>> announcer: right now abc7 news begins with breaking news. that breaking news is in san jose, fires are working a house fire now it broke out an hour ago. >> katie marzullo just talked to investigators on the scene. she is going to give us the latest. >> reporter: the fire is not out take a look behind us being see through the trees those flames licking out of the roof of this two story home. i have just talked with way captain with the san jose fire department captain rob brown tells me they have initial knock-down but the fire is not out. the call came in at 5:06 this morning this is a three-alarm fire. two story home single family residence firefighters saw flames and smoke coming out of second story, out of the roof and attic shooting out of second story windows. they believe they know where it started, in the kitchen. the people who live there

admit they left something on the stove and went back to bed this morning. they have good reason to believe the fire star in the kitchen. it has reached through the home in the attic and roof out of roof. the people who were in the home are four adults, young adults in their 20s two live there two are friends. the fire captain says he believes they did have to order evacuations of the homes on either side of the house. that's just standard protocol. he has no indication yet of exactly how much damage has been done except to say major damage has been and i should say is being done because again this fire still burning inside this home in san jose we'll bring you an update in half an hour. katie marzullo, abc7 news. we'll check back in sooner if developments warrant. with temperatures soaring today we check in with mike to talk about the winds and any possible high fire danger.

hospital. ace, bart and caltrain, no delays. we'll keep you posted on the muni line just the n line at this point. golden gate bridge, foggy commute. bay bridge toll just minor back-up for some of the cash paying lanes. we have breaking news from ohio. haz-mat crews are at a train derailment in columbus, two rail cars on fire these are live pictures of those cars still burning and people have evacuated within a half mile. officials say they are trying to determine what material is burning. police said the tankers may be carrying sulphur, 11 cars were knocked off the tracks when the train derailed after 2 a.m. near the ohio state fairgrounds. officials say, it is not clear what caused the train to go often tracks. no injuries reported >> in san jose, firefighters are still at kelly park watching for hot spots after three suspicious fires started simultaneously. the park is southeast of down

roberts and keys avenues. officials say two of the fires merged into one around 9:00 last night. 40 to 50 firefighters fought the flames. crews were able to get control of the fires within an hour no structures or homes were threatened. investigators trying to figure out if the fires were accidentally or intentionally set. this morning the contra costa county fire district says it will have to start limiting the help to the neighboring east contra costa fire district. this comes as both districts deal with limited resources. amy hollyfield is live in pleasant hill with the story. >> reporter: this is a one for them to do. their instinct is to go but they say they can't do that any more. contra costa county fire has been getting called a lot they helped out with this fire from last week that happened in oakley. this was one of 18 incidents since july the 1st that i been called to help out on

officials say they can't keep up that pace. they are helping because east contra costa county shutdown half of is fire stays july 1st, because of budget -- fire stations july 1st, because of budget problems. that district has three stations protecting 200 miles it has been calling contra costa fire to send help. contra costa county fire says, it is now going to have to limit how much help it provides. officials say they can continue to send resources out of their own district many they are worried they won't able to help their own residents. there is some frustration here that it has come to this. they say obviously, they want to help, that's what they do. but, officials say there is just no other way they do hope that residents will pass a parcel tax that going to be on the ballot in november. they believe that will give them funs that could help them remedy this -- them funds that could help them remedy this problem they believe it will be critical to public safety. amy hollyfield, abc7 news.

north of sacramento, two fires burning out of control has spread across 17,000 acres the worst burning in the mendocino national forest. the so-called mills fire has scorched 13,000 acres and counting. crews are facing very high temperatures, the lack of wind and 50% humidity is helping. ranchers say they are amazed not a single property has been lost. a principal facing charges after being accused of failing to report the molestation of an 8-year-old girl. she surrendered yesterday, accused of not notifying police the first time a parent raised suspicious at whaley elementary school a story we've been covering since january when a teacher was arrested. a total of five families have stepped forward claiming their daughters have been molested by teacher craig chandler. uc leaders expected to tell the board that tuition at

10 campuses could rise more than 20% next january if votes do not pass governor's tax plan in november. that warning was an alert to voters as uc officials prepare to endorse the state's new budget that allows uc to freeze tuition at current levels the budget assumes voters will approve the tax plan. if not, uc has been told it will receive an automatic mid year cut. city colleges san francisco has 100 days to fix major problems or lose accreditation. alternative could be an end to the school. interim chancellor talked to a packed meeting last night about the possibility of city colleging losing accreditation and state funding and possibly closing if the board doesn't fix serious problems in a hurry, including money problems and leadership weaknesses. 90,000 students attend city college. school officials say they have a task force to address the money problems and how the

not any injuries one person being looked at on scene for possible minor smoke inhalation. the fire is mostly out at this point. we want to show you the video we shot when we first arrived. it broke out just after 5:00 this morning. there were four people home the owners' two adult sons and their two friends. the owners are out of town. i asked the captain if the home had smoke detectors? he said yes. one of the people inside woke up to the sound of a smoke detector and one person woke to the actual sensation and smell of smoke in their face. investigators have reason to believe it started in the kitchen based on what residents told them. they put something on the stove and then fell back asleep. looks like the fire started in the kitchen then moved quickly up through the second story into the attic. the fire captain says he's not surprised that the fire moved so quickly. >> actually the fire can

spread quick, especially kitchen fires you have flues that run to the second floor and those will get going and spread to the attic quickly. >> reporter: for the most part nobody was hurt one person treated for a little smoke inhalation possibly. residents on either side of the home were evacuated due to protocol. the home has suffered major damage and for what it is worth, it does appear the home was for sale. katie marzullo, abc7 news. police are investigating a fatal shooting near the oakland coliseum. authorities tell abc7 news a 15-year-old boy was shot 8:00 last night on the 6700 block of leona creek drive the boy was taken to the hospital where he died. police investigating a shooting that left a 20-year-old man dead the body was discovered in the backseat of a car before noon yesterday. authorities believe the victim may have been shot somewhere

else and driven to the intersection. in a few hours governor brown is expected to sign the california homeowners bill of rights into law. the new law would stop banks from foreclosing on a house while they are considering a loan modification. also requires banks to provide a single contact person to work with each struggle homeowner. the law will increase penalties for the much criticized practice of robo signing by banks when an automatic approval for foreclosure is given without the documents being read. in san francisco, supporters of free muni for low income youth planning a rally this morning to vote on the issue. the transportation commission has allocated four million dollars to support the pilot program. supervise areas proved another $400,000. the project will need another five million dollars -- to get the free muni for youth program going.

the committee deadlocked on recommending additional funding last month. mountain view city council voted last night against google's propose to build apartments in the city's north bay shore area. that area is home to several dwindling species. the google has been looking to bill more than 1,000 units for employees so they can live a walk away from company headquarters. environmentalists say the impact could eradicate pea sees. >> they can build across 10110 -- 10 minute walk, foot bridge just completed it is not that far. >> if we can provide a little option for them to get a little closer so they can take their bike or walk it would be great for the environment and traffic. google conceded there are other places to build apartments in mountain view with the city council's rejection gaggle just won't be able to build on the north bay shore land they own.

san bernardino is now the third california city to declare bankruptcy in the past month. the city of more than 200,000 is located 65 miles east of los angeles facing a 45 million dollar deficit the council voted yesterday to seek chapter 9 protection from creditors. mammoth lakes declared bankruptcy last week stockton filed last month. san bernardino is the third largest. us airways investigating a mysterious odor that caused four crewmembers to get sick onboard a flight shortly after takeoff. the crew reported feeling ill on the flight from north carolina to rome before 10 last night. ua airways says the pilot diverted to -- us airways says the pilot diverted to philadelphia as a precaution. no illnesses reported among the passengers they are scheduled to continue on to rome today. two storms in the pacific

house republicans are set to vote against today to repeal president obama's health care law. gop lawmakers are criticizing the 2-year-old law as a threat to the nation's economic recovery and predicting some democrats will join them. even if the repeal is approved in the house it is not expected to pass in the democratic controlled senate. most of the law was just upheld by the u.s. supreme court. democrats say republicans have not comp with an alternative. -- have not come up with a good alternative. today president obama will meet behind closed doors with democratic congressional leaders to focus the plan to extend the bush era tax cuts. meanwhile, mitt romney moves to houston today he will talk economics before the naacp the nation's oldest civil rights group. the black organization has largely supported democrats.
