviving bees are being sheltered at the now gated hayes valley farm. coming up next, a close call. what set off a flame that came within inches of the famous bay area landmark. and why bart will soon be lifting a ban on bikes, at least temporarily, during commute hours on some trains.

two-acre fire. investigators say kids may have been playing with fireworks. they knock it down before it could reach homes on sign hill. bicyclists that ride bart will be able to take their wheels on board trains all day long on fridays beginning on august. the agency is lifting a ban on bikes during commute hours on some friday trains. bart wants to see how well barton can carry bicycles during the busiest parts of the day. and they want comments from riders on how they think the program is going. existing bike restriction necessary effect monday through thursday have not changed. san francisco commuters using popular muni lines will have to find other ways to get around this weekend. that's bus construction has shut down the enjuda between willard and stanyon. shut down on church between reservoir and 14th. there will be three more weekend shutdowns this summer. it's part of a project to replace old railways carrying the light rail cars across the city. >> half the nation remains in the clutches of an intense heat wave.

>> we are looking at a live picture of downtown san jose. you i used to live down mr. in well low glen. they will have great weather today. a beautiful day if you know the way to san jose. >> a big celebration this weekend. to officially welcome the battleship to its new home in southern california. the battleship officially opens to the public in san pedro. after ten months of preparation, and much of it in the bay area. the battleship sat in mothballs of a anti-war sentiments called the san francisco supervisors saying no thanks to giving her a berth here. recently it was refurbished in richmond and then towed down the coast to los angeles. it is now serving as a museum.

well, the tenth annual avon walk for breast cancer will putt thousands of people in pink in the bay area starting this morning at seven. tomorrow they will make the return trip to complete a 40 mill trek. raises millions for medical care for the needy. media partner, the mercury news, say there will be plenty of south bay participants. the avon foundation said 4.2 is a nice number and we will do even better this year. expect a see a lot of pink out there. it is a beautiful color for this cause. what's going on weather-wise? what kind of weather will they have? >> you see behind us it's very pretty out there, yellows and oranges. here's the roof camera. >> that's gorgeous.

>> yes. we've had some fog in the city. but it's not a problem. some areas it's reduced to a quarter mile, up in napa. cloudy skies along the central coast. lots of sunshine today. this afternoon the fog will all but disappear. live doppler 7hd right now shows the low cloudiness is very limited. in fact, it will be pushing offshore within the next couple of hours down around the monterey bay so we will see full sunshine today and as a result a little bit warmer temperatures. the sea breeze is going to back off as well. 61 antioch. good morning, napa. it's chilly up there. 46 there with 48 in santa rosa. 50 half moon bay and the fog is just along the coast. we will look for it to hang out just about an hour or two more when it begins to pull back. past 8:00 things should be really brightening up in most neighbors. the warmer areas today, the

livermore valley out by the delta with two degrees of warming since yesterday in san carlos. and a lot cooler up in napa where the cool air drains into the valley. so starting out chillier, but ending this afternoon with numbers near 90 in parts of the north bay. some coastal clouds and we lock for sunny and warmer conditions today. getting hot inland. not only today. we will see some low 90s. so maybe that's not hot for everyone but by tuesday and wednesday we should see mud 90s. here's the temperature profile with limited fog early. full sunshine. slightly warmer temperatures. we are talking mid-80s in the south bay with the low 90s and the warmest inland valleys. if you head further north up toward cloverdale we will see some 90s there but more 70s for oakland and on the peninsula. in the pacific we have a hurricane. this is daniel. it's a minimal hurricane at

80 miles an hour. but showers and thunderstorms developing around automatic poke cowith another disturbance that could turn into a hurricane the next several days. more like a tropical storm. and a piece of this energy building a bit to the west. that's why we've had a lot of heat from fresno to sacramento with upper 90s there. palm springs, how about 108. but along the coast mother nature providing a nice sea breeze to the. we are looking at a warmer day today in pretty much most areas with numbers coming up on average about four degrees in san jose. and 75 san mateo. oakland 74 for you. and the fog will hang back along the shoreline. it will be sunny at the beach. santa cruz 75. 85 hollister. staying nice and clear tonight for the a's game. temperatures dropping through the 60s, but should be a very nice evening.

21-13. this stops local police from referring any detainee to immigration officials unless they were convicted of a violent or serious felony. >> people live in the shadows. they may be a victim of domestic violence and you don't report it because you think you will be deported. this is not the america we want. >> right now the federal secure communities program allows fingerprints that are sent to the fbi to local police for background police to also be sent to ice. they can ask to hold the person for deportation proceedings. but not reporting all criminal violations didn't fit well with the minutemen who want to enforce immigration law. >> is somebody is illegal and they are caught doing anything they should be turned over to ice. the feds are supposed to be enforcing the immigration laws in this country and they aren't doing it. >> kemp said the new measure basically takes the teeth out of law enforcement. >> all it is doing is taking more power away from law enforcement to let illegal aliens do what they want to do.

>> california had an estimated 2.6 million undocumented immigrants in 2010. the last year for which figures are available. that's the largest of any state. will pap inside this measure will give them some piece of mind. >> they get pulled over for a ticket, wondering if their illegal statuses are going to come up for a driving infraction. i'm glad it alleviates that sense of worry for people. the ice secure communities program said it prioritizes deporting illegals with criminal records. it's been credited with almost 400,000 deportations last year, the highest number ever. the california trust account goes before a procedural hearing in the assembly before being sent to the governor. abc7 news. new this morning president obama says congress has more work to do even after sending him bills to keep student loan rates low and signed a transportation funding. it included funding for a

potential suicide barrier on the golden gate bridge. they have been working for years to get that money. and other projects, the president said it will allow thousand of people to stay on the job but he doesn't want to stop existing projects. >> for months i have been calling on congress to take half the money we are no longer spending on war and use it do do some nation building at home. there's work to be done. we can build bridges, roads, and there are hundreds of thousands of construction workers ready to do it. republican presidential candidate mitt romney said he would lower taxes and eliminate government red tape to help the private sector create jobs. at 2:00 this afternoon a special prayer service will be held on the santa clara valley medical center in san jose to remember those buried at a long forgotten potter's field. now the site of a hospital expansion project. his storic photos and blueprints show the cemetery existed in 1932, but no detailed records were kept. the graveyard got paved over and was forgotten until february. that's when construction crews rediscovered the graves when

they broke ground behind the hospital's emergency room. today's prayer service precedes the removal of about 100 coffins who are in the direct path of construction. and another 100 graves will remain untouched. the newest member of the santa clara police department is in training but he's not a person. he's a police dog. as abc7 news reporter sergio quintana tells us, the k-9 has been added to the force because of a treatment after fallen soldier. >> four dogs make up the k-9 force of the st. clairea police and the newest is this doing, argo. he's being added to the pack thanks in part to the gift from the shawn r walsh k-9 memorial oral foundation. >> my son shawn, his dream was to be a k-9 cop. >> he was killed in afghanistan last november. he was a military policeman with the national guard outfit out of san jose. before his military service, officer chris bell met shawn when he was an explorer with the santa clara police department.

>> he was inquisitive about the dogs and made it quite clear has plan was to be a k-9 handler. >> he died at age 22 but his mom sides what she will not let die was his desire for public service and his dream to be a k9 handler. last weekend she gave a $10,000 donation to the city of santa clara. it allows for a replacement k-9 for the santa clara police and for shawn walsh's legacy to continue. >> this dog was retired from the police force last month. his replacement, argo, will hit the streets next summer. >> we met argo through his handler, officer grutne, and what a perfect team. what a perfect team to honor my son's memory. >> at a time when police departments are seeing tight budgets, the hope for the foundation is to continue helping local departments with the costs associated with keeping their k-9 units. abc7 news.

>> a nine year gamble is finally paying off for a north bay tribe that's cleared the last federal hurdle to open a huge casino near roho park. the federated indians can now move forward with plans to build a 3,000 slot machine casino covering half a million square feet. yesterday the interior department allowed their compact with california to take effect. thelan also calls for the eventual addition of a 200 room hotel to be built on the 64-acre site. the tribe will hold talks over the next 90 days about ways to minimize environmental impacts. the 28th annual fillmore jazz festival starts this morning. fell more street between jackson and eddie has been transformed for the west coast's largest free jazz festival. this year's festival features two dozens bands on three stages, including a memorial to

7 on your side's michael finney said the imposters are out there getting money from victims. >> i saw a message from norton. >> eva always makes sure her computer is secure from hackers. and ironically it is trying to be secure that led her right into a scam. >> i thought for sure this was a norton person. it started when had she received an e-mail offering for her to renew her norton anti-virus protection plan for two years. she said, oh, good, give me your credit card number, and i did. >> not only did she give her credit card, she let a woman get into her computer by remote control thinking she would update her norton account. >> so i let her into my computer and she fixed everything that she had to do. she was very sweet. she was very professional, and i had highly respect of her. >> however, three months later eva found out that $120 payment

never appeared on her norton account. folks at norton told eva you never paid us. but on her credit card statement it clearly shows the $120 payment to paypal norton for norton renewed. so why didn't it get there? eva called paypal. >> i said what is this? who has $1,920? -- who has the $120? she said i will take care of it. >> paypal insisted it did pay norton and norton kept saying it never got the money. finally eva found out what really happened. >> i was convinced that lead was from norton. but she wasn't. >> the e-mail was a fake. sent by a norton imposter. the big tipoff, norton said, we never use paypal as a form of payment. if someone took her money through paypal, it wasn't norton. also, the company never sends e-mails using a yahoo account, which is what the imposter did.

paypal told eva to dispute the charge with her credit card company but it was already past the 60-day deadline to make a claim. >> i had it by then. i said i'm going to abc7 on your side. i know michael will get this straightened out. >> we contacted paypal about that $120 payment. soon after they decided to reimburse the money to eva. paypal would not discuss the case discussing privacy rules but pointed to a policy that guards consumers against fraud. paypal said we take time to understand each individual issue and concern and do everything we can to achieve a fair resolution. eva said she's learned a tough lesson. >> call the real company's telephone number and make sure this is -- they are the ones that sent that e-mail. you will find out really fast they didn't. >> norton tells us it never
