>> the district attorney says the two are equally cup pabl of the heinous crime but believes ramos, not reyes, was the shooter. reyes is nervous, anxious according to his attorney who says the 31-year-old is waiting to learn about what he is facing. and this reputed gang leader is accused of being an accomplice in the june, 2008 drive by killing of anthony bologna and his two sons in what investigators say was a case of mistaken identity i don't believe he's the shooter. >> ramos has been convicted of the triple murders and he always insisted he never fired the shots. the jury dead locked but the district attorney doesn't believe reyes was the trigger

man. he isn't being charged for that. ramos's attorney says her clients was the scapegoat. >> they got someone to blame so why should they now say it's willfredo? it's going to be difficult to prosecute willfredo when saying edwin was in the car alone all that time. >> and this is a piece being added to it. the fact he was in the car it doesn't contradict the fact mr. ramos was in the car and involved in a killing. all we have is additional information. >> and a surviving son testified he only saw ramos in the car. now, reyes attorney is wondering if that is grounds for a new trial or what impact, if any that might have

in her client's case. >> san francisco sheriff deputy has been arrested on charges. he was detained on thursday for a dispute at a gold's gym. police say the victim is someone he had a personal relationship with and he is openly gay and featured in a documentary. he's charged with false imprisonment and placed on eleven. >> police continue to search for a suspect in the double murder that left three children without parents. police have not yet named a suspect and neighbors say they heard a loud argument and gunshots and investigators found two people dead at the scene, three young children were unharmed. relatives of the victim say a jealous ex-boyfriend of the mom may be to blame.

>> in oakland police arrested a third suspect in connection with a shooting on saturday in which a chp car was rammed and shot. authorities say two of the suspect were spotted near east 24th street and there is one arrested after a two-hour standoff. police suspect they were inside of a black acura that ran the chp car saturday night, shooting out patrol career window. >> there is an update on the tragedy in colorado. bat map star christian bale is visiting survivors of the disaster. he surprised victims in their rooms. he's going from hospital to hospital to meet with shooting survivors as well as loved ones of the victims. warner brothers says bale is not there on an official visit representing the studio. >> a couple injured in the shooting has something to celebrate. a 21-year-old katie mud medly

checking healthy living news there is a great reason to power down when you want to sleep. researchers in ohio state university say being in front of the computer or tv screen could increase chances of becoming depressed. the researchers studied hamsters but say this translates to humans. they say turning off electronics late at night could reverse symptoms of depression within two week autos a san francisco man believed to be the ever person cured of hiv spoke today in washington. he also known as berlin patient says a recent study suggesting he may still have hiv is false. brown had a stem cell transplant in 2007 to treat leukemia his donor had a genetic mutation that provides natural resistance to hiv it was gone after three months
