good friday morning i'm terry mcsweeney in for eric thomas. and i'm kristen sze. breaking news. a man in custody accused of opening fire inside a packed theater. at least 14 have died. many more injuries. katie marzullo is live with the latest. >> reporter: we are learning new information about the suspect who is in custody. he's 24-years-old. authorities have not released his identity. when police found him at ter he told them he had chose sieves at his home. officers evacuated the -- apartment complex. they did find something at the movie theater. the police chief told cnn the

suspect's car was at the theater. we are seeing video of the white sedan. at last 14 are dead. 10 died at the theater, four later at the hospital. the youngest victim to the hospital was 6-years-old, 50 people were wounded. police say the shoot her a rifle, handgun and another weapon, also a gas mask. witnesses say the man did not say a word he released some sort of canister into the theater and started shooting. >> it took a second to realize what was going on. as people were running, i hit the ground. [ inaudible ] i heard the sound of metal canisters and i saw plumes of smoke. >> reporter: at this point in the hours following the shooting authorities believe the shooter acted alone. he does not have ties to domestic or international

terrorism. one hundred fbi agents at the scene. the homeland security adviser notified president obama of the shooting in the last hour. the president has released a statement he says he's shocked and saddened by what he calls a horrific and tragic event. >> much more as it comes in. suspended sheriff ross mirkarimi is headed to court today not to get his job back, but to get his wife back. a day after she testified again before the ethics commission. amy hollyfield joins us live. >> reporter: busy week for them, yesterday a hearing at city hall today a courtroom at the hall of justice where they will ask a judge to lift that protective order so they could see each other. eliana lopez admitted yesterday before the ethics commission that one fight has sent her life into a disaster.

she testified yesterday telling the commission that mirkarimi did cause the bruise on her arm. >> of course i was so angry he grabbed my arm in front of my son. >> why did that concern you? >> not only that, the profanity was worse for me. >> reporter: she says she doesn't think grabbing her arm is domestic violence. she told the panel she regrets making the video, neighbor showing the bruise on the video. on the video she says this is the second time this has happened. yesterday she said what she meant this is the second time they argued and mentioned getting a divorce not the second time he hurt her. she said she is looking forward to coming back to san francisco and reuniting with mirkarimi to reunite they have to get that protected order lifted.

amy hollyfield, abc7 news. meantime, the ethics commission has ruled san francisco mayor lee's alleged perjury in two sworn statements before them is irrelevant to the proceedings. the commissioners said any matters of witness perjury should be taken seriously with but the specific truthfulness of two statements made by the mayor do not play to the primary question of whether sheriff mirkarimi should be removed from office. other city leaders have refuted the mayor's testimony that he never discussed mirkarimi's suspension and did not authorize third parties to offer the sheriff a new job if he would quietly resign. san francisco police chief plans a news conference this morning on a fatal officer-involved shooting in the financial district. the victim is a 32-year-old man of oakland police say he slashed a co-worker with a box

denver, of the parking lot of a movie theater where tragedy struck this morning. a gunman opened fire inside a packed theater at the opening of the batman movie. 14 people so far have been killed. 50 others injured, including a 6-year-old boy. police say they do have the suspected gunman in custody. witnesses say he released some sort of canister then began firing, wearing googles, mask police had his apartment building evacuated because he told them that he had some sort of explosives. katie marzullo will be back with another update shortly. cdc is warning of an old time disease making a comeback. the number of cases of pertussis, better known as whooping cough is rising. tahman bradley has the details.
