berkeley eastbound near ashby at 13 accident blocking a couple of lanes i don't see it there is roadwork eastbound. we'll follow that. so far traffic flowing smoothly westbound on your commute direction towards the act arthur maze, no problem. stalled northbound 80 at bernal. eastbound highway 4 at loveridge closed detour in place. breaking news from oakland. police are investigating two shootings overnight. one wounded a child who is in the hospital in serious condition. it happened around 1:00 while the child was inside a home on macon road near i-880. the other shooting 11:30 sent three adults to the hospital on seminary avenue near oakdale. more information, terry mcsweeney is at the scene right now. he will have a live report at

the top of the hour. this morning martinez police still trying to figure out why a driver backed into a service station gas pump igniting a huge fireball. amy hollyfield is live at the gas station. >> reporter: you have to look at this picture first look what is left. can you believe that is a gas pump? can you imagine standing here pumping your gas when this happened? we have surveillance video you have to see this. it shows the moment when it happened. there were people here pumping gas. they say it was terrifying. a car hit the gas pump, igniting a fire. a man working here said he heard a loud kaboom. people living a few blocks away said they heard it. >> then started hearing explosions, we heard seven or eight.

>> i started yelling at everybody to get the hell out of here, big hazard. >> reporter: this is the driver of the car who backed into the pump. police say he told them he stepped on the accelerator accidentally, instead of the brake. this happen at 5:30 yesterday afternoon at the oil and gas station in martinez. the good and quite amazing news is that no one was hurt. amy hollyfield, abc7 news. this morning a veteran san jose firefighter is home from the hospital after suffering a heart attack while fighting a fire last month. 41-year-old frank ryan was released yesterday where he had been recovering. he collapsed as crews were tackling a tough three alarm fire at st. patrick church. ryan was in critical condition and did not regain consciousness for five days.

he received around the clock support from fellow firefighters who went to the hospital and raised money for family members. palo alto police alerting people to be on the lookout for a suspected groper getting more aggressive. latest inch tkfrpbt -- latest incident happened yesterday morning. a woman was jogging, the man grabbed her from behind, bear hugged her and tried to pull her down. investigators believe it is the same person who committed two similar crimes in the past month. police in moraga warning parents and students about what may have been a second attempted abduction. a stranger drove up to a student yesterday and offered him a ride. the boy said no and the man drove off. police say the same man was seen two weeks ago asking another student if he wanted a driver. driver white man, clean shaven looked to be college age,

driving brown pick-up truck with camper shell. vallejo mayor davis wants the city council to ask attorney general harris to investigate the death of a parolee shot by police. september 2nd, identifies fires -- officers fired the shots police say he reached for a weapon. it is the 7th shooting since may. defense davis says hope as independent probe will restore confidence in the vallejo police department. california's ban on foie gras will remain for now. a group wanted a judge to lift the ban until the courts rule. the judge refused. critics of the ban say it is too vague and intergears with interstate commerce. supporters argue the force-feeding of ducks and

berry farm in southern california on a ride called the windseeker the ride came to a stud stop, engineers manage today to lower the ride and get the 20 people off safely in is the second time in 12 days the ride has malfunctioned. knott's berry farm trying to determine what went wrong. bart moving forward with expansion proposal that many hope will ease congestion on i last night a public meeting was held to discuss the report. the station would run five miles east of the current end of the line station in dublin. officials estimate the extension could get 20,000 commuters off the roads on to bart. but estimated the project would cost 1.2 billion dollars. in november, voters will have a chance to boost odds of the plans staying even track. >> expensive project if measure b-1 is approved by

near six day long the coast, 60s bay, 70s inland cloverdale, clear lake east bay valleys some areas could get around the low 80s. across the country mild east of the rockies, 60s and 70s dallas 92, phoenix 104 mid 70s seattle and portland. we hardly have any wet weather to speak of. swirl of air around the great lakes is going to make for a bumpy ride traveling across the country but everybody on trim. -- on time. republican presidential candidate mitt romney returns to the bay area for a fundraising visit tomorrow. private $50,000 per person event set to take place at strawberry hill estate in hillsborough. romney was in the bayary july attending fundraisers. -- in the bay area in july attending fundraisers.

speed. romney and ryan head to ohio monday for a three-day bus tour. tahman bradley, abc news, washington. federal law that defines marriage as union between man and woman is likely to come before the supreme court before the end of this term that's the opinion of justice ruth bader ginsburg. in a session with students a question came up about the federal defense of marriage act. she smiled and said she couldn't answer because the measure is likely to come before the court this term. federal judge in new york has already declared that law unconstitutional. nfl fined alex smith $15,000 then retracted it, his offense, wearing a san francisco giants cap in a post-game news conference last season. here he is with the cap. the league says players aren't allowed to wear any team logo not affiliated with the nfl in the first 90 minutes after a
