recommend today whether he should keep his job. an attorney for the city was ready to deliver a 40 minute long closing argument, spelling out why mirkarimi should be fired. but, a commissioner quickly interrupted with questions about the commission's power and the evidence. >> how can an active domestic violence be transfered into saying that is a misconduct in relation to his office? >> reporter: the defense also faced some heat from the commissioner who scolded mirkarimi's attorneys for what they wrote in legal briefs. >> you didn't do your client any favor by starting off your brief by saying at the end of an unnecessary protracted dog and pony show. is that what you consider these proceedings to be? >> umm, respectfully commissioner, no, absolutely

no >> reporter: lots of questions and interactions. both sides did manage to get their arguments in. the panel plans to deliberate over the lunch hour and issue its recommendation while commissioner are deliberating there will be rallies on the steps of city hall and in the plaza for and against ross mirkarimi. amy hollyfield, abc7 news. searchers are still looking for a 6-year-old presumed dead after he and another boy were swept away at yosemite national park. the tragedy happened yesterday afternoon. a family from southern california were cooling-off in the merced river near the foot bridge. currents swept the two boys away. the 10-year-old boy's body was found 150 yards downstream, cpr could not revive him. the 6-year-old has not been recovered. >> yosemite officials dealing with a health danger after a man visiting the park died and another person became sick from a virus spread by

rodents. health officials believe the two were exposed to mice droppings or urine while staying at curry village and contracted the junta virus, there have been four cases this year. avoid areas where wild row denies may be. keep food tightly sealed, remove piles and junk and seal holes. to learn more, including symptoms go to abc7news.com under see it on tv. this morning authorities are investigating another attack on a worker at napa state hospital two days after we told you about the new safety measures to protect employee as the -- employees at the mental hospital. there are concerns the alarms can pose a risk of strangulation. we are told that is what happened. a patient grabbed the lanyard and tried to choke a male tech last night. he was sent to the hospital. he was not seriously injured.

>> the state is taking blame for today's -- tuesday's computer glitch at the department of motor vehicles. the glitch shutdown the system for several hours was blamed on at&t and verizon it was discovered that a router at dmv headquarters caused the problem. another router at the state failed that shutdown the network that links libraries, child services and dozens of other departments across the state. the state insists the two router failures were not connected to the multi-million dollar revamp from a few years back. facebook stock rebounding slightly after dropping to an all time low this morning. shares plunged as 271 million new shares became eligible for on the first day that the post ipo lock-up period ended meaning early investors can now sell their shares. the stock hit a low of $19.69.

down 20%. first day trading was marred by nasdaq glitch an an unimpressive earnings report followed cause the stock to spiral down. right now facebook shares selling at just over $20 a share. in san jose, samsung scheduled to make major announcement in a few hours. the mayor and the governor will be at the 3 p.m. event at city hall. samsung is in a legal battle with apple over several patents. we where getting our first look inside the newly renovated memorial stadium at the university of california. the bears football team is holding its first practice in the stadium today. they've been working on fields nearby, while the 80-year-old facility received a 321 million dollar earthquake retrofit and facelift. cal officials say the upgrades will not only benefit the

determine whether fogging might be necessary in the future. the worst outbreak of west nile in the country is in texas right now some worry about the danger from the chemicals used to kill the mosquitoes carrying the virus others point out west nile can be deadly. scott goldberg reports. >> reporter: the little pests always are hugely annoying but this year in mosquito country the consequences of their bites go well beyond the itch. >> just killer killer headache. >> reporter: catherine in texas, nearly 700 other americans have confirmed cases of west nile virus, 26 people have died those numbers just scratch the surface. >> from that you can estimate as many as 12,000 people have been sickened by west nile in 43 states half of the cases are in texas. >> reporter: the reason it is so bad, the winter wasn't cold enough to keep mosquitoes from breeding it is now a summertime threat. >> the people who tend to get this worse are people who are

talk about a tight squeeze. a young boy in southwest china found him specific in a bad spot after he got his head stuck in a hole on a stone balcony. crews first tried to squeeze him out that didn't work so they brought in the jaws of life. they finally pulled him out. he's crying. after doctors gave him a once over he was reunited with his grandmother doing fine just a few tears. >> he's not going to try that again. >> no. i can see what his parents are saying. >> why did you do that? >> exactly. if you like the clouds they will come back right now they have left as we talked about they would, sunshine over san jose now. as we look from mount sutro this morning you can see a one
