now. not in the bottom of the ocean. >> reporter: that's jack with his buddy, christian, talking about their terrify -- terrifying afternoon, sitting in this rowboat that was adrift and taking on water on san francisco bay. two 12-year-olds wondering if they were survive. >> me and yack were bawling and bawling and crying and weeping, never going to get back. >> reporter: they might not have gotten back if not for nick, who stripped down into this underwear, jumped into the 55 teague water and swam nearly a mile. with he the row boat sinking, he grabbed the boys with the life jackets and told them to lay on their back and kick. >> it was narly situation. and i was a little freaked out, too. there was no boat and i was holding two jackets with one hand and doing the side stroke up to the pier. but we method it happen. >> reporter: that's where they were rescued bay coast guard

cutter. this afternoon started pleasantly enough. they were all at candlestick point recreation area for the birthday party. the boys got in a boat to get a football that landed in the water but it was wind diand an umbrella on the boot acted like a sail. >> we got the football and realized we weren't going to get back. they were yelling at us. >> two other up identified men also stripped down and jumped into the water and had about toe be rescued but it was nick, lifeguard for 15 years, who was able to reach the boys. >> just the thing to do. yeah. not sure i call myself a hero. >> he is a hero. he is -- saveed me and my froippedzs' life and wouldn't have an able to get back without him. >> san francisco fire took partner rescue. there was some mild hypothermia but everybody is fine. the two friends are set to secondart second agreed at san francisco's

gateway on mches the shane the teach are asks them, they can answer what they did this summer in south san francisco, john alston, abc-7 news. >> ama: so fortunate. thank you. an 81-year-old man has been arrested in connection with a road rage incident that sent a cyclist to the hospital. it happened on wednesday on highway 12 near the golf course. the cyclist said the driver yelled at him and then followed him on to a cart path on the golf course and hit him. >> he could have run right over me. i was scared for my life. >> he had a titanium plate placed in his rick. henry edward smith was arrested after motion got a tip from a cl female cycle qwest who had a similar incident last year. he took a picture of his license plate when he yell at her last year. smith was identified out of a lineup today. smith its charged with assault with a deadly weapon. police in capitola are

asking for your help to find a missing 75-year-old man. richard carter was last seen yesterday morning near his home on capitola avenue. carter, who was discharged from the hospital last week, may be disorient from the new heart medicine he has been taking. san francisco police tell us two pushinged gang members are in custody tonight on suspicious of shooting at an 18-year-old in broad daylight. one suspect shot the male victim. the victim then dried to board a bus. witness testimony led police to a nearby house where the suspects were arrested and a large amount of weapons were discovered. the victim is expected to recover. in san jose, 15-year-old skateboarder was taken to the hospital after what police believe to be a gang-related shooting just about 3:00 this afternoon. those responsible were gone by the time police arrived. the teenager was shot in the leg

and is hospitalizedded with nonlife-threatening injuries. hundreds gathered to remember a loss ales to hill marine who was killed in afghan. matthew manoukian was shot and killed while conducting combat operations. here's the story. >> reporter: this memorial was a chance for friends and family to pay tribute to the 29-year-old who many described as a strong leader. >> commit to what you believe in and stick it to and that's what matthew did. >> reporter: among those at the memorial were marines from camp pendleton in san diego and camp lay juvenile -- lejeune? north carolina. >> the head of the high school estimated more than 18 people turn out for this service. this memorial for captain matt manoukian stretched out for more than three hours. >> just the length of the service today demonstrates how many people wanted to talk about

good evening, i'm ama daetz in tonight's headlines, five people escape safely from the colored waters of san francisco bay after a small boat capsided. two children tried to retrieve a football in the bay and three men tried to rescue them after they ended up in distress. a bicyclist is recovering from fractured ribs he not when he said a driver tried to run him down. an 81-year-old santa rosa man has been arrested and charged with assault with a deadly weapon. >> two are in custody after the shooting of an 18-year-old. the victim tried to get on a bus after he was shot. friends and family of los altos hills resident matt manoukian memorialized him today. >> bad weather ground airplanes on the front lines on the battle agains west nile disease in the dallas area.

the mosquitos carry the deadly virus. the ground and aerial spraying of the insecticide comes after people were insuspect -- infected. a drought has gripped much of texas but mosquitoes only need a small amount of water to breed. >> one of the things that happens in drought years, people collect water so when this occurs you have perfect greeding ground for mosquitoes. >> ama: west nile has infected nearly 700 americans, killing ten of them. this is the worst outbreak of the virus this early in the season every. young chirp, the elderly and people with compromised immune systems faced the biggest risk of coming down with west nile. >> a bay area bird has tested positive for west nile. authorities released the results today. the first bird in alameda county to test positive for the west nile virus this year.

>> a dog wag rescued after being abandoned on a colorado mountain for a week and tonight her own e wants to get him back. >> this german shepherd is on the toad recovery. at it her owner who is now feeling the bite. she faces a criminal charge of cruelty to animals after abandoning missy near the 14,000-foot summit of a mountain. the 29-year-old says he had no choice. sharp rocks severely hurt her walks. she was too hurt to walk and too hurt to carry. he called 9-1-1 but was told an animal rescue was too risky, he made no effort to rescue her. >> she was found almost a week later. >> just laying there and was barely moving. >> they went organizing a volunteer rescue team. >> we just started getting tons and tons of phone calls. >> nine days after missy was left for dead a group of total strangers hoisted the 100-pound

>> ama: just a matter of time before the next big earthquake hits. our iteam has been checking on hospitals that have not made upgrades and talked to one expert who said making a deadline night mott be enough. >> we all know the bay area is riddled with faultlines and very close to those faultlines are some of the area's busiest hospitals. state law says hospitals have to guarantee they can function after a major quake but we

talked with an expert cho -- who claims that is virtually impossible. >> one, two, three, four -- >> so many hospitals on bay area faultlines. >> you can run but you can't hide. >> davis schwartz with the u.s. geological survey says there's a 63% chance of a major earthquake in the bay area by 2036. >> it's critical we have hospitals that people can go to and be taken care of. >> reporter: after. the 1994 north around earthquake, the state legislature passed a law requiring hospital build little be built or retrofitted to remain standing after an earthquake. that was supposed to happen by 2008. >> compliance for this has been pushed off to 2013, 2015. >> reporter: through public records request the abc-7 i-team uncovered at least 120 hospitals statewide will miss the 2013

deadline, including santa clary valley medical center in san jose. a portion of operations are still in older buildings while a new hospital is being built. doctors medical center in san pablo is in the planning phase. marin general plans to build a new hospital but hasn't yet. california pacific medical center is in a fight over building a new hospital. the hospitals have applied for extensions that could run until the year 2020. 12 years after the only deadline. but if the state grants an extension ill witness come with a catch. >> have to be capable of withstanding the forces of the earthquake and remain functional. >> state law mandates by 2030 all hospitals mt. be capable of taking patients immediately after a quake. paul coleman with the office of statewide planning and development says, hospitals that get that extension will have to be ready in 2020. ten years earlier than original 2030 deadline. one expert has doubts about the state's plan.

>> to assure continuous operation to me, based on my history and hundreds of operation, is practically impossible. >> peter is an earthquake engineer and has study the aftermath of more than 100 quake weighs. he claims too many things can go wrong during a quake, causing a hospital to shut down. >> important to think we can actually protect the dozens and dozens of miles and all sorts of piping inside a hospital. >> he points to the 2010, 8.8 magnitude quake in chile. his photo shows a hospital's interior remained intact but the inside is a different story. >> the ceiling come down from here. >> reporter: on a recent visit to los angeles hospitals he discovered a major problem. the equipment wasn't properly anchored. >> the piping is okay. the equipment moves three feet and rips owl the piping.

coleman stands by the state's requirement that hospitals must be functioning after a major earthquake by the 2020 and 2030 deadlines and points to this recent test done at uc san diego. a five-story building, built to current hospital building codes-was set up with medical equipment and put on a shake table to simulate a major earthquake. the building remained standing and a nonstructural element passed the test. >> if you do have good, strong building codes and they are properly enforced, and complied with, that it is possible to have a building that can with stand earthquake forces. >> a worthwhile goal. hospitals have always supported that goal. >> jan shay with the can't hospital association says retrofitting or building new buildings will cost hospitals up to $110 billion. even then, no one really knows if that will be a wise investment. >> we're not going to know for sure if all of these buildings
