in north carolina this morning. he tried to escape through a window of a home. police say reyes was arrested along with another ms 13 gang member in a home in north carolina. and ramos sentenced to three consecutive live terms for the murders. and ramos said he was not the shooter and only driving in the drive by shooting. he said reyes fired into the car after mistaking them for rival gang members. he says he was shocked when reyes pulled out of the gun. >> i wasn't part of it like yeah, i'm going to help you. it was something happen in the moment without me knowing or expecting it. >> and they seem to have some doubts on who fired shots. and they deed locked on that

one charge. police have been looking for reyes for the bologna murder was a $5 million warrant out for him. daniel bologna was told of the arrest. >> they want to fight for justice and they're happy that this arrest has been made. >> in that will be likely another meegsal trial for danielle bologna. she told abc 7 news in this interview that she feared reyes was still out there, one reason she p her daughter and sole surviving son are still in witness relocation. >> let's just say my life has been stripped. income protective it's kind of hard. it's not the same. we can't just go where we want to go. >> and a homicide inspector

flew in to make arrests along with ice agents and confiscated a handgun, and cocaine from the home. prosecutors say they're working on exindicting reyes. >> and mayor ed lee spoke out about accusations he tried to use his political clout to find a new job for ross mirkarimi then lied about it. and lee suspended mirkarimi stemming from dil charges on new year's eve. the ethics commission is determining whether mirkarimi can return to his job. mirk ream ease's comp a -- camp accused lee of trying to push the sheriff towards the job. >> i told the truth to the ethics commission and you know it sounds like another pafrt of the campaign going with people that say i'm not telling the truth.

and there is a restaurant near jack london square 14 years. >> i'm going to say it's still safe to come down here at night. it's a beautiful place. the water front is a beautiful location. i think it was just one time incident. >> and in a conference, jean kwan had no comment on the shooting but former mayor brown did. >> there is a great deal of crime. i think it's a great city. i live here and i am here several days per week. i was just say together police chief you've got to do better, guys. >> police are still looking for the shooter and the gun in this case. the meantime they say they'll increase patrols in this area and i mexed there are three other homicides over the weekend. police have made arrests in all three of the cases.

>> jury selection began today in the wrongful death suit against a former so far ware company owner convicted of murdering his wife, nina riser in the oakland hills, he's acting as his own attorney. the children are suing their father. they want compensation for their suffering from this murder. >> there are a number of people who think mr. riser has money somewhere in russia. if he does, what we need is a judgment so we can find assets for the children. >> gonzales says it should apply to any money he makes from software ideas in prison. his children will not attend the trial. they wlif their grandparents in russia. >> the city of oakland and port of kicking off a huge project promising to bring thousands of jobs to the area. they're working to convert a big part of the old army base located between 0 and 880 into a packing center for the port.

ray lahood joined governor and jerry brown today to mark the start of the project. the first phase called for $484 million in rail lines and warehouses to improve the movement of cargo containers between ships and trains. though lahood and brown were there to inaugurate this project, must have of the talk and nearly every question is about the controversial high speed rail plan. abc 7 news has the story. >> ray lahood called this conversion a game changer, then launching into this description of the vote in the leng slay tour. -- legislature. >> it was taken by california assembly and senate and gets california foo the next generation of transportation for the next generation he was referring to friday's vote to begin the piers phase of construction on california's high spaed passenger rail. that is what california has

told reporters the state needs both. >> i don't have to play games. and i'm tilling you we need high speed rail. we need a tax on the afluent to pay for schools. that is where we're going. >> the governor convinced california should have high speed rail. the secretary of transportation told me america will have high speed rail. but that vote in november will give us a better idea of when. >> and there is a supreme court judge ruling that his tax measure can be at the top of the november ballot. a los angeles attorney sued to push her own tax initiative head of the governor. and experts believe the ruling will give a better chance of passing if it is at the top of the ballot. and the governor's victory may be short-lived. the howard jar advice taxpayer association argues legislature

occupy the farm say they plan to fill up the city hall meeting where a public hearing is about to be held on development plans for a highly contested piece of land. it's located near marin and san pablo avenues. there it is on the map. there is a rally scheduled. >> and people here so far and it's been a contentious battle between occupy activists. now, you may recall back in late april, occupy the farm activists set up camp on the corner of san pablo and marin avenue. the plan to turn it into an urban farm. three weeks later the university chased them out and arrested nine demonstrators. tonight's hearing will put part of the land some residents are lobbying for a 55,000 square foot store, others want the land to be left alone. and over the weekend, occupy
