880 in oakland. >> this is the story. >> traffic slowing nicely. we're going to show you what it looks like. >> the suspect was handcuffed and kept face down on the ground. police had guns pointed at the man. the car car overturned and several lanes of northbound 880 were closed creating a back up. and police say they tried to stop the driver because they suspected it was a stolen car. the pursuit happened after officers tried to pull the car over when this driver sped away. several cars were hit including this one owned by a union city family. the yuck boy was strapped in a

between a suv. the suv was towing a boat. and this happened near scott creek road. lanes closed an hour and a half. no one was injured. right now, bart is back on track after reports of smoke shut down service today, white smoke coming from an electric substation prompted officials to stop service. trains at the stations stopped running. >> there is a compromise in the works at napa state hospital over how workers can now safely carry personal alarms. and fears were realized when a patient choked an employee with that device, abc 7 news is here now with the developments on the controversial lanyards. >> this is a head shaker.

guards will tell you don't wear anything around your neck but this week, issuing lanyards and it took a day before a worker was choked. >> napa state hospital executive work autos you pull down and it activates and if you yank, it breaks away. >> that is how it works and employees showed me what happened wednesday when an employee lanyard was pulled from behind. >> and this patient started grabbing it and choking him like so. >> and the employee is recovering and will be back to work. workers wondering why the hospital is asking them to wear lanyard that's don't break if they're grab frtd back. >> we're in a place where we have something dangerous. we're going to have to play out these next 10 day autos

this psych tech says it's just going to be 10 days because yesterday, the hospital ordered a batch of metal clips that will hold triggers. once in, any employee prefers the belt clip can use it instead of the lanyard. and there are some saying until then they'd prefer to die them around their belt autos we're looking at that. they're measuring against the belt clip and evaluated and we'll see what he can do. >> this hospital union reps say it should be a no brainer. >> it's their necks. it's our necks on the line. it's their necks right now. >> and a number of employees refused to wear lanyards and after advised by supervisors to wear them around their necks administrators decided to let employees come to work. there will be no action.

i'm told, for refusing. >> thank you. >> there is a major warning from a fire chief after an overnight fire killed two men and officials say the amount of stuff in the house kept firefighters from rescuing victims in time. amy holly field has the story. >> there are temperatures saying there was so much stuff there was a hard time getting to victims. >> if this took longer than it normally would that would be free of the debris. took about 20 minutes to get the first victim, then 10, 12 minutes to locate the second. >> she says it would normally take a minute or two. and both men inside died. >> loss of life is always disheartening but i'm confident that the crews here did the best they could in rapid response and a search to

this afternoon the federal government launched a crack down on children being left inside hot cars following deaths of eight children nationwide in just the first week of august. the look before you lock campaign reminds parents to double check vehicles before walking away. >> just doesn't have a profile that you can say rich, poor, young, old, smart, stupid thchl can happen to anyone. >> and one key tip to remind parents their children under the back seat leave the purse, brief case or cell phone next to the child so you won't forget either when leaving the car. >> there is more welcome news for chocolate lovers. a stud gee shows eating a coco drink or eating a chunk of dark chocolate can help brain health in older adults.

there is an effort in sunnyvale to make it more bicycle friendly allowing to sue if harassed or injured by a driver in a traffic accident

and phone shallly collect triple damages and how is this law being received? >> this is everyone we talked to say they hadn't heard of the law. it's been in the works for the last year. sunnyvale has been making efforts and installed 80 miles of lanes over the last two years and this new law takes efforts to a new level. and some bicyclists raised interesting questions and they're curious about how this will work. some wondered if it's necessary. leaders say it would make it possible to secretly in civil court against the driver and if they bring a case to court and win, the driver could be liable for triple damages and court and attorney fee autos there is a car oriented network. there is no way they can

compete with a vehicle when a car is in a situation of violating rules of the road. so this does help to raise awareness. >> and this this is fashioned after ordinances that have gone into affect in two other cities, los angeles and berkeley. sunnyvale bicyclists say they have been in a few different accidents but they say it's because drivers are not paying attention, and it's not because those drivers are trying to injure riders so a lot of the bicyclists were wondering how often this law would be used. i did talk on the phone with the author of berkeley's law. he says to his recollection it has not yet been used in court. >> and michael finney is here

now answering questions that people sent him and we'll start with gina h asking how can i file a claim reporting a pot hole i hit and dented my rim. >> that is a good question. they are actually responsible for any damage there. it's tough to collect. here in san francisco many cities do it like this, you go online and to the city attorney office. there is a claim against the city. there is a form, fill it out and hit send and there are sometimes they'll pay, but generally they deny it and that starts a potential lawsuit this next comes from joyce h. a friend used a gift card. the server told him he had to pay sales tax in cash s this legal? >> how weird is that? >> that doesn't make sense. >> that is odd. >> they can do it because there are aren't any rules on

what a gift card with pay for or not. i never heard of this before. they probably legally can do it but why would they want to do it? send me the name of the restaurant we'll ask them that in person that. is too odd. you're supposed to show up with pocket change? >> matthew asked i bought a car and now they're claiming they under charged me and demanding i pay or return the car. can they do that? >> they can. if you take a look... >> that is odd. this is back in the day. car dealerships would be open late at night before the internet or weekend. they'd cut a deal and perhaps information you gave them is no longer correct or maybe you lied to them. they had to roll the car back. and that is still the rule today so somewhere will be written this is not in effect until after paper work goes through and they give themselves 30 days now there

>> this is my brother now there is a little bit of problems with hearing and his brain doesn't work as well, but we're happy he's survived. >> i think i met someone with the same brain tumor as me. it's pretty rare. so that is cool. >> the retreat is offered by the foundation providing a crucial level of support for families so stressed out by their child's illness. >> we came to camp before ashley's second surgery. and we didn't know anybody going through what we're going through. >> the camp director runs a support group for the adults talking about the illness having a ripple affect on the family. >> this is a sibling maybe being left with family members or friends while parents are at the hospital. and financial stress because parents want to be with their child not be maybe at jobs or lose their jobs because of this. >> the camp is personal. melissa's son wasn't even three when diagnosed with

multiple brain tumors and she had a new baby. melissa is my niece. >> this is a feeling each time you get to tell the story to someone who understands. and just doesn't want a one minute version with a happy ending. they want to know details. >> mitch turner's son, aidan was dying notioned with four, his baby brother celebrated his firj birthday while aidan was having surgery. >> it was difficult fr me. i thought i can't do this anymore. seeing how much fun and joy aidan has and friends he has, i was like, i can't deny him that. >> mitch and i work together at abc 7. >> this foundation created by barry and elaine tailor, related to jack of jack's camp. jack diagnosed at age 24 and did not survive, sadly. but he won't be forgoten
