driver was taken to the hospital with minor injury asks is now in police custody. in fremont abc 7 news. >> thank you. >> a cupertino neighborhood remains shaken following a tragic accident that killed a 5-year-old boy. investigators say the boy was riding a scooter when a driver backing out of his driveway ran over him. it happened on vista court a cul-de-sac with less than a dozen homes. and the boy was conscious and breathing when crews arrived. but he died later in the hospital. >> more developing news in san francisco. a police officer shot a man near the ferry building at davis and washington streets. shortly after the man stabbed a co-worker in a chocolate company block as way at pier 17. abc 7 news is live with the latest. let's get clarification. we had initial reports out there today that this suspect

was killed. what is the latest? >> we're told he's in critical condition with life-threatening wounds. he went through surgery this morning. this is the chocolate factory making high-end chocolates today ending up becoming a crime scene. this started this morning. the chief says a 30-year-old man slashed a co-worker. >> employee raised his arm to block the flash. it cut him good on the arm. >> the victim left a bloody trail following his attacker. police encountered a suspect near washington and davis streets. >> the suspect was nonhe responsive, just kept walking. >> the chief says officers then tried to stop him. >> he produced a box cutter razor knife, lunched at a

an -- lunged at officers. the suspect went down on his stomach. the officers handcuffed him. and they saw he had been shot twice they unhandcuffed him. >> police performed cpr and an ambulance took him to san francisco general ho. again, the suspect went through surgery this morning. we're told that he was in critical condition. and there is police are not releasing his name. the victim of the slashing, we're told was treated and released. the chief says that victim said he doesn't know why he was attacked and that it was unprovoked. at 6:00 you'll hear from someone who says he witnessed that attack. >> and we're watching for developments at usc -- ucsf where they will vote on a plan to freeze under graduate tu

but just for a few months. and we're live. leanne? >> they just voted and despite the vote to freeze tuition, several dozen students and workers decided to disrupt this meeting and now decided to dress up as zombies and started chanting and dancing to the beat of the popular song "thriller". why zombies? they're protesting so called or what they call death of public education. the prot testors decided to leave on their own. the real news happened later when the regents voted to not increase tuition for under graduates in the fall. they're counting on voters to pass the increase. if it passes uc system would get $125 million the following year. but, if the initiative fails,

suspended sheriff ross mirkarimi is back in san francisco now. and set to testify within the hour in her husband's ongoing investigation. she returned last night scheduled to appear before the ethics committee around 5:00 p.m. that panel will decide whether to recommend removing mirkarimi from office because of domestic violence on new year's eve. and lopez has been in her native country since march n may she told dan noyes in an interview she feels this investigation is politically motivated and taking a toll on the family. dan noyes will be inside of the meeting and will be tweeting live updates. also have live reports from abc 7 news reporter carolyn tyler at 5:00 and 6:00. >> the governor was in san francisco today to sign a high speed rail funding bill. the governor sign that had bill this afternoon and decided the future transit center. the bill will allow the state
