good morning. i'm eric. >> eric: and i'm kristen sze. oakland leaders and patients of the largest medical dispensary are gathering this morning promising to fight the federal government which is taking strong action to shut down what they are calling a marijuana super store. amy hollyfield is live at oakland city hall where they just finished their news conference. >> the u.s. attorney's office says it's the size that makes it's a target. the pot has a greater chance ending up in the wrong hands. officials say it is so large because the need is so great. they say they aren't going

anywhere. >> we will never abandon our patients. [ applause ] >> with a bold determination, officials at harbor side health center promised they will take on the federal government and do whatever it takes to keep their doors open. >> we know that when dispensaries close it's the most vulnerable patients that suffer the most, unable to find new sources, unable to navigate dangers of illegal marketplace. >> they put them on notice they plan to seize the property under federal laws prohibiting the distribution of marijuana. this has 100,000 customers very nervous. his young son relies on marijuana to stop the seizures he suffers.

down another university. according to the press release the mayor was expected to address all this but she was not there. oakland police are investigating an early morning homicide at a macarthur boulevard hotel. we brought you the story at four third. they responded about 3:00 this morning. they found a female victim inside a bloody room. investigators say the woman was an oakland resident and arrived w there with someone else. >> there was one other individual that was under age. they had to administer cpr to. >> the man with the woman was said to be a friend. this is the seventh homicide in oakland since last friday. >> united states of firefighters are joining the efforts to battle a fire that continues to grow. the blaze broke out yesterday

afternoon near the american river. fire officials say it grew to 220 acres. 200 people have now been evacuated. crews are facing tough conditions with higher temperatures. they are moving quickly to keep the spreads from spreading and jumping the north fork at the american river. if the fire goes in the canyon, it has a lot of potential for growth and canyon is very narrow condition yon and fire could jump to the other side of the river. that is what we don't want to see. >> the town of colfax is the other side of the american river. that fire is 20% contained. couple more wildfires to tell you. mill fire in mendocino is 38% contained. >> in tulusa county the wildfire has burned 42 acres. they should be under control by

saturday. the cause is under investigation. >> back here in the bay area, firefighters are looking into what caused a late night grass fire next to a mobile home park and construction site. it erupted around 11:00 last night off of monterey highway. it damaged a power line and there were no outages. nobody was hurt. now we are under another spare-the-air day in a row here in the bay area meaning the air quality levels could be a little unhealthy. >> a live look from emeryville looking towards san francisco. you can see the haze sitting over the city. a little less smoke and a little more fog than yesterday. meteorologist mike nicco has a look at the forecast. >> great observation on both your parts. here a couple things. how cry it is a lack of clouds over the land but over the coast the clouds are not dropping any rain but they signal the sea

children that sandusky victimized. >> powerful and shocking. that is how they described penn state officials who they believe covered up the scandal to avoid bad publicity. >> no such sentiments were ever expressed by them to sandusky's victims. >> his 267 page report says most of the report came through e-mails. penn state's former president vice president jerry schultz and athletic director. pa paterno told curly, instul stetd of calling police and they decided not to alert authorities. this happened after all four knew of past sexual allegations against sandusky. last month they found him guilty

just getting word that the hacking breach involving yahoo extends to g-mail, aol and global and more. the company says they are looking through claims of a massive security breach that may have exposed half a million e-mail addresses and passion words. they say a group of hackers based in ukraine have claimed responsibility and can it to prove that yahoo has security weakness. in a statement they apologized and urged users to change their password on a regular basis. >> looks as though nature has taken its course in south san francisco. wayward dolphin in colma creek has gone home. he was first spotted around 11:30 in the morning. much to the delighted of locals.
