thank you sue. good morning i'm carolyn tyler sitting in for kristen sze. i'm eric thomas. we begin with the latest on the shooting tragedy in colorado. in two hours prosecutors are expected to formally file charges against james holmes the suspect. attorneys are pecked to argue about a package he allegedly sent to his psychiatrist. brandy has more from the court mouse in centennial, colorado. >> reporter: the prosecution is expected to lay down the hammer on 24-years-old james holmes, 10 days after the movie theater massacre. holmes could face hundreds of charges, including 12 counts of first degree murder, 58 counts after tempted murder, first degree assault and reckless endangerment for the explosives in his apartment. >> i don't care what your motive is, he knew what he was doing. that's it. i want to see justice.

>> reporter: ashley's stepmother says she will be in the courtroom. ashley not only lost her 6-year-old daughter veronica, she too was shot several times and has suffered a miscarriage. >> it was because of stress. because of trauma. ashley has been through a >> reporter: so have the victims' families. many buried their loved ones over the weekend. now at the center of this investigation, a notebook holmes sent to his psychiatrist, dr. lynn fenton police intercepted that book which reportedly includes plans for a massacre. >> if a psychologist or psychiatrist feels someone they are treating, may pose a threat in most states they are obligated to do something. >> reporter: holmes' attorneys claim the seizure of that notebook is a breach of confidentiality between the doctor and patient and they will argue to get that notebook back, in court. abc news, colorado.

the time now is 5:30. the newest ride at the six flag as musement park in vallejo is out of service today the superman rollercoaster became super statistic for about two hours yesterday, leaving riders stranded on top. amy hollyfield joins us live from the park with what officials are saying went wrong. >> reporter: they don't know for sure they say as best as they can tell there was no mechanical issues, they are still trying to figure it out it just suddenly stopped with 12 people onboard they were stuck 150 feet up in the air. fortunately they were upright they were not dangling upside down. firefighters used a crane to get to them, check on them, give them water taking them down in the bucket was going to be the last resort the hope is the coaster would bring them down. visitors had to sit for two hours while the crews had to

figure out how to do that visitors said they did what they could to pass the time i was trying to keep calm at one point i brought out my rosary and said a prayer. >> they were telling us to shake back and forth it felt like it wasn't moving. >> reporter: mechanics shook the car it did shake it loose and got going but it went backwards. authorities said that was fine, i was a safe way for them to come down. everyone was checked out once on the ground and determined they were fine. they were given a season pass and fast pass so they can jump to the front of the line whenever they want to, from here on out. officials say it will usually stop because it has detected something is wrong. they will spend today trying to figure out what that is. this ride is now closed until further notice. amy hollyfield, abc7 news.

when everything goes right, a ride aboard superman ultimate flight lasts a minute and reaches speeds of up to 62 miles per hour. terry mcsweeney, something of a daredevil got a sneak peek of the ride last month. it features plenty of twists and turns this is not the first time riders found themselves stranded on a rollercoaster at discovery kingdom. 28 escaped using a cat walk when the boomerang got stuck in august of 2010. it also stranded riders in 1999. in 2009, air pressure problem caused the roar to shutdown, no one was hurt in any of those incidents. new development in the amber alert for a teenaged girl from monterey county. she believed to have been kidnapped from her home where the bodies of two men were found over the weekend. an amber alert has been issued

animal control. abc7 news crews were on the scene this weekend on california street the boy was attacked at the home of his babysitter. doctors had to reattach the youngster's eyelid yesterday and determined he was well enough to go home. right now pg&e crews working to get final 106 customers in daly city back online after 3600 lost power last night. the outage affected customers in south san francisco and colma. crews found downed wires near the intersection of clay avenue in daly city after 8:00 last night crews say a metallic balloon hitting power lines caused that outage. the power at the south san francisco bart was intentionally shun down as a precaution. three people got -- people got stuck in an elevator and had to be rescued. power at that bart station back on this morning. more traffic delays around
