a possible new owner and that new owner to some loyal pete's customers it couldn't be worse than to hear starbucks is interested in buying petes that is the hot rumor. i'll tell you how the rumor got started. the stock was up 3% last week that was after a company offered to buy the company. that has analysts speculating, goes up 3% why? starbucks may be prepared to offer $80 a share for piece. that would be $7 per share higher than what is now on the take. analysts say buying petes would make sense it would give starbucks entry into the gourmet coffee market pete's sells for a dollar more per 12 ounce bag than does staubach, petes has 190 cafes in the u.s. selling in whole foods and wal-mart. there are many at petes who don't like it.

>> no, i think they would discontinue and not have the same flavor i think they are just looking to make their franchise bigger and not keep the pete's coffee. i don't think so. >> reporter: if starbucks caught pete's what would you this think? >> we'll find out. i gotta get to the office and find out what is going on, you told me there's a deal happening. >> reporter: a number of people here on so-called wall street west at montgomery street hearing it from us that starbucks might be interested, thinking about it, some didn't want to talk on camera but headed to the office to see how this might translate into a deal for them. right now it is just speculation. you talk to the people at starbucks and executives at pete's and they have no comment sarbucks saying they don't comment on rumors. that only makes the rumor continue. there are some who are saying it makes sense.

and killing morgan hill teenager sierra lamar is pecked in court this morning to enter a plea. amy hollyfield is live in san jose with the long waited milestone in the case. >> reporter: -- he was arrested two months ago and he's just now going to be entering a plea. there's been a delay because antolin garcia-torres' attorney had to quit the case because representing the defendant's father who is in jail and charged with molesting his daughter. there's a conflict of interest there that has delayed things garcia-torres is accused of murdering 15-year-old sierra lamar. she disappeared march 16th. police say her dna was found inside go. ' car. and his dna -- inside garcia-torres' car and his dna on her clothing which they found side of the road. they haven't found her body. police and volunteers have conducted searches. those are on hold for now. if any new information

surfaces officials and volunteers say they will be ready to go again. 21-year-old garcia-torres is eligible for the death penalty if convicted. the the d.a. has not decided whether he will ask for death. today we are expecting to hear a plea from him, two months after his arrest. amy hollyfield, abc7 news. a 17-year-old boy faces attempted murder charges after oakley police say an argument during an online game lead to gunfire and a stabbing. the victim's mother says it started when the suspect accused her son of interfering in a deal to buy marijuana. the argument began yesterday afternoon while the two were playing video games online. police say the teen grabbed a rifle and knife went to his friend's home to confront him. >> he had the gun aimed at me and then shot at my son i went downstairs to call the police he came downstairs put his gun down and ran back up the stairs, i thought they were

fistfighting and he was stabbing the hell out of my son. >> she says her son was stabbed 16 times he's expected to recover. police caught with the suspect at his home and arrested him after a brief chase. public utilities commission tells abc7 news the party bus operator involved in a fatal accident has been fined for past violations. 20 -- 25-year-old natasha noland died. in 2010 the company was fined for operating with a suspended permit and failing to perform preemployment drug testing. noland got into a fight with another woman when the door to the bus opened and she fell from the bus. the faa says a pilot chose to slam on the brakes during takeoff attempt after receiving a warning from an

indicator light, nobody was hurt. passengers were put on a different plane which landed at sfo hours later. officials tell abc7 news they are still investigating the specific issue but ultimately the pilot determined the situation required a maintenance inspection and chose to return to the gate. in san jose opening statements expected this morning in a trial of apple's claims that samsung is infringing on its patents. a jury was seated yesterday. apple sued samsung last year alleging the company's smartphones and computer tablets are illegal knock-offs. apple is demanding 2 1/2 billion dollars in damages. samsung says some of the technology at issue has been industry standard for years. today is the financial final day on the job for former interim yahoo's ceo ross levin he announced yesterday he's leaving days afteria -- yahoo hired former
