thanks for joining us. breaking news u.s. k firefighters on the scene of an overnight fire that broke out in saratoga. katie marzullo is live. >> reporter: it appears the fire is out but the house is still smoldering. this is live now you can see the smoke still billowing out of the front of this house. good news this morning the house was vacant and under construction, nobody was home and nobody was inside to be injured. take a look at the flames. this was before 3:00 this morning when the fire broke out when firefighters arrived they say the fire was running through the attic and pretty much out of control. it had lept up into a large

and weeping tree in front of the house that could have posed a threat to the other homes in the neighborhood. there's almost no wind at this hour or earlier when the fire wasser so that helped firefighters not to mention the fact that these lots are big and the hopes are fairly spaced apart that helped firefighters save the other homes. the other homeowners didn't have to be evacuated this morning. that is some of the good news. again, the fire out at this hour. one-alarm fire. crews made quick work of it. they've set up cones in front along the side of this house perhaps to keep people away out of some fear there might be some collapse. firefighters on the scene. next, they will be looking for the cause of in fire. katie marzullo, abc7 news. -- of course firefighters had to worry about embers that will be a worry for most of

into the wee hours of this morning on a plan to build on land owned by uc berkeley. protesters were there with other ideas for the property. amy hollyfield is live at the tract with the story. >> reporter: they tweeted us a couple of hours ago when the vote came down they said good-bye gill trabgtd. the decision was to develop a part of this land. uc berkeley will continue to use some of it for research the vote was 4-1 to allow uc berkeley to develop this land. big point for -- big disappointment for the activists. so many people wanted to speak out at the meeting most were opposed to the plan to build a 175 unit senior housing complex with stores, including a whole foods market. >> i have witnessed families

farming together, hands connected to the earth, parents teaching their children the kind of lessons that are denied to most of us who live in an urban environment. >> choices for our members who live in albany is to move 60 miles from their kids, grandchildren to find some place to live. this is one of the few opportunities they will have to have senior housing. >> reporter: the controversy started in april when some activists started squatting on this land owned by uc berkeley. they call themselves occupy the farm. they started planting crops and advocating for urban farming. university police kicked them out three weeks later and arrested nine. the group has been advocating to keep this land open but the vote last night was 4-1 to let uc berkeley move forward wits plan. amy hollyfield, abc7 news. san francisco fugitive awaits extradition from

north carolina this morning where he was arrested for the 2008 murders of three members of the bologna family. police arrested the 31-year-old wilfredo reyes yesterday with a 25-year-old man accused of harboring a fugitive. there was a five million dollar arrest warrant out foray yes, sir he's a wanted accomplice of edwin ramos who was convicted last month for the murders of anthony bologna and his sons michael and matthew. ramos' attorney says the arrest supports his client's story there was a second person in the car when the fatal shots were fired. >> it gives him some credibility first of all that he wasn't alone in the car -- alone in the car. >> prosecutors believe the killings were a case of mistaken identity ramos thought he was shooting at members of a rival gang. a spokesperson for the bologna

family says they will prepare for another trial. an autopsy has been performed on a san jose police officer's 3-year-old son. it could be several weeks until the results are released. preston orlando was found with a fatal gunshot wound in the home last thursday. history has been on the san jose police force for nine years the gun that killed the child was a privately owned 45 calibre semi-automatic pistol, not the officer's service weapon. new civil grand jury report finds san mateo county officials have not adequately planned for dam and levee failures five years after they've been warned to do so. responders to contact in the haven't of a dam or levee failure the report found the risk has not been a priority.

challenged her to debates all over the state monday a poll over the weekend shows that she trails the incumbent and 65% of californians don't know who she is. feinstein has two million dollars in the bank the challenger just $23,000. she said she is excited because with all of feinstein's advantages she says her lead should be much bigger. president obama in iowa today pitching supporters to press tax cuts for low and middle income earners only. a new poll out this morning shows his bid for reelection couldn't get any tighter. >> reporter: as the presidential race heats up in a dozen crucial battleground states a poll this morning shows the contest is dead even. president obama and mitt romney are tied among registered voters nationally. the poll shows troubling news for the president, 63% believe

the country is heading in the wrong direction. after another slow month for job growth president obama is renutting his focus on taxes pushing to extend tax cut force the middle class and raise taxes for those making more than $250,000 a year. as democrats try to build suspicion about romney's investments the president is calling on him to release his tax returns saying it is important for him to be an open book. romney says he has nothing to hide. >> all the taxes are paid as appropriate, all reported to the government, nothing hidden. >> reporter: the new poll shows most americans continue to disapprove of president obama's handling of the economy. more than half the country faults him on health care and immigration. still, 58% expect him to win a second term. tahman bradley, abc news, washington. thousands of people continue to look for work. abc7 news wants to do what we can to help.

some residents are unhappy the color of the new 7 1/2 million dollar library is pretty yellow the design went through a community process but the anti-yellow faction says the color they signed off on was not as bright. >> what was your reaction? >> shocking to see it, it really stands out. maybe in a negative way. >> the city councilman representing the district is conducting a poll on whether to remain. so far 44% want charcoal and grey library only 19% want to keep it yellow. this morning, several people face charges following a wild melee outside a florida courtroom in a stand your ground gun case. punches started flying when the hearing was cancelled yesterday. officers made several arrests. this controversial law allows people to use deadly force
