short time later only 50 feet of grass burned. a group that raised funds to keep a popular park open will demand donations be refunded after the discovery of tens of millions of dollars hidden in the state agency in charge of parks at a time when parks are being closed due to budget cuts. terry mcsweeney is live in san jose with the story. >> reporter: it was upsetting these groups, 54 million dollars has been found in the state parks' fund and it is looking like maybe none of it is going to save these parks scheduled foreclosure. take a look at pictures, some people are -- saying it is unbelievable the money wouldn't be going for parks slated foreclosure. henry hill park was on the hit list until a fund stepped in and raised 27 -- $279,000, privately raised a promise from the group to raise the

same amount for the next two years. that deal might be off the table. >> if we don't get assurances from the legislature they will move these funds back into the state parks we will -- >> reporter: state parks director has stepped down, one week ago today. other non-profits want their money back including forecast rock state park. the preservation fund is giving state until september 30th, to make a decision. today in san jose, there is going to be a news conference so people are get to -- are going to get the message out the state has to be something about the money raised privately and that money in that undisclosed fund in sacramento. terry mcsweeney, abc7 news. in a few hours the police say the man who caused a horrific road rage accident in fremont is scheduled back in

court. last week the 21-year-old told the judge he could not afford a lawyer a public defender was assigned. he lost control of his car nine days ago, barely missing a toddler slamming into the little boy's mom and sister if a stroller. the mom and child are okay and he faces two felony counts, including reckless driving causing bodily injury. sheriff looks for more potential victims after arresting a man suspected of having sex with a 13-year-old girl. they say he befriended the girl at a shopping center. offered her a ride home an had sex with her. her family confronted pollack at a convenience store last night where deputies arrested him. he ly moved to the area from tennessee. he drives a 1993 red toyota with a tennessee plate and often visited the shopping center. anyone with information is asked to call the sheriff's office. somebody is calling

residents and business owners saying they are raising money for the fire department. the san francisco fire department says it is a scam. two people have been contacted, one by e-mail, one by phone a merchant got a call asking for nearly $200 to pay for a fire department yearbook. he was told the department does not solicit donations. oakland city officials say their police officers are wrong about their radio system breaking down while president obama was in town early they are week. officers claimed the system crashed during his speech at the fox theater monday night and they couldn't communicate with other officers in the room. city officials responded saying no officer in the theater was affected. city officials say the problem began when an air conditioning unit on one of the radio towers went down causing an antenna to fail. they insist it didn't happen until long after the president

left town. palo alto police looking for the person who pulled a gun on a man riding his bike home from work. all the robber got was a cell phone and small amount of cash. he was wearing a black hoodie, had a black handgun on the bike path between the town and country center. police want you to call if you recognize that person. newark police continue to hunt for four armed men who robbed a jewelry store in a shopping mall around 12:15 yesterday inside the newpark mall. they stormed in the store and smashed display cases, grabbing merchandise. one fired a gun, nobody was hit. police believe the robbers ran through a jc penney store before hopping into two stores. san francisco archbishop set to make major announcement this morning. no word on what he is going to announce.

>> 5:30 thank you for joining us i'm eric thomas. and i'm kristen sze. firefighters are working to cap a hydrant after a car crashed into it this morning causing a huge fountain now, big mess. amy hollyfield is live at castro and henry streets. how are they doing? >> reporter: they've stopped the flow of water the gushing is over. take a look there's the fire hydrant there in the back of the pick-up truck it is out of here. this driver just knocked it over and crews have loaded it up. look at this video when the car hit the hydrant it knocked it off and triggered water at castro and henry street 2:00 this morning. the man working on the water situation told me police took the driver out of here, he appeared to be drunk. residents never lost water,

crews say they may have lost some pressure. they just got the hydrant capped. did it create a mess and a challenge for a couple of hours. but, they have resolved the situation. amy hollyfield, abc7 news. thank you. 5:32 now. a few hours from now, the non-profit group that raised nearly $300,000 to keep a popular south bay state park open will demand state lawmakers return the public's donations or make sure it is used on the park. governor brown's administration discovered 54 million dollars in hidden money in the park department's account. the foundation says the money could have been used to keep 70 parks off the budget chopping block. henry park near morgan hill was on that list until the non-profit raised money to keep the park open. terry mcsweeney will have a live report coming up in our

next half hour. a 2-year-old boy is being treated for third degree burns after falling into a fire pit in marin county it happened last night at dillon beach a fire department spokesman says the boy fell backwards into the pit he suffered burns on his lower back. the family members were with the toddler when the accident happened. an ambulance was called for bodega bay which is 20 miles away. pg&e settled lawsuits with two families that lost lives of loved ones in the san bruno pipeline explosion two years ago. >> san mateo county superior court judge approved the deal yesterday for an undisclosed amount. attorneys have negotiated agreements with pg&e peg in 50 cases. more than 400 suits filed by survivors who lost relatives in the 2010 explosion. santa rosa man faces several felony charges after five hour standoff with the sonoma s.w.a.t. team.

officials say they received the report before 6:00 last night from a man who said he heard gunshots from his roommate's bedroom. deputies say the 48-year-old man refused to come the out of the house all other residents were evacuated. 11 p.m. a remote controlled robot was sent into the house and found him lying near a bed intoxicated and unresponsive. he was taken to a hospital for a medical evaluation. bike rider accused of killing an elderly pedestrian in san francisco's castro district is due back in court today. 36-year-old chris bucchere pleaded not guilty to felony vehicular man lauter -- vehicular manslaughter last month. he's free on he's accused of running into a 71-year-old man when he was in the crosswalk at market and castro last march he died a few days later. prosecutors say bucchere made no effort to stop or slow

down. this morning a glimpse of things to come on the new bay bridge caltrans lit up 24,000 individual l.e.d. lights on the completed eastern section. the state-of-the-art lights were created just for the bridge when both sides are completed 1500 fixtures will house 48,000 l.e.d.'s creating a flat white light that does not shine into opposing traffic. better for an iowa-based lighting company designed the special lighting. >> what we use for l.e.d.'s individually aimed and visored. you create basically the ability to pain the road surface as opposed to throwing a bunch of light at it. >> the new about is on schedule to open labor day weekend, next year. >> seems to be high-tech in almost every dimension, including those lights. >> after all this time and money, that's good. >> looking forward it to.
