and good monday morning, everyone. the suspected colorado gunman is back in court this morning. >> james holmes is expected to hear the long list of charges against him with all eyes, again, on his appearance, though shocking in the first court appearance last week. >> brandi hitt joins us from centennial, colorado, this morning with all the details. good morning, brandi. >> reporter: good morning. in a few hours, we'll hear the charges filed against james holmes. it comes as the victims of this tragedy deal with even more heartbreak. >> monday july 30th. >> reporter: the prosecution is expected to lay down the hammer on 24-year-old james holmes ten days after colorado's movie theater massacre. at his ararnment -- arraignment, holmes could face hundreds of

charges, including 12 counts of first degree murder, 58 counts of attempted murder and charges for the explosives at his apartment. >> i don't care what his motive is. he knew what he was doing. i said, i want to see him. i want to see justice. >> reporter: ashley moser's stepmother says she'll be in the courtroom. not only did ashley lose her 6-year-old daughter in the shooting spree, she was shot several times and suffered a miscarriage. >> it was because of stress. it was because of trauma. it was -- ashley's been through a lot. >> reporter: so have the victims' families. many buried their loved ones over the weekend. at the center of this investigation is a notebook that holmes sent to his psychiatrist, dr. lynne fenton. >> if a psychologist or psychiatrist feels that a patient they're treating may pose a threat, in most states they're obligated to do something. >> reporter: in this case,

holmes' attorneys will say the seizure of that notebook was a breach of confidentiality. between a doctor and patient. they'll argue to get that notebook back in court today and also that it cannot be used as evidence. rob and paula? >> you mentioned ashley moser's miscarriage. certainly heartbreaking news compounding the tragedy there. does that mean 13 charges will be filed now for murder? >> reporter: no, rob, not in colorado. we learned from a former prosecutor that in this state, homicide charges are not applied to those not born alive. in this case, it will still be 12 murder victims, not 13. but a tragedy for the family. because, as you know, we have been following this case. at first, we thought she would be able to carry the baby. we learned over the weekend that the stress was just too much. >> a devastating turn. abc's brandi hitt live from colorado this morning, thank you for the report. a developing story in the heartland. a series of bomb threats against

walmart stores in two states. three stores in kansas were temporarily closed and inspected by police. after threats were called in yesterday. no bombs were found. no one was ever in any danger. those threats follow similar once made to store in at least eight communities in missouri on friday. overseas, syrians are fleeing their country in droves as a fierce battle continues to rage in aleppo. rebels celebrating after seizing a government tank. the opposition has reportedly taken over large sections of the city. but syrian troops are pounding rebel positions to regain control. mitt romney says the u.s. has a moral imperative to keep iran from getting nuclear weapons. speaking over the weekend, romney said the israelis have a

right to defend themselves from the iranian threat. he wraps up his three-nation tour today with a wit to poland. as we wait for romney's choice for vice president, we're hearing candid comments from former vp dick cheney. he pulled no punches. frankly, the vice presidential vetting process wasn't handled well by john mccain's camp four years ago. >> i like governor palin. i've met her, i know her. she's an attractive candidate. but based on her background -- she had only been a governor for two years -- i don't think she passed that test. >> being ready? >> being ready to take over. i think that was a mistake. >> no comment from palin's camp. romney will announce his choice for a vice president in the coming weeks. we'll hear more from cheney on "good morning america." and there's confirmation this morning about some new treatment being received by congressman jesse jackson jr.

he's at the mayo clinic the state of many opinion. he's been treated for depression and gastrointestinal issues. he's been on medical leave since early june and his condition has been unclear. protesters in anaheim are angry over the police shootings of two unarmed men. the shootings ignited four days of violent protests, culminated tuesday night with the hundreds of protesters surging through downtown. a giant dust storm engulfed phoenix once again. the thick cloud of dirt and debr debris, known as a haboob, swept in. scientists say we can expect larger and more frequent storms like this and they're blaming it on climate change. that seems to be responsible for a lot of things right now. >> it's been a wild summer

welcome back, everybody. it's a homecoming of sorts for the stock market today. for the first time in almost three months, the dow jones industrial average opens this morning above 13,000. it gained 188 points on friday because of encouraging news from europe and a government report showing the economy did not slow as much as had been feared. federal investigators are looking into a potential problem with boeing's new 787 dreamliner jet. debris from an engine started a grass fire over the weekend. five of the planes have been grounded. boeing says it still has

confidence in its new jet. and watch for airfares to come down soon, at least for a little while. travel website farecompare sees a 20% drop coming. the demand this summer seems to be down a little. airlines are likely to hold off on more fare hike attempts. >> when's the last story we did about fares going down? that's refreshing. >> it will last for about 12 minutes. the take for "the dark knight" keeps rising at the box office. it was the number one film for a second weekend in a row. there was a 60% drop from the opening weekend. "the dark knight rises" took in $64 million. not bad. ice age, continental drift was the second place, just over 13 million bucks there. and the watch, getting slammed by the critics, still brought in about $13 million. it may have been a bitter weekend for starbucks' ceo howard schultz.

he lost $151 million last friday when the coffee chain's stock fell almost five bucks a share. the stock fell because of what schultz calls economic struggles around the world. he owns more than 30 million shares. >> coffee was on ice? bad joke this monday morning. and there's anger here in new york about a program that would lock up baby formula at hospitals all in the name of promoting breast-feeding for newborns. mayor michael bloomberg is backing the voluntary program that begins this september. baby formula will be available. mothers who receive it will get a lesson about the benefit of breast-feeding before they can tap the formula. >> good to know. the mayor getting involved in all kinds of issues over the last couple of months. sodas and breast-feeding. he's an active mayor. >> yes, he is. and the action from the london games. including a supreme disappointment at the pool for team usa.

delays possible in phoenix, las vegas, denver, and miami. i'm just going to apologize for both of us. >> it's a monday, bear with us. day three of the summer olympics in london is already under way. medals will be handed out in 12 more events today. >> it was something of a disappointing silver medal yesterday in the men's 4 by 100 freestyle relay. lochte was this the lead but was passed by a frenchman. lochte adds the silver to the gold he won on saturday. >> dana vollmer is bringing home a gold medal after her victory in the women's 100-meter butterfly. she set a new world record in the process. she summed it up by saying she was on top of the world, understandably so. well done. >> and the other high-profile competition going on is gymnastics. the u.s. men go for the gold in

the team event later today. >> the u.s. women's team had the highest scores of all in qualifying. but there was something of a surprise, as well. a heavy favorite, jordyn wieber, failed to qualify in the individual all-around competition. she finished behind two of her teammat teammates. she was eliminated, as you can tell by that moment right there. >> some commentators think she was underscored and deserved to move on. no such problem for the u.s. men's basketball team on the court. after a sluggish start, they pulled away from france to notch their first win of the tournament, the final score, 98-71. the first lady there to cheer them on. the team is -- their next game is tomorrow against tunisia. >> let's check the all-important medal count at this point. china leads with 12 over all, half of them gold. the u.s. in second, 11 medals in all. italy in third with seven medals. >> kazakhstan has two.

a piece of history on sunday. the brickyard 400. where else? indianapolis. we pick things up, 31 laps to go. tight racing off a restart. kyle busch struggled of late. gets underneath johnson. johnson holding him off. we're on board. a little bit of wiggle. no issues. 29 laps to go. jimmie johnson, a run on greg biffle. he passes him. johnson would lead 99 overall laps. back here in the 20th position. joey logano turns side waist, gets into bobby labonte and takes matt kenseth to the wall. johnson, blowing the competition away on the restart. he's won three times at the brickyard. twice this season. looking for his tenth career three-win season. he kisses the bricks for the fourth time in his career. baseball, by the bay. we got a pennant race. clayton kershaw. he gets theriot swinging. then melky cabrera as well. dodgers, up 2-0.

it's time to check "the pulse," the pop culture on this monday morning. starting with a family feud averted. >> the stars of the hit show "modern family" have settled their contract dispute just in time to start shooting the show's fourth season today. >> it includes ty burrell, sofia vergara, julie bowen, eric stonestreet, and jesse tyler ferguson. they'll each make a reported 180 grand an episode, triple what they were making. a pay increase. >> we're in the wrong business. a little inspiration from actress jada pinkett smith -- showing the world she's like a

fine wine. the 41-year-old wife of will smith tweeted this picture of herself flaunting her bikini body for all to see. >> take a gander, rob. she added this message, to my 40 and over crew, don't believe the hype. we do get better with age. >> yes, indeed. she stays in shape by exercising five days a week. she does gymnastics, yoga, boxing, and martial arts. and they're still talking about this startling image from the olympics. here in the red shirt, right alongside the indian athletes in yellow and black, a parade crasher. >> she was a cast member helping with the event. she was not supposed to walk out into the stadium. she got so caught up with the excitement, she couldn't help it. indian officials are upset that the focus on this one woman instead of the indian athletes.
