from the south bay where the san francisco 49ers are very excited, they are getting ready to set another big mile style as their new stadium is beginning to take shape. you may remember a few months ago in april the 49ers launched that big grand opening, groundbreaking party of what will be a 1.2 billion dollar state-of-the-art, nfl stadium nothing else like it in the country. not long after that the cement truck started to roll in and they set to work to build the foundation that. is finished. now today the next phase happens with the very first load of steel arriving here in a few hours. that steel will be used to create the framework structure for the new stadium. we understand the santa clara mayor will be here with top stadium project executives. for 49er fans be sure to mark your cal -- your calendar, 49ers tell us the stadium will

be ready by 2014 p in just a couple of years. sue thompson, abc7 news. the newest rollercoaster at vallejo's discovery kingdom is shutdown indefinitely after a dozen people got stuck on the ride yesterday. one of the cars stopped at the top of the ride, 15 stories from the ground. crews and engineers used a large crane to get to the righters and pass out water and sunscreen. it -- riders and pass out water and sunscreen. with the plan of releasing the train our first plan of action, the safest. second would be to rescue them individually, if we had to. we were able to fortunately, go ahead and release the train. >> everyone on the ride was checked by paramedics and given season passes to the park. officials say the problem doesn't appear to be mechanical, the cause is under investigation and the superman

coaster remains closed. two titans set to go to court in san jose in a pat dispute. apple is suing samsung for allegedly copying its iphone and ipad design. a jury is expected to be selected today. apple is demanding 2.5 billion dollars in damages. apple says it intends to push for more injunctions to block u.s. sale of samsung's phones and tablets, those devices are powered by google's android operating system. authorities are trying to determine their next step in the search for a missing woman who suffers from dementia. 76-year-old maria jansen vanished from her home in pacifica sometime last wednesday. especially trained dogs joined search volunteers this weekend looking for jansen. no indication they found any

we want to do our job. >> deputies state man who was wounded refused to answer questions from investigators. investigators want to know if underaged drinking might have played a role in a fight on a party bus that ended in a woman's death when two people fell from the moving bus on highway 17 in los gatos. a group of about a dozen people were on their way home to santa cruz, after a concert at shoreline ampitheater, two women got into a fight. investigators want to know how the bus' emergency door opened. 25-year-old natasha nolan died when the bus ran over. the other woman a 20-year-old went to the hospital, expected to be okay. the bus driver is not being charged. school superintendent has stepped down over allegations that he harassed a teacher because she was pregnant. tom cooper has resigned from the district in santa barbara county, teachers say he talked about putting birth control in

thank you sue. good morning i'm carolyn tyler sitting in for kristen sze. i'm eric thomas. we begin with the latest on the shooting tragedy in colorado. in two hours prosecutors are expected to formally file charges against james holmes the suspect. attorneys are pecked to argue about a package he allegedly sent to his psychiatrist. brandy has more from the court mouse in centennial, colorado. >> reporter: the prosecution is expected to lay down the hammer on 24-years-old james holmes, 10 days after the movie theater massacre. holmes could face hundreds of charges, including 12 counts of first degree murder, 58 counts after tempted murder, first degree assault and reckless endangerment for the explosives in his apartment. >> i don't care what your motive is, he knew what he was doing. that's it. i want to see justice.

>> reporter: ashley's stepmother says she will be in the courtroom. ashley not only lost her 6-year-old daughter veronica, she too was shot several times and has suffered a miscarriage. >> it was because of stress. because of trauma. ashley has been through a >> reporter: so have the victims' families. many buried their loved ones over the weekend. now at the center of this investigation, a notebook holmes sent to his psychiatrist, dr. lynn fenton police intercepted that book which reportedly includes plans for a massacre. >> if a psychologist or psychiatrist feels someone they are treating, may pose a threat in most states they are obligated to do something. >> reporter: holmes' attorneys claim the seizure of that notebook is a breach of confidentiality between the doctor and patient and they will argue to get that notebook back, in court. abc news, colorado.

the time now is 5:30. the newest ride at the six flag as musement park in vallejo is out of service today the superman rollercoaster became super statistic for about two hours yesterday, leaving riders stranded on top. amy hollyfield joins us live from the park with what officials are saying went wrong. >> reporter: they don't know for sure they say as best as they can tell there was no mechanical issues, they are still trying to figure it out it just suddenly stopped with 12 people onboard they were stuck 150 feet up in the air. fortunately they were upright they were not dangling upside down. firefighters used a crane to get to them, check on them, give them water taking them down in the bucket was going to be the last resort the hope is the coaster would bring them down. visitors had to sit for two hours while the crews had to

figure out how to do that visitors said they did what they could to pass the time i was trying to keep calm at one point i brought out my rosary and said a prayer. >> they were telling us to shake back and forth it felt like it wasn't moving. >> reporter: mechanics shook the car it did shake it loose and got going but it went backwards. authorities said that was fine, i was a safe way for them to come down. everyone was checked out once on the ground and determined they were fine. they were given a season pass and fast pass so they can jump to the front of the line whenever they want to, from here on out. officials say it will usually stop because it has detected something is wrong. they will spend today trying to figure out what that is. this ride is now closed until further notice. amy hollyfield, abc7 news.

when everything goes right, a ride aboard superman ultimate flight lasts a minute and reaches speeds of up to 62 miles per hour. terry mcsweeney, something of a daredevil got a sneak peek of the ride last month. it features plenty of twists and turns this is not the first time riders found themselves stranded on a rollercoaster at discovery kingdom. 28 escaped using a cat walk when the boomerang got stuck in august of 2010. it also stranded riders in 1999. in 2009, air pressure problem caused the roar to shutdown, no one was hurt in any of those incidents. new development in the amber alert for a teenaged girl from monterey county. she believed to have been kidnapped from her home where the bodies of two men were found over the weekend. an amber alert has been issued

for the 16-year-old who is believed to be with her boyfriend and his father, she is 5'5 weighs, 130 pounds. police say say they may be heading towards mexico. -- another car they've been looking for was found abandoned. san francisco police are trying to determine the identity of a man whose body was found in the backyard of's house in the diamond heights neighborhood. a resident -- a resident discovered the victim yesterday morning outside a home off diamond heights boulevard. police say the man had been shot. one neighbor thought he heard gunshots 11:00 saturday night. the medical examiner will check the man's fingerprints in hopes of identifying him. this morning a pit bull that mauled a two year boiled remains in the custody of

animal control. abc7 news crews were on the scene this weekend on california street the boy was attacked at the home of his babysitter. doctors had to reattach the youngster's eyelid yesterday and determined he was well enough to go home. right now pg&e crews working to get final 106 customers in daly city back online after 3600 lost power last night. the outage affected customers in south san francisco and colma. crews found downed wires near the intersection of clay avenue in daly city after 8:00 last night crews say a metallic balloon hitting power lines caused that outage. the power at the south san francisco bart was intentionally shun down as a precaution. three people got -- people got stuck in an elevator and had to be rescued. power at that bart station back on this morning. more traffic delays around
