temperatures in the 50s. some fog and especially drizzle along the coast. by noontime we will see a lot of sunshine for everybody. notice the wide range of temperatures. upper 50s along the coast and already getting into the low 80s inland. a lot of sunshine this afternoon with a widespread of temperatures. low 60s to upper 80s inland and clear this evening before the clouds move in once again. i have some details on the gilroy garlic festival and the giants game coming up shortly. terry. >> thanks a lot. developing news in los gatos. a fatal crash has kept the southbound lanes of highway 17 shut down until 2:00 this morning. an investigation is underway that will probably keep southbound 17 closed until six this morning. it's south of the highway 89 interchange. drivers have to exit at lark and take surface street to enter at state route 9. we will notice as soon as we know that the southbound stretch

reopens. this morning san jose police have a new piece of evidence in the double homicide. miss believe pedro shot and killed a couple in a domestic violence dispute. three children were left orphaned. the suspect is still at large and he's believed to be in southern california. ma dina's 2006 black maxima, resembling the car in this photo was towed and being held in evidence. >> it's a pretty good evidence that san jose's casino m8trix will be open for business. it is lit up like a riverboat even though the parking lot and the building is vacant, but that may change soon. it's just off highway 101 in san jose. john alston industries the final hurdle the casino must clear before the doors can open. >> it's quiet now, but the

owners of casino m8trix in san jose are hoping that sometime next week these 49 tables will be hopping once the city's division of gaming control gives final approval. >> we've submitted all the documentation we believe they require so as soon as we get some feedback from them early next week we are hoping we can literally pay for the permit, pick it up and later next week open the front doors. >> sack hose police chief chris moore signed off on the card room provided they meet certain conditions. it has to test the surveillance system, making sure there are off-site tv monitors at the division of gaming toll. also the city wants to make sure it gets information from tracking devices at each table showing player activity and how fees are collected and paid. they said the outstanding issues are relatively minor. >> i think they are all issues that will be resolved quickly and i think we can expect to see the matrix casino open k shortly. >> by law they will have to shut down their other casino in town,

the garden city card room, as soon as this one is opened. eventually they want to open gambling salons on the eighth floor of the building but that could take months. new casino is expected to create about 300 new jobs. it will be one ever two card rooms in san jose. >> they generate about $15 million a year in tax revenue and i think we can say we will probably see a 20% increase in that over the next year or two. >> but not everyone is thrilled about the new and bigger cass seen no. >> it doesn't sound good, some guys getting salary and spending it in the casino and they are getting addicted to these things. casino is not a good idea actually. >> the plan is to eventually build a hotel next to the kau nine and m8trix is still look to hire about 100 team. abc7 news. in just a few hours a

massive search will get underway in pacifica for a woman that hasn't been seen for days. the 76-year-old maria janssen is considered at risk based on mental conditions and the fact nobody has seen her since wednesday afternoon. police are calling for emergency response team volunteers to help them with that search. a multi-agency task force will set out this morning at 9:00 in trafficca. a woman who is morbidly obese said she was kicked out of the hospital and has nopes to go. here's nick smith with a story you will only see on abc7 news. >> gloria turned 53 on tuesday but it's another number that has put any celebration she may have had on hold. >> i weigh 810 pounds. >> because of her weight she has limited mobility and suffers from a host of medical issues. >> i came in because i had a bladder infection and i had my wounds infected and i had

cellulitis. >> she was admitted here but after one week she was discharged and no one to provide her with the care she needs. >> i can't be at home sitting on this bed rotting because i have known to turn me. i have bed source. if i don't get turned everyday, my source get worse. >> this video, provided by the family, shows how labor-intensive it is to move her. >> and just because i'm big and can't walk, it doesn't make me less of a person. >> why should this be washington's responsibility to take care of you? they are not in the weight management business. >> they have more ability, more than i could ever have to help me. >> washington hospital provided this statement to abc7 news. the patient was discharged after she no longer needed acute care. as was discussed with the patient's family. the hospital agreed to supply in-home support care for the

patient. what isn't clear is what gloria can do today. her family isn't medically trained or able to help and the clock is ticking. >> i just want somebody to help me. i want to live a longer life. >> the hospital said they will provide her with in-home support services for 14 days at their expense. what isn't clear is what gloria will do on day 15. in fremont, nick smith, abc7 news. this morning a twelve-year-old girl crushed by a tree in a san mateo park is recovering from surgery at stanford. his family reached out exclusively to abc7 news, they tell us he will lose his right leg. zachary row was camping at the park when a 60-foot tree fell on his tent early wednesday morning. a close family friend described what happened next. >> zachary was saying things like, you know, my legs feel like jelly, they are restless, kind of rolling back and forth. we thought maybe he was just

still half asleep. >> zachary suffered a crushed pelvis and doctors are worried about internal bleeding. zach was scheduled to start 7th grade in arizona in two weeks. all of that on hold as he recovers. a warning going out to the elderly in san francisco. crooks may offer you spiritual help while helping themselves to your money. take a look at some video from a public service announcement from the san francisco police department warning people about this crime. police say strangers approached their target, usually elderly chinese women, and prey on their superstitions saying they are cursed or haunted, offering to remove the curse. victims say the new twist is that the suspects are touching them the entire time. >> some of these victims that were encountered were telling us they feel they might have been drugged in some manner or put into some type of spell from this physical contact. there's nothing we've been able to confirm. >> the victims then hand over their money or valuables and the

criminals take off. there have been dozens of new victims in the past two weeks. more than $250,000 in cash, $90,000 in jewelry have been taken from victims in this recent crime spree. monday will be a most interesting day on wall street after the dow jones close yesterday above the 13,000 mark for the first time since may. but it wasn't a good day for facebook. it's stock dropped nearly 12%, closing at 2370. that equals a $1 billion loss for founder mark zuckerburg. at its initial stock offering in may the share of stock went for $38 a share. but don't worry about zuckerburg, still one of the richest people in the world. good morning america will have more coming up at 7:00. apple has been in talks with twitter about making a strategic investment. the new york times said the investment could be in the hundreds of millions of dollars and an investment of that size could put the value of twitter at more than $10 billion.

the most part, 54 in san francisco, 57 in san jose. so low clouds and fog. very typical summer like pattern, coastal drizzle, as well. today will be sunny. temperatures climbing to near normal. in fact, they will be bumping up a few more degrees and then this pattern stays with us all through next week. so if you like today, you will like all of next week i think. here's a look at the satellite radar image looping the last twelve hours or so. we have the area of high pressure. this is a dominant feature with air circulating clockwise. we have a little bit of the on shore flow but the high pressure gives us the sunny weather but the slight on shore flow brings us the fog and the overnight low clouds. that's what we are going to see the next few days. the forecast model shows the clouds, widespread cloud cover during the morning. you seat green that's a little bit of the drizzle that we might see along the coast. by lunchtime sunny for everybody except for the peninsula coast and this afternoon even more sunshine and then in the evening

we will start to see the clouds move in once again with some possible drizzle again near half moon bay. that's the areas of light green. look for temperatures to warm up very comfortably today. 68 in san francisco if you are heading to the giants game. and you will need sunscreen as well. look for 80 in san jose. some 70s around the bay with 73 in oakland and getting into the upper 80s in the interior area such as 88 in antioch, 88 in fairfield, even up to 90 degrees in clear lake and we will head down to the monterey bay area. so look for low to mid-80s inland. and in gilroy it's going to be a hot one. if you want it cooler, head to the coast. 74 at santa cruz, even 64 in monterey with cloud cover. here's what you can expect today besides the heavy traffic in gilroy, heading to gilroy. by 10:00 when the festival starts it's already going to be 68 degrees. warming up to 74 by noon. pretty hot at 85 for the

one-third of the state's schools are more than 50 years old. the superintendent of schools is outlining a plan to create 21st century learning environments. here's abc7 education reporter lyanne melendez with what they might look like. >> department of education says 10% of california's schools are over 70 years old, one in ten, and 30% are over 50. >> there's a lot of need here for the retrofit, the energy efficiency, the greening and just keeping the investment going. >> that's superintendent of california's schools who said it's time to invest in brick and motor. even in these continuing hard times. the key is to find creative ways to fund products. for that he asked the u.c. berkeley center for cities and schools to come up with recommendations. the center looked at how other states are using multiple sources of funding.

>> bond funds, state tax, lottery funds or some sort of special business tax. >> oakland unified has also used grants from private institutions such as kaiser permanente. they have helped school-based health centers like the one at oakland high where students get medical and mental services. and today a new one is being built. >> when this project is done we will have in oakland 15 school based health chin nicks our high schools and middle schools. i think that's more than any other district in the state. >> part of the money to build it came from a 2006 voter-approved bond. now the district will ask voters again in november for another $475 million. >> i think this community understands that we are investing in quality schools in every neighborhood. the community is rallying to support the bond and it is a really hard time in california but i think we are demonstrating leadership for that positive work. >> it's worth mentioning that

and some even patchy fog in some areas. let's check out live doppler 7hd and show you that it's pretty quiet right now just as it does a sweep around the bay. but you can see it is picking up some of the low clouds cover around the bay and in parts of san jose you see the little bit of gray there. that's what it's showing. also we will check out temperatures right now mainly in the 50s. look for 54 in san rafael and san francisco. oakland at 55. san jose at 57 and livermore at 57, as well. so we have a very typical summertime pat northwestern place. low clouds and fog with coastal drizzle. terry had to use the wipers this morning and so did i coming into work. temperatures will climb to near normal today. we will warm up a few more degrees in the next few days and then we have this steady pattern all through next week. so kind of just a repeat of today, all through the work week, as well.

so here's why. we have this area of high pressure. this is the pacific satellite image over the last twelve hours and this is going to continue to bring us a slight on shore flow. with the high pressure we will also see sunny days. we have a quiet and stable summertime pattern ahead and that's in store for a while. here's a look at the forecast models. the low cloud cover this morning, the areas of green show the drizzle so that's where we are picking up some moisture. by lunchtime mainly sunny except for along the coast and half moon bay. by this afternoon a lot of sunshine as we reach highs around 3:00, 4:00. then this evening the clouds will start to move in again but mainly clear if you have dinnertime plans out and look for drizzle again along the coast on the peninsula this evening. highs for today very mild. 80 in san jose. a lot of sunshine for you, 84, one of the warmer spots in los gatos. look for a high of 76 in palo alto. cooler as you head up north. 71 milbrae and notice along the coast still in the 60s, the

low 60s because of the cloud cover. 68 downtown san francisco. look for 80s, mid-80s sonoma, napa, and 70 degrees for the near east bay with 71 in berkeley. and just getting up to 90 degrees in brentwood. a lot of upper 80s in interior valleys, very warm conditions as well. look for 8 tos in interior valleys, including 85 at the gilroy garlic festival. if you want to have the free ice cream it will be a nice treat. 64 monterey. if you are heading to the giants game, it will be pretty sunny so you will need sunscreen. temperatures right around 66 to 68 degrees right when the game ends around 4:00. and see how temperatures climb up a few degrees? but then they hold steady all week long with a lot of sunshine. we will just see the morning cog and low clouds that kind of typical pattern. >> you pointed out something very important, the giants game at 1:00 today. even though the tickets say six, it's 1:00 this afternoon.

if you have tickets, it's 1:00. >> 1:05 to be exact. >> thanks very much. no one should have to pay for a service they aren't getting but a san jose family has been doing that for years. here's michael finney with the story. >> linda enjoys time in her san jose garden. tucked away in the corner of her small yard are two garbage cans. the flash for garbage, the blue one for recyclables. missing a yellow can for yard waste. >> we've never had a yellow can or a green waste can. no one in this complex has ever had a yellow can. >> any yard waste generate sudden left on the curb and picked up by the homeowner's association. yet she recently discovered her family has been paying for a yellow can it never had. linda's late mother suffered from the early stages of alzheimer's. she suspects the billing dates back to that period, more than five years ago when mom was

paying the bills. >> it's the point of the thing, being billed for something you never had. >> she called the garbage company but when the next bill arrived, the charge was still on there. she crossed it out and requested the company credit the charge back to her. >> so two months later i get a bill for the yellow waste can plus a penalty charge for the bill for the amount i didn't pay. >> so once again she phoned the garbage company. >> she said, okay, well we will send somebody over there to look at the can and i'm going what? it's a nonexistent can. >> that's when she decided to call 7 on your side. we took her concerns to the city of san jose and the city immediately called linda. >> oh, yeah. it was a relief. it was a relief. >> city regulations call for san jose to only credit her back to the date the mistake was discovered. but the city took it a step
