and officers took him there. >> police never searched his car, even though they had probable cause. his car was not towed at that time. we didn't do a toe inventory search of the vehicle. >> i believe that if the officers had taken this as a criminal case from the beginning they wouldn't have been wrong to do so and that a search of the vehicle would have been lawful. >> police eventually did on july 22nd, after he was released from general hospital and began harassing neighbors near golden gate park. this neighbor said john's car was parked near his house for weeks. >> so it had the homeless situation here that was the massive homeless thing going on for about four weeks >> the district attorney's complaint also state's that john imported one of the guns into california and planned to sell it. police also revealed that names of national politicians were found inside the car. the fbi confirmed it is assisting the police in the investigation. chief sir stands behind the decision made by his officer. >> now we have all the weapons

and nobody was harmed. >> and neighbors told me another man hung out with johns and they were concerned that he was still out there. but this afternoon san francisco police told me that they have arrested that second man on unrelated charges and that's all they would say. i'm live in san francisco, lyanne melendez, abc7 news. >> thank you. houses showed out across the nation today to show their support for chick-fil-a restaurants. the only chick-fil-a in fairfield, the lines were up to 2 hours long. it stretched across the parking lot. mark matthews is live with more on the support that the chain's ceo is getting for publicly opposing same-sex marriage. >> they are calling it chick-fil-a appreciation day. but the people that stood out here in the parking lot for a couple of hours, i think it had more to do with religion and politics than lunch. >> thank you, jesus.

is staying open until 10:00 tonight. word has it they are running short of supplies. some people are getting free coupons to come back another day. reporting from fairfield, mark matthews, abc7 news. >> that was in fairfield. but in san jose a different story. supporters of same-sex marriage stood outside a restaurant that's set to open there later this month. about a dozen took place in this counter protest at headquarters drive. and on friday a a larger protest is expected as same-sex couples plan to converge on chick-fil-a restaurants across the united states for national same sex kiss day. in case you were wondering the rankings of total fast-food stores in the u.s. show chick-fil-a comes in at number ten. mcdonald's is the leader followed by subway, burger king rounds out the middle coming in at number five. out of the fast-food chain chick-fil-a has the highest per store sales. >> we want to return to the

breaking news we showed you at the top of the newscast. the destructive, and fast moving fire in southern california. we are joined from riverside california with the latest on the riverside fire. rob. >> let's start with the good news. at this point it appears that a lot of the smoke that you saw here about an hour ago has cleared. perhaps that's because the afternoon winds have kicked up which can be bad news in and of itself. but we are here at one of the highest points in the area where a lot of residents have gathered to take a look at what the fire is doing. if you look behind me you don't see much smoke at this point. those are some of the homes the fire ripped past about three or four hours ago, right past those homes into the canyon on the back side where the fire has destroyed at least one home so far. >> fast action by firefighters wasn't enough to save this home. a large structure at the bottom of a small canyon fully engulfed in flames. there are many homes spread out across the hill tops here, west

of the 15 freeway and marietta, and crews worked hard to protect as many homes as possible. from the skies above air tankers dropped fire retardent on the line trying to draw a line around the edge of the fire to keep it from burning homes. many residents voluntarily left the area to stay safe. >> you could see it coming closer. you don't know how fast it's going to move and grab what you can and get out. >> the fire started around 11:30 this morning burning across a valley, up a small hill toward a number of homes. residents who didn't leave the area stayed around to keep a close eye on it, especially because of the thick brush and occasional wind gusts. >> there's lots of dry brush and there was high winds that just missed this valley and actually took out the next one. yeah, it was pretty intense. >> right now it's not as bad but earlier it was coming quick. it started down there and then, you know, you turned around and

it was up on top of the hill. >> how close did it come? >> it's about two blocks away as the crow flies and it was moving pretty fast. with all brush there, it was a big fire. probably 30 feet in the air. pretty amazing. >> and you are looking live at part of the burn area. that's the valley below our location. about a quarter mile away. here are some of the numbers from firefighters. the fire has burned about 400 acres. it's 20% contained right now. no mandatory evacuations in the area, but at this point they are telling people who are living near this fire to voluntarily leave their homes. the bad news one structure destroyed, but the good news, at least at this point, no reports of any injuries to residents or firefighters. reporting live, rob mcmillan, abc7 news. >> rob, thank you. >> california faces a potential shortage of prison inmates available to fight wildfires because of changes the way many offenders serve their sentences. cal fire relies on about 4,000

minimal security inmates to help fight fires. that number may shrink to 2500 next june. that's because many lower level offenders are serving their sentence necessary county jail to save taxpayer money and for prison overcrowding. >> a woman found brutally beaten yesterday in oakland has died. a jogger found her and her boyfriend yesterday morning and both were covered in blood. they say it's a case of domestic violence and they are holding the boyfriend on suspicion of murder. they haven't revealed the identities. >> and wasted almost $2 million on high-tech equipment some of which was never used. four of the twelve tech systems the police department bought were never deployed. they called another shot spotter underutilized. the report places much of the blame on a lack of communication between the police department and thety's department of

>> closed captioning brought to you by mancini sleepworld. >> police in fairfield expect a prank center may be behind an exploding soda bottle that woke people up. it exploded along hickory avenue just after six this morning. officers discovered another unexploded bottle when they arrived on the scene. now it appears that somebody filled that bottle with chemicals that could cause it to explode. fairfield police say this is the late nest a series of similar cases. >> unfortunately it's extremely dangerous when the device is actually detonated. it throws debris for sometimes hundreds of feet. it's sharp. now it's covered with acid and it's a felony in the state of california. >> fortunately nobody was hurtpy today's blast. the bomb squad assisted in disposing of the unexploded bottle. >> free birth control is one

health benefit that's now available to women under president obama controversial affordable care act. a provision went into effect today that provides free services that also includes screenings for sexually transmitted infections, prenatal care, pap smears, pelvic exams and breast cancer screenings. >> too often we put our own health last and that's especially true when it comes to preventive care. the regular checkups and screenings that are so important for staying healthy but can be easy to put off. >> existing customers will receive the benefit at the start of their plan the next renewal date. the government indicates 47 million women will be eligible for the new benefits. >> today marks the kickoff of world breastfeeding week and three bay area hospitals have joined a nationwide push to eliminate formula whenever possible. we are shown what the movement is all about. >> kaiser permanente is tries to

receive a baby friendly at all it's hospital. the policy strongly favors breastfeeding. >> we do not give formula to our babies unless it's medically indicated. >> the industrywide push is not so much a move to ban formula than it is to educate woman. >> certainly in a baby friendly hospital we want to give all the encouragement to the mom and facility breastfeeding and make it happen. >> the baby friendly hospital initiative is a global effort by the world health organization and unicef to promote breastfeeding. obtaining the official designation is tough. the hospital must practice certain policies such as promoting breastfeeding over formula, encouraging breastfeeding within one hour of birth and whenever the baby is hungry. the baby must also commit to keeping mothers and infants in the same room and train all of its staff to help implement the

policies. only three bay area hospitals have actually achieve the baby friendly status. keyser is and hayward, sf general and almeda county medical center in oakland. but these new moms at day one in palo alto say they have noticed the trend. >> where i gave birth, and they had consultants and i went to breastfeeding class the day after my baby was born. >> even hospitals with baby friendly designations say they will always respect the rights of their patients. >> if she wants to bottle-feed we will honor that but we encourage and support breastfeeding. >> these three women say it's an important decision and one they are glad they made n palo alto, karina rusk, abc7 news. all right. on to consumer news. there's a brand new e-mail service come from microsoft and it will challenge google's popular g mail. >> this is pretty amazing. it is competition, no doubt about it. microsoft is not replacing its hot mail service, instead this is a whole new web-based e-mail

system called outlook.com. the news service will let you link up directly with your facebook and twitter accounts. and a tech editor said that, unlike google, outlook.com will not have ads based on what is in your e-mail. >> there is advertising. it allows it to be a free service but they aren't putting ads targeted at the actual text in an e-mail. >> which a lot of people find extremely creepy. outlook also aims to show more messages and push ads off to the right side of the screen so there will be less clutter. the bay area toy making company that uses all recycled plastics is now recalling thousands of its toys. green toys in mill valley is recalling 50,000 mini cars and trucks, including that one right there. the company said the wheels can detach and pose a choking hazard. the company received ten reports of lose wheels and hub caps. however there were no reports of

injuries. green toy initiated the recall itself. if you have one of the toys you should not let your child play with it and instead return it for a full refund. the recalled toys are the mini vehicle set and mini assortment, the red fast back and fast back set. the mini taxi, police car and ambulance. okay. what do you say when the fast-food guy says do you want fries with that? >> yes! >> yes. well, increasingly customers are saying no, they don't want the tempting side order with theirburg. an industry survey found fast-food places sold 1 billion fewer combo meals the last few years. analysts say the economy is only part of the reason for the cutback. a big factor, more folks now prefer healthier side dishes like sal lads, believe it or not. >> they are healthy but the fries taste so good. >> yeah. thank you. >> we have three more new friends we want to thank for

as we lookcat san francisco, san mateo county coast you still see some fog really hanging on. half moon bay is overcast right now. 55 degrees. cool compared to the 90s that we have inland. you look at the relative humidity, it's at 100%. really the air is saturated. we have the fog there. get away from the coast and the inland areas are quite dry and hot. we will check out livermore right now. it's clear, 91 degrees. relative humidity 23%. so the contrasting climates in full play here in the bay area. i want to show you the current readings. 95 degrees in fairfield right now. so far the inland highs have made it to the mid-90s. coastal areas in the 50s and 630s right now. pacifica only in the upper 50s. so we have the wide range of conditions. fog near the bay and coast overnight. hot inland again tomorrow and we are looking at a cooler pattern by the weekend. you will really feel the difference by the weekend. at 7:00 tonight you see the fog at the coast moving locally inland, and you notice the green

showing up here for your morning commute at 5:00 a.m. you may see patchy drizzle along highway 101, along the coastline. temperatures starting out in the low 50s to the upper 50s for most. 60 degrees in antioch. watch what happens to the fog. really limited in coverage like this morning and then it pulls away. burns off from the bay side communities but not quite the coast. 60s coastside. we will go with 90s inland. these are summertime microclimates and we will keep them coming for another day. 85 in campbell, saratoga kau. pretty warm day in cupertino. mild and sunny, palo alto 79. cool in pacifica, 60 degrees. not much change in downtown san francisco. 67 degrees. sunset district 61. get you up into the north bay and you will see the upper 90s around ukiah, clear lake, 88 san rafael. in the east bay the 73 in oakland, up to 81 hercules. inland areas this is where it's gwing to be another hot one.

>> president obama was thrilled by yesterday's gold medal performance by the usa women's gymnastic teams. he called them from air force one and expressed his awe. >> i told these young ladies as i was congratulating him, how do you not bust your heads every time you are on that little balance beam? i couldn't walk across that balance beam. >> the white house said the president watched the gymnastics and the swimming finals. he also called michael phelps to congratulate him for winning his 19th olympic medal. that's an all-time record for the games. >> amazing. we have olympic results and if you don't want to know todays winners now is the time to turn away and come back when the music ends. ♪
