batman movie. it may not be overyet. katie marzullo joins us live from the breaking news center. >> reporter: several new updates within this half hour. first, authorities still believe the shooter act add loan that he does not have ties to domestic or international terrorism. this was potentially his car found at ter police looking through for any explosives. they might have found an explosive inside the theater. at his apartment complex he claimed to have explosives. as for the shooting 14 are dead, that number may have been downgraded to 12. that is still developing. 10 people died at the theater at least and then more at the hospital. the youngest victim here's an update, before we thought wait as a 6-year-old authorities are reporting a three-month-old was the youngest victim killed or wounded, not sure at this hour. 50 people were wounded some treated for gunshot wounds

>> those are some parents' children and some grandparents kid, and so forth. just unfortunate, sad. you go to the theater to have fun eat popcorn, hot dogs have fun with your loved ones, dates and enjoy a movie. >> reporter: he didn't fully know the details of the story. back to colorado this is the alleged shooter the suspect's apartment complex. he claimed to have explosive there is. authorities evacuated the complex and are still searching. unclear if they did find explosives or not. not a lot of details on the suspect, he's in custody, 24-years-old. authorities have not yet released his identity. suspended sheriff ross mirkarimi is headed to court today to get his wife back. this comes a day after his wife eliana lopez wrapped up her testimony best things

commission. lopez testified that the fight she had -- she had with her husband on new year's eve has sent her life into a tailspin. she told the commission that mirkarimi did cause the bruises on her arm during the argument she said she regrets making the video showing her neighbor the bruise. she said she recorded that in case their marriage ended in divorce and a custody battle ensued. amy hollyfield will have a live report in our next half hour. ethics commission has ruled san francisco mayor lee's alleged perjury in two sworn statements before them is irrelevant event to the proceedings. the commissioners said any matters of witness perjury should be taken seriously. but the specific truth fullness of two statements made by the mayor don't play to the question of whether sheriff mirkarimi should be removed from office. other city leaders have refuted the mayor's testimony that he never discussed mirkarimi's suspension with supervisors before he issued

the jurors could not agree on a misdemeanor assault charge. lindner took the fifth amendment and refused to answer questions about the sexual assault even after prosecutors said that the abuse did take place. lindner testified that he did not abuse the lynch brothers. memorial service is scheduled in millbrae today for two people who died when their house caught fire in san bruno a week ago today. the 62-year-old died in the hospital. her 2-year-old grandson was killed in friday's fire. investigators believe candles from the family's religious alter may have started that fire. san mateo county supervisors will try to get voters to approve a tax increase in november to pay for general services. voters said no to two tax measures in june. officials vote tuesday whether to put the measure on the ballot.

one would ask voters to increase sales tax by half a percent from 8.25% to 8.75 if voters agree would it add 60 million dollars per year for 10 years and then expire. speaking of taxes, san francisco bay area officials will study a proposal to charge motorists a tax on every mile they drive. members of the mta and the an association of bay area governments approve going forward with further study on the plan last night. drivers could be required to install gps-type odometers on their vehicles. it would raise money for roads and public transit while reducing traffic and car emissions it could take a decade or more to be launched. don't you see potential challenges? >> i see a number of challenges. there might be people upset about that.
