good morning i'm kristen sze. i'm eric thomas. breaking news in ohio right now haz-mat crews 100 people have been evacuated. you are looking at live pictures of that fire that is still burning. officials are trying to big out what the material is. police say the tankers may be carrying sulphur. it appears 11 cars were knocked off the tracks when the train derailed after 2 a.m. near the ohio state fairgrounds. officials say it is not clear what caused the train to go often tracks. so far two reported injuries. we'll continue to update this story throughout the morning and online at abc7news.com. this morning we have to look at the air quality and the possibility for slightly higher fire danger. >> let's check in with mike. heat we are most concerned

they put out several fires last night in kelly park. katie marzullo is live at the scene. where the fires deemed us is push ? >> reporter: yes. -- because of the number of them there are were two or three fires that broke out in the same location at kelly park last night. take a look at some of that video from last night this was around 8:50. two to three fires are being called suspicious. they burned 8 to 12 acres couple different estimates before firefighters were able to bring those flames under control. not an official cause. officials as well as residents near this park acknowledge the homeless and homeless camps in the creek are a problem. >> homeless encampments are a problem in the creek areas too early to make a determination that it is a homeless encampment. it could be accidental for

some unknown reason it could be intentional, too early to say. >> reporter: fire crews brought the flames under control after 10:30 last night no structures were damaged and no one was hurt. as you heard from mike, another hot one today in the 90s here in san jose, no doubt residents and people in general will be on high alert for fire danger today as well. katie marzullo, abc7 news. 4:30 four in contra costa county investigators trying to -- to determine what caused a grass fire along highway four. the fire forced the highway patrol to close westbound lanes at willow pass more than an hour those are piles of lumber burping in the middle of a feel the fire spread to 12 acres. fortunately the fire was nowhere near homes and nobody was hurt. oakland police investigating fatal shooting near the coliseum.

a 15-year-old boy was not around 8:00 last night on the 6700 block of leona creek drive he was taken to a hospital where he died. >> oakland police also investigating a shooting that left a 20-year-old dead the body was discovered in the backseat of a car before noon yesterday. authorities believe the victim may have been shot somewhere else and driven to the intersection near the seminary off-ramp and 580. mountain view man in custody in connection with a deadly pedestrian crash. the 21-year-old is charged with one count of vehicular manslaughter with gross negligence. police believe he was speeding when he ran a red light. a 50-year-old man was waiting for a bus when he was run over, he died at the scene. house republicans are set to vote again today to try to

repeal president obama's health care law. gop lawmakers are criticizing the law as a threat to the nation's economic recovery and they are predicting some democrats will join them. if it is approved in the house it is not expected to pass in the senate. most of the law was just upheld by the u.s. supreme court. democrats say republicans have not come up with a good alternative. at the white house today, president obama will meet behind closed doors with democratic congressional leaders. they will focus on the plan to extend bush era tax cuts. mr. obama wants them to expire at the end of the year for people who earn more than $250,000 annually. meantime, mitt romney moves his campaign to houston today. he will talk economics in a rare appearance before naacp. the organization has largely supported democrats but romney hopes excel a message that his policies would be better for

blacks who have an overall unemployment rate of over 14%, higher than the national average of 8.2%. governor brown is expected to sign the california homeowners bill of rights into law. the new law would stop banks from foreclosing on a house while considering a loan modification. requires banks to provide a single contact person to work with each struggling homeowner. the law will increase penalties for the criticized practice of robo signing by banks, an automatic approval for foreclosures without reading documents. california's high speed rail project is facing new challenges after the funding was approved. the legislature's vote last friday is giving way to smaller challenges before the state can break ground in the central valley next year. two opponents of the rail praopblg are close to reaching settlements with the state. union pacific has threatened to stall the project is close

to reaching a deal. some peninsula opponents say they are close to settling a court battle. in san francisco supporters of free muni for low income use are planning a rally before the transportation planners meet to vote. the metropolitan transportation commission allocated four million dollars to support the pilot program and san francisco supervisors approved another $400,000. the project will need near five million dollars to get the free muni for youth program going. time to check the weather. mike has been telling us if you like the heat you going to love today. >> what time did you turn your air conditioner on eric? >> about five minutes before i got home. good morning. this is the abc7 morning news live look from our roof camera towards san francisco east bay or south bay heat. mike is following the temperatures and the fire danger and he'll wrap that upcoming up. in southern california, a middle school teacher is in custody this morning after leading police on a wild chase. there goes. let's show you. a pe teacher behind the wheel. officers tried to arrest him on child abuse charges.

the chase through los angeles county came to a brief stop in torrance when an officer hit the truck causing it to spin and crash foot side of a big rig. but that didn't -- that didn't stop him he took off again. several miles later the pick up went flying often road over an embankment into a -- tree the wanted teacher was taken to a local hospital under police custody. us air ways investigating a mysterious odor that forced four crewmembers to get sick shortly after takeoff. they reported feeling ill on the flight from north carolina to rome. the pilot decided to divert to philadelphia. the sick crewmembers were taken to the hospital they've been released. no illnesses were reported among any of the 176 passengers, they are scheduled to continue on to rome today. parents listen to this, warning about a safety product that could turn into a deadly

naturally conceived. the much anticipated baby had been celebrated across japan. giant pandas have a low birthrate. in italy the captain of last january's shipwreck says he was distracted by a phone call when the cruise liner crashed. the captain told an italian tv station that he blames himself for being distracted but also said destiny played a role. 32 people died after the hull was gashed by a reef and the cruise liner took on water. last week a judge lived the captain's house arrest order but said he -- judge lifted the captain's house arrest order. he's accused of manslaughter, causing a shipwreck and abandoning the liner while passengers and crew were still onboard. >> sinking of a luxurious yacht in lake tahoe still a mystery there were more than a dozen on the yacht shortly before it went down in the tahoe keys marina.
