and it is happening in the south bay where a probation officer has been shot on the job. good evening. i'm dan ashley. >> i'm carolyn johnson. highway 17 is a mess tonight as sheriff deputies investigate of the abc7 news reporter lisa amin gulezian is live with the latest for us. lisa? >> carolyn, the santa cruz county sheriff's department is in charge of this investigation, and right now they are here still gathering evidence at this time.

but it is causing quite a problem along the laurel curve and highway 17. here's what we know what happened today. at 8:18 tonight, chp dispatchers put out what is known as an aide call to all sheriff departments in the area to respond to highway 17. the probation officer is from santa clara county, and he called for help himself. this after being shot. it is not clear how he was shot in the upper leg, but chp reports that two people were arrested soon after the shooting. in fact, one car was just towed away, and that car according to a witness belonged to the suspect. but since that time, highway 17 southbound at this hour is as you mentioned, carolyn, still a mess. traffic is backed up southbound to the summit. the investigation into what happened still continues. officers will be out here for several more hours. live along highway 17 tonight,ly say amin gulezian, abc7 news. >> lisa, thank you. a bay area story that made national news is now being

made into a movie. filming is underway. it is called "fruit veil, drama about the shooting of oscar grant by a bart police officer." and tonight we know the transit agency is actually helping make the production possible. john alston is here, but it is all about trust, isn't it? >> that's true. tonight an official with the commission refused to reveal any information about filming locations except to say there were no filming permits for tonight. and bart declined to provide information saying it has an agreement with the producer to keep the filming as quiet as possible. >> according to family members and those familiar with the project, one of the filming locations is the fruit veil bart station in oakland where he was shot and killed by a bart police officer. the film is being made with the blessing of bart which is being paid as undisclosed amount of money by the producers. jim allison tells abc news when there was filming on bart property, the permit ensures that bart is reimbursed for

staff work so taxpayers are not sub subsidizing the film. but he would not reveal any specific financial details. the independent film titled fruit veil has octavia spencer. the two had a chance to talk about grant recently. >> i told her that was the last time i got to see him, my birthday celebration where he came and brought some crab. we laughed and cried and it was a really good interview. >> reporter: the writer and director is ryan kugler seen during recent filming. he declined comment. other places include high land hospital and police say there will be filming at the san leandro bart station later this week. the transit agency spokesman says bart oversees the content, so bart is not portrayed in a way that bart does not want to be portrayed. the city and transit agency is keeping the details close to the vest.

>> i would think it would have to do with how the case turned out. you know, what kind of appearance it would give the city of oakland with this movie in itself. >> i am believing it is going to be a big success. it will be a teaching tool for others to learn and to see that, you know, when police are in a tight situation, it doesn't have to end in murder. >> bart officer johannness mezerley was not convicted of manslaughter. they said if we want a deal, we would have to make a public records request. we plan to do that. a 20-year-old santa rosa man died in the russian river tonight, the fifth person to die in the river this summer. investigators say the man was swimming near sunset beach when he began flashing and went underwater. divers found his body about an hour later in 10 feet of water, not far from where he

went missing. the man's name has not yet been released pending notification of family. today's drowning happened about a mile downstream from steel head beach where a 13-year-old san francisco boy drowned on sunday. an update now on the tragedy in colorado. the survivors of the shooting masacre got a surprise visit today from christian bale, the actor who playsthe "the dark knight rises." bale might have resembled bruce wayne smore than batman when he visited the hospital. he stopped by a growing memorial near the movie theater where 12 people died when a gunman opened fire when "the dark knight" premiered early friday morning. abc news continues to learn more about how the shooting suspect, james holmes, is behaving in jail. they say he spat at guards so often at one point they forced him to wear a face guard. he twitched his eyes while staring at the wall hours after his arrest. he told officers he was the

joker. at one point detectives covered his hands with plastic bags to collect gun powder residue. holmes pretended the bags were puppets. and a young man was wounded in the shooting and his wife, this is hugo jackson immediately. his mother, katie, gave birth to him this morning. katie immediately escaped unharmed, but her husband, caleb, was shot in the head. he is in a medically enduced coma at the same hospital where his son was born. his brother says he is improving every day. >> we all know caleb. we know he is a fighter and he will not stay out of that child's life for any length of time. >> the university of colorado hospital reports mom and baby are doing just fine. the immediatelies went to see "the dark knight rises" as their last date night before becoming parents. caleb immediately has worked as a stand up comic and his fellow comics plan to hold benefits to help pay for his hospital bills because the

family does not have health insurance. back here, oakland police are looking for a 16-year-old teenager in the attempted murder of a california highway patrol man. they say canyon thomas of oakland is one of four suspects who rammed a chp cruiser saturday night. they then fired on the officer blowing out the car's back window. you can see all of the glass. two men were arrested that night, and a third man was taken into custody monday after an hour's long standoff in east oakland. police say that thomas is an african-american male, 5 foot 5, 135 pounds with short, black hair and wears glasses. they also say thomas may be armed. a san francisco sheriff lieutenant was place owed administrative leave following an alleged domestic violence incident. he was detained after getting in a dispute last thursday at the gold's gym on market street. we have video of him in the 2009 documentary "the butch factor." he is openly gay, and he faces assault with intent to cause

outside the golden gate bridge. the national oceanic relationship saw them feeding in a shipping lane just today. on june 21st, an endangered fin will was found. the spine was cleanly severed in half, most likely by the propeller of a ship. >> right now we have an abundance of whales just outside the golden gate bridge. that's where the national oceanic and atmospheric administration is recommending all slips showdown to 10 knots in the shipping lanes. >> today our accessory search crews cited as a minimum 30 whales, primarily humpbacks between the fairlawn islands and the golden gate bridge. >> reporter: they are eating huge amounts of cril, and they are in the shipping lanes so the decision to slow down is voluntary. >> obviously it is counter to their business interest to slow down.

they have schedules to make. >> reporter: but johnberg -- john berge says the industry is making a good faith effort to follow the recommendation. >> the crews on the ships understand the whales are magnificent animals animals and nobody wants to hit them. if they can see a next success success -- nexus of actions that might be required of them, and a benefit to the whale p poo layings, then we are -- whale population, then we are hoping for success. >> they may enact a mandatory rule that would move the shipping lanes further from the coast, and they would also create a slow lane. it and it y at first. if there wasn't compliance, we would look at doing a regulatory action and making it mandatory for vessels to move to a different lane. >> but the shipping industry is president coulding. it agreed to have trained whale spotters who would send out warnings to other ships. now noaa and the shipping industry agree it will take a lot of out reach by both parties. if you want to see the whales

and didn't report them for a dozen years. the mercury news reports that only an honor system is used to track these special funds. state agencies have more than 500 of these types of accounts that comes from user fees as opposed to tax revenues. apple reported $35 billion in revenue this quarter, a lot of money obviously, but still didn't meet analyst expectations. that's a 23% jump in growth, but believe it or not it is the slowest rate of growth in years for apple in revenue and net income. analysts expected 37.5 billion. the drop is not due to sales volume of the apple met expectations for the iphone and the ipad. the price for both those products has dropped in recent years. apple announced it will release its new operating system for mac computers, the mountain lion, tomorrow. >> a pleasant and cool week of weather coming our way. >> it is all good. sandhya patel is here with the

the temperatures. the numbers right now in the 50s and the 60s. it is still pretty mild. fog near the coast bay. below average temperatures inland for your wednesday. it is going to be a little warmer by the time we get into the weekend. so let's look at some of the high temperatures by tomorrow and compare them to the average. santa rosa should be at 83 tomorrow. tomorrow afternoon 75 8 degrees below where you should be this time of year. livermore, 90 is the average. you are falling about 6 degrees short. and in san jose, 79 tomorrow afternoon and 84 is typically what you see, so 5 degrees cooler than where you should be. it is all due to a trough that is over us, and it is not in a hurry to go away anytime soon. if the wind flows from the high to the low this pattern will continue which means wednesday through friday. it is a quiet pattern. mild conditions as opposed to hot in our inland valleys. it is going to be a pleasant forecast ahead, just not what you

the temperatures will be quite comfortable, much like today when you step out the door in the 50s. the fog could limit your visibility. you might want to get out the door as you head out to work a few minutes earlier. the fog that will be around especially in the north bay and along the coast and bay will really pull away except for a few patches along the coastline. 60s at the coast and 80s inland. very narrow range for summertime. we normally see a good 30, 40-degree spread between the coast and inland. not going to happen tomorrow. 79 tomorrow afternoon in the south bay and san jose. 77 for sunnyvale. on the peninsula, 70 in millbrae and up to 76 in palo alto, mountain view. 61 on the coast in pacifica, 63 half moon bay and breezy at times. westerly winds up to 20. downtown san francisco, 66 degrees. get you up into the north bay, upper 80s around ukiah. 75 santa rosa, 76 in sonoma. east bay communities, oakland a real comfortable day, 69, 72 in hayward. inland areas not the 90s, we are going with 80s.

researchers say youtube videos could be a helpful tool when it comes to treating vertigo. vertigo is the unsettling feeling of spinning when you are not moving. and now doctors at the university of michigan say you can learn a technique to cure it by watching youtube. it is seen here and it helps relief the dizziness by moving particles in the ear. the key is finding a video like this one produced by the american academy of inure roll gee that shows the correct technique. vertigo affects six million people in the u.s. it is responsible for up to 40% of doctor visits related to dizziness. alameda county is looking for volunteers to conduct a vital civic duty, perform civil marriages. to do the job you must read and write english, be 35 years old and be able to volunteer a minimum of two and a half hours a week. those flewent with in other languages are encouraged to apply. they need people on tuesday an monday, tuesday and wednesday
