towards 101, foster city and san mateo, no major accidents, look out for fog across the golden gate bridge and there are a few slow spots in the east bay i'll show you where in my next report. :02. new this morning, highway patrol is investigating the death of a man who ran across the freeway after stopping his car on the side of the road. investigators say it happened before midnight on eastbound highway 4 in antioch. the driver ran into oncoming traffic and was hit by an ambulance. that one you see in the fast lane. officials don't know why the man left his vehicle. they've not confirmed his identity but believe with he was from brentwood and was about 45-years-old. suspended sheriff ross mirkarimi is taking exception to those who said he should have apologized after his domestic violence incident. last week the ethnics

commission found he had committed official misconduct when he grabbed his wife's arm. he spoke on kgo radio. >> the ethics commissioner asked why didn't i just apologize? because i wasn't allowed to. in the beginning i was saddled through a whole court process at the hall of justice where i was sequestered from being able to say anything for a number of reasons. >> it is now up to the board of commissioners to rule on his fate. >> a taxpayer's group if the south bay says santa clara county's sales tax measure is illegal and vowing to go to court to stop from it appearing on the november ballot. supervisors passed a measure two weeks ago to raise sales tax by an 8th of a cent the taxpayers association says state law requires a general tax measure to coincide with the election of local candidates on the same ballot. supervisors races were decided

in the june primary. as the new school year begins california launching first new grade level in more than a century. more than 800 districts are expected to offer the first year of a two year kindergarten the transitional kindergarten is for children with birthdays in the fall who would be too young for regular kindergarten. the eligible age is moving up three months or for kindergarten is moving up three months to 5-years-old by september 1st, phasing in a month at a time over three years it will be offered in more than 2,000 classrooms. new this morning, just released field poll shows an increasing majority of california voters support president obama's health care reform act. the poll finds 54% of california voters support the law, 37% oppose compared to last year, only 52% of california voters supported the law. at that time 39% opposed.

crashed into the pit area hitting at least three people, two had to be taken to the hospital. no word on the extent of their injuries or why the driver lost control. a scary, scary accident. hollywood is mourning the death of well-known director tony scott this morning. scott directed top gun, spy game and man on fire. police say he died after jumping off a bridge in los angeles yesterday. investigators say they found a suicide note at his office. the 68-year-old scott was working on a film with his brother director ridley scott. in texas five more planes will spray a second coat of pest of pesticides. four planes took off yesterday to spray the area. heavy rain saturday helped flush out mosquito larvae. residents need to be vigilant removing standing water.

the freeway after stopping his car on the side of the road. amy hollyfield is live along highway 4 in antioch with details. >> reporter: the tragic irony is he was hit by an ambulance driver who is usually in the role of helping people this happened7)w$ñ about 11:30 last night chp is calling this an accident, not citing that driver. they say they don't know why the man was on the side of the road whether his car had broken down, they also don't know why he suddenly ran across highway 4. >> initial investigation says that the pedestrian got out of driver's seat and ran directly across the road into the freeway and was struck by the ambulance in the number one lane. [ inaudible ] >> reporter: investigators state ambulance was diving at normal speed the driver did

not have lights and sirens on. they believe the victim is possibly from brentwood and is in his mid 40s. they are still working on tphoeufping his family. all lanes of highway 4 are now open this happened 11:30 last night. amy hollyfield, abc7 news. a man is hospitalized in san jose with life-threatening injuries this morning the latest victim of the city's recent rash on gun violence he was found last night about 9:00 on east san antonio street near highway 101. police say the shooter or shooters left before they arrived. investigators hope to hear from any possible witnesses. san jose police also investigating the city's 28th homicide of the year a man found shot to death early yesterday morning 5 a.m.. the victim died at the scene. police have no motive and no suspect description. also in san jose vigil

planned 7:30 tonight for a homeless murder victim the woman some called the screaming lady was killed by a man with a samurai sword last monday night she was usually seen sitting on the sidewalk on san carlo near meridian avenue where the vigil is planned tonight. authorities are still trying to identify the woman. police arrested 37-year-old marcus reynolds for the attack. in shasta firefighters are battling a 12,000 acre wildfire that has already destroyed seven homes and forced thousands to evacuate. we just checked the latest numbers this morning it is only 5% contained. the ponderosa fire broke out following a lightning storm early saturday morning. mike talked about the possibility of that happening. it has been growing ever since, consuming 19 miles of rural forest land. two other communities are in the line of fire about 3,000 homes evacuated and shasta
