good morning one minute after 5, i'm katie marzullo in for eric thomas. and i'm kristen sze. lake fires continue to grow, 6,000 acres have now been scorched near clear lake. there is somber news some are able to wake up in their own beds this morning. amy hollyfield is live at the calfire station in calistoga with the latest. >> reporter: good news/bad miss. the news is not good for firefighters. -- they face a tough fight and hot day coming up. the news is good for rizes some did get to go home after evacuating the spring valley neighborhood sunday night. the fire did destroy two

buildings and damaged a third. firefighters think that threat has passed, people were allowed to go home. still, the fire is burping with plenty of intensity, it is -- is burning with plenty of intensity burning in a rural area creating challenges for firefighters trying to get to. that at least brings relief to residents who just wanted to go home. >> i'm glad everybody is going to come home. hard part is over, it happened three years ago, something you live with up here. >> reporter: the fire did grow by another 1,000 acres yesterday it has now burned about 6,000. 25% contained about the same amount of containment they had yesterday morning they are holding stead any this fight, not making huge strides. -- they have 358 firefighters battling this one. and another hot day expected ahead for them. amy hollyfield, abc7 news.

to death last night near a walgreens store. witnesses say she was attacked by a man with a samurai sword. the weapon was found nearby and the man is still on the loose. the victim was a well-known homeless person in the area. shortly before 2:00 in the afternoon there was a fatal drive-by shooting near charles street a man in the car was kill. 4:00 in the afternoon another drive-by shooting wounded someone standing in front of a house near tully road. oakland city council will hold a special meeting this morning related into the investigation into how police handled occupy oakland protests. last fall police used tear gas when they moved in on protesters to break up their encampment at frank ogawa plaza. complaints lead to extensive investigations. five outside firms are working on. today the council is being asked to approve another 27 -- $2 5,000 for one of the contracted firms. contra costa county board of supervisors will get a

briefing today on the chevron refinery fire. the report is expected9d{ to include the status of several ongoing investigations. the federal probe is on hold apparently structural engineers say the burn site is still unsafe for crews to enter now. sky 7 hd was over the scene yesterday. an investigation by the u.s. chemical safety board is focusing on possible pipe corrosion as the cause. investigators believe a small hydrocarbon leak ignited quickly and sent a plume of toxic smoke over richmond and other parts of the east bay. in martinez, shell investigating an incident at its refinery. fire reported yesterday afternoon in a light oil processing area initially classified as level 2 emergency later downgraded to level 1. that means there was no threat to the community. there was some flaring from the smokestacks to help reduce pressure on the system. no one was injured. today mayor lee plans to update supervisors on the

response to last week's fire that damaged 10 businesses in the city's ingleside district. two firefighters were injured fighting the august 7th, fire on ocean avenue. it could have been much worse. 10 firefighters were battling the fire in the front of one building when a backdraft created a fireball, very rare occurrence that is capable of taking the lives of firefighters. in this instance one firefighter suffered a wrist injury. right now bail to moving to the california an senate that could help make college more affordable. the state assembly approved a bill that closes a corporate tax loophole and uses the expected wind fall to reduce tuition. ab-1500 would eliminate a one billion dollar tax break for out of state corporations. the legislature approved it as a way if get republican lawmakers to vote for the state budget. california -- [ unintelligible ]

crews are on the line hoping to make significant progress while it is nice and cool and obviously dark out here before the sun comes up really heats up the day and afternoon winds come in. this fire is a tough one. it still has plenty of energy and now burning in a rural area that is tough to get to. it has burned about 6,000 acres. firefighters have established a fire line around 25% of it. they are working hard on it right now this is actually the time when they feel like they can get a lot done. >> we are making good progress overnight because that's when the humidities are high and the fire intensity is slowing down. it is a matter of holding on to what we have during the afternoon we are still expecting high temperatures, low humidities and winds in the afternoon which is making everything a challenge. >> reporter: the good news, people who live in spring

samurai sword. he walked over to the woman as she sat on the sidewalk and started swinging the sword, cutting into her throat. bystanders chased after the man running around walgreens but he returned to the victim and began stabbing her again with the sword. employees at a nearby starbucks say a man matching the description of her attacker had been in the coffee shop earlier in the day and started screaming. they say he scared everyone telling them the street woman had put a voodoo hex on him. >> he said she was trying to put a black voodoo spell on me and i didn't want her to. and she was scared to death. -- and he literally was scared to death. >> reporter: the two on charles street in north san jose, a man in his 30s sitting in a car someone shot and killed him. a couple hours later police scrambled to another shooting in east san jose, a man was shot in his driveway.

we don't have many details on his condition. police have not made any arrests in any of these incidents. the two people who have been killed raises murder rate in san jose to 27 so far this year. reporting live in san jose, i'm sergio quintana, abc7 news. state lawmakers are sending the governor bail that would ban government agencies from disrupting phone -- disrupting cell phone service without a court order. bart says the safety of passengers and workers remain top priority. august 11th, of last year a massive protest attempted to shutdown bart service. bart responded by cutting off cell phone service inside the station in an effort to disrupt communications. some argue that threatened public safety. today east bay state

senator who chairs the senate transportation committee will hold public hearing to address caltrans' testing issues. caltrans engineers uncovered broader range of problems with testing of roads and bridges. that comes after the sacramento bee exposed falsified data in safety tests of the new eastern span of the bay bridge. the team found problems extended beyond a single employee found to be falsifying data, 23 cases have been discovered. new employee safety program begins today at napa state hospital. some say it could put them at risk. they will begin wearing emergency alarm tags on lanyards some worry those lanyard could be a strangulation hazard. officials say the strap has a safety break away feature and alarms can be attached by a clasp. two years ago a psychiatric

tech at the hospital was strangled by a patient. employees have long complained about a lack of security and safety at the facility. federal panel has given california until friday to come up with ideas to reduce the prison population, including early release. the deadline was made because the state probably won't meet the requirement of a court-ordered population reduction. governor brown's plan to move low level offenders from state to county jails is not moving fast enough. california has up to 8,000 too many prisoners to meet the federal mandate. the realignment has created overcrowding at san mateo county jails. the number of inmates transfered from state prisons to the county jails is 15% higher than what state corrections officials projected. 170 inmates who would have served time in state prison have been sentenced to county jail instead. state power grid managers have declared a flex alert for
