leann melendez, abc7 news. here's something that may help for those with an iphone, ipad or other apple products one police department is reminding users to download the find my iphone app to help you locate your item on a map it can help police track it down. we have a link to the app on abc7news.com look under see it on tv it can also remotely lock your device and protect your information. oakland police department is at risk tonight of being taken over by the federal government. new report says the department appears stagnant in its efforts to implement reforms ordered by a judge 10 years ago. it cites recent problems, including officer involved shootings and handling of occupy protests as well as distubbing ing, racist insultsf! posted on a -- police bulletin board. despite that the mayor disagrees with a court appointed auditor's report claiming progress has been made.

>> when i became a councilmember there were 55 points, when i became mayor there were 22. now there's only nine. of those nine we are confident that we'll have most of them under control by the end of the year. >> a federal judge ordered the reforms in 2003 as par of a misconduct settlement after -- as part of the misconduct settlement after the arrest and prosecution of four oakland police officer known as riders in a police brutality case. attorneys for plaintiffs in that case plan to file in october to put the department under federal control. mayor quan and police union vow to fight that man accused of killing 15-year-old sierra lamar will not edge a plea until next machine. the courtroom was packed with people on both sides of the case. karina rusk explains what happened in court today. >> reporter: antolin garcia-torres' family was in court, but not him.

defense attorneys averaged it so the man accused of killing 15-year-old sierra lamar did not have to appear before the judge or enter a ply. supporters of the lamar family are frustrated. >> i wish he would just tell us where she is. have some heart at least. out of all of this give the family some closure. >> reporter: sierra lamar disappeared march 16th, walking to the school bus stop. despite four months of intense searching the cheerleader's body has never been found. legal analysts say it is not unusual for defense attorneys in complex cases to take their time. >> there's a mountain of evidence for the defendant to go over not just about their client but this entire investigation and they need time to review that that's why you see that plea delayed once again. >> reporter: deputies arrested garcia-torres in may after finding dna evidence in his car and on sire sear's clothing -- on sierra lamar clothing found days after her

disappearance. defense attorneys have stopped talking about the case. are you still strongly defending his innocence? >> of course. >> reporter: sierra's parents are not ready to face garcia-torres in court and say they are especially grateful to the dedicated community volunteers who continue their weekly searches for sierra. >> we haven't given up we are out there wednesdays and saturdays and we are continuing the search effort because we want to bring peace to the family >> reporter: the judge set a new date for garcia fernandez to enter a plea if there is -- for garcia-torres to enter a plea if there is not another delay that will happen -- a santa cruz couple has two new computers they used somebody else's credit cards to buy them. this man and woman bought two new computers from best buy in santa cruz in the past few weeks. they can be seen on video entering the store july 12th. investigators hope the public can identify them.

they opened several unauthorized accounts in another person's name, bought numerous items using those cards. the victim alerted police. online game company zynga has been hit with a class action lawsuit alleging insider trading. the suit claims zynga new the -- knew the company was struggling -- last week the company that makes the game farmville reported second quarter earnings of four to nine cents a share. zynga shares have dropped more than 40% since last week's earnings announcement. facebook stock hit another all-time low today. shares closed down $1.44 to finish at $21.71, 42 below initial price.

attorneys for apple and samsung began laying out their cases today in a high stakes lawsuit. a jury in federal court heard opening statements today. apple claims samsung copied design and user experience of iphone and ipad. while they are major rivals, apple relies on samsung for key components. analysts say this is a complicated relationship. >> silicon valley is a very interesting place as is the whole technology industry. two companies can be partnered on one side and be battling on the other in the end everyone acts in their own financial interests. >> samsung's attorneys counter apple's claim saying the company employs thousands of designers and spend billions on research and development to create new products. measure before the san francisco board of supervisors trying to drum up support for city colleges in san francisco the school is in

serious danger of losing accreditation. losing accreditation means it loses state funding that would force it to close next year. the resolution urges local and state officials to look for new revenue sources for the school. it supports november parcel tax for city college. >> the local parcel tax and the state revenue measure don't pass it will mean more cuts and larger class sizes almost a ruining of the education system in the community colleges. >> city college san francisco has to present a report in october showing request it should stay in business and another by march outlining how would it close its campuses. after two years of contentious negotiations, california state university has reached a tentative four year contract with faculty. csu faculty had been workg without a contract for two years and haven't seen a raise in five. the new deal which must still be ratified by union members averts a planned strike this

fall. two sides say they can focus on pushing for more revenue for the 23 campus system has suffered 750 million dollars in state funding cuts over the past four years. san mateo's 133 city employees have agreed to give-backs. san mateo faces 4.3 million dollar deficit the pact reached last night saves 2.8 million. employees will pay for more -- more for retirement benefits. employees have agreed to give up pay hikes next year. they will end up with a 4% raise over the course of this new four year contract. >> the state republican party must file finance report by midnight tonight they have big time money problems the party could be in the red by 750,000. that is a big change from 2009 according to the former chief operating officer they a $250

after he used stolen credit cards at a costco. bay area legislator took on-the-job of a domestic worker today to get support for a bill that offers workplace protections. assemblywoman went to the north oakland home to take her service dog out for a walk. work like this the legislator wants to protect. the domestic workers bill of rights would give meal breaks over time pay and paid vacation time and worker's comp. >> we all get sick. these workers are taking care of our most vulnerable, elderly, sick, disabled. if they get sick they have to go to work. >> san francisco already has a similar law granting protections for domestic workers. the bill passed the assembly needs approval in the state senate. 49ers' quarterback smith reported for jury duty in san jose today even though summer training is in session.

contra costa county social services and beyond learning from what another what is needed to better serve people who need help. >> there's always need for more services in primary safety net services. the recession only made the situation worse. >> reporter: the recession meant government funding at all levels dried up at the same time more people needed help with everything from food to health carry in contra costa county from july 2010 to june 2011, more than 6,000 people used homeless services, nearly 3,000 for the first time. one agency said in 2010, 45% of its clients were worried about a lack of food in 2011 that number rose to 89%. >> no matter what we do to help people in need if they stay in need we haven't solved the problem. >> reporter: the director says the food bank is doing well at keeping up with the growing need. he's here to help make sure other needs are met as well. >> we are doing what we do well but it is not enough we
