we are cloudy everywhere except concord by the delta at breeze has made its way into our east bay valleys that's why temperatures are uniformed in the mid 50s here, five fly san francisco, we are talking about a warm -- warm up inland valleys today around the bay, coast not only today and in the days ahead going to stay comfortable not going to see much of a temperature change microclimates and heat, i'll have it all coming up. we first brought your attention to this crash reported westbound 580 approaching basco 10 minutes ago by traffic spotter now reports of heavy traffic as you approach the scene five minutes ago. it has been reported east and westbound. chp en route. traffic jammed on westbound 580 out of the altamont pass or through the altamont pass, in fact it is heavy from

westbound 205 and tracy. we'll keep track of it for you. bay bridge toll, a minor wait now for some of the cash paying lanes. 6:02. we begin with developing news in oakland. right now police are looking for a gunman who shot five people last night while they waited outside a theater. police were call to the regal theater on second and washington shortly after 9:30 last night. the victims were waiting outside to see spieser hand when a car pull up someone opened fire. three were able to get themselves to a nearby hospital, two were taken by ambulance. police say the victims are all expected to survive. amy hollyfield will have a live report. caltrain beginning major new project today aimed at getting better information to commuters. katie marzullo joins us live

from the station. >> reporter: of course you've caught us in between trains at this moment as fate would always have it. we've been out here we've seen people coming and going and hoping and assuming that their train is coming and going on time. caltrain is going to test a new system that should change that. the testing begins today. caltrans is going to use the gps system already on all of the trains to tell riders whether or not their train is on time for late in real-time. the announcements are going to be on electronic message boards also over a loudspeakerer in the terminals. right now some stations only have that audio announcement, others stations have no indication to riders whether or not the train is coming or going on time. passengers we talked with this morning say this sounds good. >> i think it would be good it

would be nice to know it going to be late so i plan. >> i'm going to love that. that is going to be fabulous. it is going to -- probably won't make a huge difference in my life but will make me happier. >> making connection from the trainv$( is an issue, if i'm 5, 10 minutes late for that connection makes me late for work. having the gps and that time ahead of time would be wonderful. >> reporter: the first round of testing begins this morning, all week monday through friday from 10 in the morning until 3 in the afternoon. the announcements on the message boards and overhead speakers will begin with "this is a test" so riders should be aware of what is going on. when the system is fully up and running the system will give people real-time alerts on caltrain's website as well as text and e-mail alerts.

the system is supposed to be up and running by the end of the year. katie marzullo, abc7 news. 6:05. highway patrol says more underaged people are getting arrested for dui in marin county for the first half of this year officers made 10 arrests. the same number of arrests officers made for all of last year. highway patrol says underaged arrests for possession of alcohol and public intoxication are also up from 2011. this morning being a judge women hand down a ruling that could have a far-reaching impact on governor brown's tax plan. at issue where on the balance -- ballot the proposition will land. he signed legislation to put his initiative at the top of the ballot. an attorney has file suit to put her own initiative at the top. the judge's decision will place brown's proposition either first or eighth on the ballot. >> environmentalists are expected to turn in enough

block area identified in oakland as being one of the most dangerous parts of the city. people said it was very scary here last night this was in front of the movie theater on washington street at second. this is 9:30 in the evening people lined up to trying to get a movie tick at the time, when gunfire broke out. -- movie ticket, when gunfire broke out. five people were shot. people say it was chaotic people were shoving trying to get in the theater, trying to get to safety. police say no arrests have been made. >> a bunch of kids out here going to of movies to see spider-man. car pulled up and start shooting. >> reporter: then what happened? >> everybody start running. and i hid and that was it. >> reporter: three victims got to the hospital on their own

in private cars. police discovered one victim in front of the theater. then found a fifth one about a block away, all are expected to survive. five people shot here last night. it was a crazy scene for police. they scared witnesses trying to clamor to safety, they had scattered victims. they are trying to put it together they've not given us a suspect description, vehicle description, they tell us no arrests have been made. amy hollyfield, abc7 news. former software company owner convicted of murdering his wife in the oakland hills scheduled to be back in court this morning where a jury selection is going to begin in civil court. hans reiser's children have filed a wrongful death suit against their father they want compensation for their suffering from the murder of their mother. he was sentenced to 15 years to life after he led authorities to her body in a remote section of the oakland hills. the lawsuit asks for

in his 20s, dark hair, brown eyes, 5'4, 145 pounds. he fell saturday afternoon from the 280 freeway overpass wearing a black t-shirt and light colored pants he's still unconscious and has severe head trauma. if you have any information on this patient's identity call san francisco general. fremont man who survived a shark attack is talking. it happened saturday off pleasure point in santa cruz county. the shark left its mark on the kayak during the tax. the man known as mel said the force of the attack threw him into the water he swam a bit and jumped aboard a private boat nearby. mel described the shark saying, his head was and white under his mouth his mouth was already closed when i saw him with my kayak in his mouth i can seufdly see the seriousness on his eyes.
