just come home from work as the fire was already under way. people who live in the court apartments here say the fire spread fast. for some the first sign of trouble was the smell of smoke. >> i smell campfire then i was like i smell that too. we parked right there and we look and we see black smoke coming up. we are lick what the heck. >>reporter: the series of apartment buildings sits writ along the railroad track on highway 85. resident were worried that the flames were going to jump over and reach their homes. no one took any chances. >> as soon as we saw it we got in the car and everyone else was already getting out of the building so yes as soon as we saw made sure we could get out okay. >>reporter: firefighters had a tough time getting to the flames at first. they were forced to cut through the chain link fence. flames destroyed few shed and 3 vehicle. crew were successful in keeping the flames from reaching the apartment building. investigators now trying to determine what started the

fire. they say it looks suspicious. >> because of the time of day and the location also there were report of teenagers in the area. >>reporter: none of this surprising to this man who hear people hanging out near the track often. >> couple time a week you hear people playing with fireworks back there. so it's a little scary with all the brush and tree et cetera. >>reporter: resident say there was a fire in this same area last year but it was much smaller. they say this one was definitely more nerve wracking. live in los gatos, abc 7 news. >> thank you. >> another fire to tell but. interstate 5 near lake shas to open again. 300 firefighters continue an all out assault on wildfire grown to 900 acre since erupting along the highway. 100 homes threatened along with several buildings and major power lines. one building already lost in fact. fire is only 20 percent contained with full containment

not expected until sunday nigh night. authorities say it may have been started by what they are calling human activity. victory tonight for south bay muslims trying to build islamic community center for 6 years. this is project that has had strong opposition from the start. center which include as mosque would be built on vacant lot in san martin south of san jose. here's lisa. >> this is about political bigotry. people being intolerant don't like how the community is changing. >>reporter: frustration during today santa clara county planning commission meeting was pat palatable as islamic community asked for use permit to build a community center in san martin. the center would contain a mosque, hall and cemetery. >> do i believe they have picked the wrong area to have a church. >>reporter: proposed site along monterey highway has been met with opposition since the inception. south valley islamic community started the dwoingt build a mosque here 6 years ago. in that time they

have tested the soil. water. septic tank. congestion. and according to the planning commission they have passed all of those tests. which is why many muslims believe there's another reason they are not wanted. >> we should not be holding the center at different stand arrested than other places of worship which brings concern of element of islamic phone yaichlt about fear ignorance. >>reporter: project opponent strongly disagree with that characterization. they were a minority in the room today, they have always been very vocal about their concern. >> i am concerned about the traffic. thinking it has to do with being a bigot or not wanting them there. it's not that. the fact is these people live in a flood zone. it's a rural area. >> some people use water concerns as cover for that hatred. >>reporter: in the end the planning commission voted unanimously to grant the use permit. opponent plan to appeal that decision and take it up before the board of supervisors next month. lisa,

abc 7 news. san jose police chief facing some trouble within the rank. budget cut and shrinking morale within the department could lead to possible vote of no confidence for chief chris moore. at least one board member of the san jose police officer association is trying to get a vote on next week meeting agenda. director of communication david spring says chief moore has a tough job right now. >> she didn't create budget short fall or recession. chief did not create the pension challenges we have over the next 5 to 20 years. what he has been dealt with not due to anything has done is with a shrinking budget. >>reporter: the item is on the p o a board agenda for august 7. at that time the board can decide to take the vote to the full membership or let the issue drop. 6-year-old stockton boy in child protective services custody tonight after police found a picture of him playing with a gun in a car. it wasn't

just any picture either. police say it was being used as wallpaper on his father's i-phone. they were arrested on gun drug charges. police called the picture extremely disturbing. >> because what will happen is if this kid is in this type of lifestyle growing up with guns. drugs. potential gang violence that means they go right into that lifestyle. >> police say in addition to guns and drug they found several thousand rounds of ammunition. 10 gram of cocaine and 100 ecstacy pills in the little boy's home. >> san joaquin county sheriff's department investigating remains of teenager girl and fetus found in a well near lynden. remains found in march along with the bodies of these 2 people. all likely victims of the speed freak killer. opportunity identified remains fit property file of girl 16 to 18 years old with mixed ancestry. fetus 32 weeks.

remains of other 2 victim sent to family. he's on death row at san quentin while the other committed sue snide january. >> unbelievable turn of events there was another gas leak today at ground zero in san bruno. this time however no daniel. pg&e says backhoe being used by private contractor ruptured 2 inch plastic pipe at the intersection of earl avenue and glen view drive. it was at the same intersection in september of 2010 that gas transmission pipe burst triggering explosion and fire storm that killed 8 people and nearly burned the entire neighborhood to the ground. it took utility crew just half hour to cap today's leak but 14 homes were evacuated as precaution. police in campbell located statue stolen from the catholic church. investigators found the missing statue of a saint not far from the catholic church. police received a tip. statue was located close to the church in a parking lot on

hamilton avenue. police say the statue was wrapped up when they found it still no word on who might have taken jit tips from the public led to the arrest of suspected burglar after the crime caught on tape. belmont police arrested 32-year-old john bentley at home in hayward after they released surveillance video of the burglary in progress. video in broad daylight shows man walking out of the home burglary committed load ago suitcase into his mercedes and then driving off. bentley lives near the crime scene and he own as green mercedes. police say they found items that were stolen from the home including the suitcase in his possession. well up next. chicken filet kiss in. protest started with long lines and chicken sandwiches is about to turn into an in your face protest. also fur seal found thousands office miles from home, gets a lift to the bay area with a little tlc. >> giants slumber party turn into a real field of dreamer. then later on "nightline".

>> gay rights activist planning protest at chicken filet restaurant across the u.s. tomorrow demonstration in the force of kiss in to protest the company stand against same sex marriage. yesterday the appreciation day was a huge success for the restaurant chain. company says it set a 1 day sales record as thousands stood in line for hours to show their support for ceo who stirred up controversy when he publicly admitted he was against same sex marriage. limited pilot program allowing bicycle on bart during friday rush hour gets rolling tomorrow. bart will use passenger feedback from the month long experiment to develop more bike friendly policies. bike are normally banned on bart during the morning evening commute on all but the richmond fremont line.
