explaining the transition. the two men involved on the left passing the torch san francisco archbishop. the older man to the left. to the right of him the bishop of oakland since 2009. the vatican made it official today that he will take over the half million strong san francisco archdiocese october 4th. this will not be without controversy. the father is known to be backer of prop 8, the ban on same-sex in california and he was not shy about explaining why. >> marriage is the union of a man and woman because children can only come about through the embrace of a man and woman. >> the archbishop is retiring after being here since 2006. he has had health problems recently, notably he had chest pains in southern california and had a double bypass operation. by cannon law he has reached

75 and at 75 archbishops have to retire, part of the reason for the transition. once again the archbishop, the future archbishop will be installed october 4th. eric thomas, abc7 news. san francisco mayor ed lee has delayed a city leader to come out against chick-fil-a he wants the chain to stay away from the city after the ceo took a public stance against same-sex marriage. the mayors of chicago and boston made similar comments. gay rights advocates across the nation have been protesting outside the restaurants. the mayor sent out these tweets: very disappointed chick-fil-a doesn't share san francisco's values and strong commitment to equality for everyone. the closest chick-fil-a to san francisco is 40 miles away and strongly mend they not try to come closer. the santa cruz sheriff looking for more potential victims after arresting a man suspected of having sex with a

13-year-old. deputies arrested the 20-year-old alexander pollack he befriended the girl at a shopping center offered her a ride home and had sex with her. her family confronted pollack at a convenience store last night where deputies arrested him. recently moved to the felton area analyst in his car he drives a red toyota with a tennessee plate and often visited the shopping center. anyone with information is asked to call the sheriff's office. we know the identity of the man who died in a san francisco apartment fire this week. the medical examiner's office says 78-year-old roosevelt watts was killed in the fire. that blaze broke out in a building on cleary court in the western addition neighborhood wednesday. two other residents of the complex suffered smoke inhalation but are expected to recover. the cause remains investigation. demand from a non-profit group that has raised hundreds of thousands in donations to

save a popular state park from the budget ax. this after similar group in sonoma county made the same demand yesterday. they want the stay to make a promise or hand all that money back. terry mcsweeney is live in san jose this is a fallout after a stunning discovery. >> reporter: yeah that was 54 million dollars sitting there in a california state park's bank account that not a lot of people knew about. in this morning's mercury news a blockbuster of a story this may be the tip of the iceberg it is reporting billions in state money found in hundreds of different accounts in addition to the state parks. take a look at a news conference in san jose about one hour ago. representatives from the co-park preservation fund saying 54 million dollars a lot, if the state spends 20 million of that on state parks, it will continue to the state with $300,000, per year in

private funding for the next two years, as it did this year, to keep santa clara county's co-state park open. if lawmakers don't do that, the deal is off. >> the cppf will dissolve the three year understanding we initiated in january of 2012. which we paid one year. and we will ask, we will demand the return of the $279,000 we presented them may 25th of 2012. >> reporter: the 20 million dollars they want spent on state parks entry and concession fees from park users. he says he doesn't feel the rangers and superintendents he negotiated with were being dishonest with him. he says everyone involved in the negotiations had been deceived by higher-ups. those who hid the 54 million dollars are the ones who should pay the price. director of the state parks

has resigned. back the news article about the 2.3 billion dollars worth of money that had again unaccounted for now showing up in various accounts in 500 different accounts. the state parks issue maybe a small part of a larger problem. terry mcsweeney, abc7 news. a warning, don't fall victim to a new scam. someone is calling san francisco residents and business owners claiming they are raising money for the fire department. at least two beam have been contacted so far. a merchant got the call asking for nearly $200 to pay for san francisco fire department yearbook. a resident got an e-mail saying he had been issued a $1,000 gift card for free on behalf of the fire department, but was going to have to send some money to claim it. both times the people called the fire department and were told the fire department does not solicit. if you are contacted you are advised to call police.

trucks vs. restaurants, today the trucks have won a legal skirmish in san francisco. earlier this year a group of nine restaurants sued the food truck group off the grid and challenged its permit after a set-up. at a hearing last night, off the grid and supporters successfully argued its permit is within the law. the food truck market has been on hiatus since june 1st. it set to return in a week. facebook continues to struggle, shares opened at a new all-time throw morning. facebook stock opened at $23.21 a day after the company released first quarterly earnings report since going public. shares picked up a bit today, still trading below yesterday's closing price. facebook results met expectations but investors lost confidence over slower revenue growth and higher expenses. president obama's latest

president obama signed a cooperation act this morning offering support against threats. the u.s. will give israel 70 million dollars for a security program aimed at missile strikes. >> the president: this legislation brings together all the outstanding cooperation we've seen at an unprecedented level between our two countries. >> republican presidential candidate mitt romney heads to israel tomorrow. today in london he was forced to walk to meet the irish prime minister, when heavy traffic from the olympics snarled his motorcade. romney stirred up controversy yesterday seemingly questioning whether london was prepared to handle olympics logistics. residents along much of the east coast are cleaning up after a powerful thunderstorm swept through yesterday. look at this video of lightning captured in the

midwest and new york city. two deaths are being blamed on falling debris caused by wind and rain. utility crews are working to restore electricity to at least 300,000 homes and businesses that lost power. weaker remnants of the storm are expected to head towards the southeast today. a couple in washington state spent the last week watching their front lawn disappear off a 200 foot cliff. you can see chunks from their property crumbling. the workshop where roy makes his living is close to sliding off, nothing he can do about it. it started about a week ago when a geyser appeared. experts believe either a natural spring changed its course or it is erosion from years of heavy rain. >> hard seeing people -- [ inaudible ] >> couple is waiting to find out if their property will be

a huge wet problem in the middle of the night in the castro neighborhood. suspected drunk driver crashed into this fire hydrant knocking it over and unleashed a geyser that spewed water several feet into the air for hours. officials had a tough time finding the valve to get the water shut off but did cap it a little after 5 a.m.. residents in the area never lost water completely, water pressure is fine now.

warning for drivers who may be in the city this sunday. expect lots of road closures for the san francisco marathon. the race will start and end near the ferry building. full course will take runners along the northern waterfront over the golden gate bridge through golden gate park before returning to the bay. the embarcadero will close saturday night into sunday at midnight near the starting line at the ferry building. street signs have already been set up along the course telling the public about closures. muni will reroute some bus lines around the course. >> a lot going on this weekend, no pressure, what kind of weather are you going to deliver mike? >> i'm looking at the route, they are going to start in fog, run into sunshine and run back to the fog. from the 50s to the 60s a lot going on. good morning lots to talk about first cloud cover still hanging around bringing flight arrival delays into sfo and departure delays out of
