right now abc7 news begins with breaking news. that breaking news berkeley near the california campus where a car crashed into a building and severed a gasline some had to be evacuated. >> amy hollyfield is live at the scene what is happening now? >> reporter: i just got briefed by an officer here at the scene. students are being allowed back into their dorm. they were evacuated as a precaution until authorities could figure out if the situation was safe. what happened was, a car crashed, jumped the curb right before 3:00 this morning, sheared off the top of a gas theater then came to rest against putnam hall at channing. pg&e shut off gas, engineers checked the structure of the

building. while that was going on police were trying to investigate the crash and the housing department here at uc berkeley was evacuating all students. it was a very active night here at uc berkeley. the police officer estimates it was a couple hundred students who evacuated. he was busy with the crash so he's not sure. i asked was it dozens, hundreds? he said probably a couple hundred. he said the evacuation was orderly. they got the students to other halls and dorms because it is a little chilly out. they had -- now they are being told they are being allowed back in. as for the driver the captain at the police department told me he fled the scene, but then came back, turned himself in they are now talking to him, trying to figure out who he is? and trying to figure out what happened? amy hollyfield, abc7 news.

two huge wildfires continue to burn out of control in far northern california. 79 squire mile fire called the chips fire threatened 900 homes in the national forest, 3500 homes if lie in the path of the ponderosa fire along the shasta tehama county line. it has claimed 50 buildings, including seven homes. calfire got a break when winds changed directions yesterday giving firefighters a chance to reinforce lines. he that fire is 40% contained more than 21,000 acres. >> governor brown is taking steps to eliminate some of the red tape in fighting fires. he has won approval from washington for a new fighting chain of command allows him to appoint a single commander from the california national guard to coordinate the military when they are

called in to fight a fire. right now the military operates independently. defense secretary panetta has signed off on the idea. police in oakland warning women to lock car doors while driving after a sexual assault. s have say a 25-year-old man was attacked last saturday stopped at a stop sign. a man opened her door, took her cell phone and drove her to an isolated area where he assaulted her. there's a $5,000 reward. anyone with information is being asked to call oakland police. jury deliberations expected to begin today in san jose over the patent battle between apple and samsung. billions are at stake between the world's biggest smartphone companies many people lined up at the courthouse to hear closing argumts yesterday the judge has asked both sides to come up with an out of court settlement, no now the jury has decide whether samsung trampled on billions

back in. they tell me it was a scary experience they still feel shakey some wondering if they will be able to go back to sleep. look at car that crashed this morning at college and ch anning on campus it broke a gas meter and came to rest -- came to rest at putnam hall. officials decided to evacuate that dorm. a couple hundred students had to evacuate. pg&e needed that gas turned off and engineers wanted to see if the building was structurally sound. this crash happened before 3:00 in the morning. students tell me they heard it and felt it. >> the lounge room we heard a large loud sound and the building shake. >> [ inaudible ] >> a been of people were running and screaming, crazy. >> reporter: police say the driver ran away of after the

crash but came back he turned himself in. they do have him in custody. they say he's okay, now they are trying figure out why he crashed. the scene now, l)y picture the car is gone, there's still evidence that something happened here. you can see the skid mark on the sidewalk and you can get a vision of how he came -- jumped this curb and came up into the building and that's where the gas meter was. we have seen officials gathered around this area trying to figure out if it is still okay and can be repaired. students are back in their building trying to get sleep, not going to get a hot shower any time soon the gas is still turned off. fire officials say that could be the situation throughout the day. hopefully, they will get a shower in sometime before tomorrow, that's when classes start. amy hollyfield, abc7 news. 5:31. state reinforcements sent in to help an out of control

wildfire the ponderosa fire has grown overnight in shasta and tehama counties. katie you just talked with calfire what are they saying? >> reporter: the woman tells me that i been getting more calls residents saying they are smelling stronger smoke at their homes she said likely due to overnight winds blowing the smoke and fire duncan beyond which is a typical evening phenomenon. the state and federal governments are sending more help as the fire rages on. governor brown has sent national guard troops to assist firefighters and fema is offering federal money. the fire has destroyed 50 structures, not known how many are homes crews haven't been able to get to every nook and cranny. 3500 more homes threatened in three communities unevacuation orders residents packing up

talking with witness to get a better description of the suspect so far all they have is that he was wearing dark clothing this is the city's 31st homicide of the year. chevron will open a new help center this morning to assist people affected bay the refinery fire while leaders shop for a better system to notify people of such emergencies in the future. the new help center will open at 9:00 this morning at north richmond senior apartments on fred jackson way until 7:00 in the evening. people can file injury and damage claims through stkaeurbgt the last day to file. -- through saturday, the last day to file. supervisors say they plan to reverse the company that provides reverse telephone alerts it took more than three hours to notify 18,000 people due -- the vendor is paid $90,000 a year, the company warns supervisors that swimming companies won't

necessarily improve performance because all systems redial calls that don't get answered. a driver dead following a fiery crash before 7:00 in martinez, suv rear-ended a car that stalled on highway 4 after the driver lost control and hit a guardrail. the collision sent the car down an embankment where it split in half and burst into flames killing the driver. two of the four people in the suv were hospitalized no word on the extent of injuries. the highway patrol is investigating. new poll of voters finds nearly 2/3 think suspended sheriff ross mirkarimi should be removed from office. 61% said he should be removed from office. % said no. 8% weren't sure. the poll was commissioned by a coalition of women active in san francisco, advocating for victims of domestic violence.

last night crews teamed up with wildlife specialists to catch it. marmots usually live in the sierra above the 6,000 foot level, unusual place for. they think this large rodent may have hitched a ride to san jose inside or under someone's vehicle. >> we are hoping that maybe somebody will come forward and say they saw this thing jump out when they got home. we would like to return him or her to her colony. >> a group plans to work with the rehab center near tahoe to release the marmot back to its native habitat in the sierra. if it was in the car, it would be hard to miss if it were underneath a long way to hang on. >> you would think, plus they don't have thumbs how can they hitch a ride. breaking news from the --
