>> announcer: abc7 news starts with live breaking news. good morning i'm kristen sze. i'm eric thomas. that breaking news we first brought you at 4:30 back-to-back back shootings in oakland injured four people, one a sleeping boy. >> terry mcsweeney is live in oakland. you found out why the casualties could have been higher? >> reporter: it could have been far worse nine people sleeping in this house near 98th avenue and 880 not far from the airport. gun fire from outside rings out 1:00 this morning.

one person hit, 11-year-old boy. take a look at this house we are talking about. this is on macon road, 880 and 98th avenue we counted at least 15 bullet holes outside of that house one went through two walls an indoor and hit 11-year-old luis hernandez in the chest. the bullet was slowed by the walls and the door. the boy is expected to be okay. his family says when he was hit, he got up and started running around the house screaming and he said, i can't do this any more, meaning he was on the verge of collapsing. they tried to keep him on his feet. inside his two sisters, he has two uncles being, parents, two brothers, -- none hit, one sister, four months old. his brother francisco described what it was like in that house. >> out of nowhere i heard like loud noise like big fireworks, but it wasn't. i heard my uncle saying get

down. i got down i guess my brother didn't get down they were shooting inside my mom's room and they went through the door and it hit the wall where my brother was sleeping and he got shot on the chest. >> reporter: again, 11-year-old luis hernandez hit in the chest, but expected to be okay. picture of him from a few years ago. the family says, they do not believe in any way, shape or form that house was targeted that somebody was walking down the sidewalk or possibly driving by a car and opened fire on that house. again, at least 15 bullet holes went into that house, through walls, went into a variety of places but did not hit any of the other eight people sleeping there. the only one hit luis, in the chest and he is expected to be okay. live in oakland, terry mcsweeney, abc7 news. 5:32 now.

insurance adjusters and repair crews will be the only ones using a martinez gas station today after it was damaged in an explosion and fire ignited by out of control car, all caught on video. amy hollyfield is live at that gas station with more. >> reporter: you've got to see this. check out what used to be a gas pump. you can barely recognize it now here at this gas station. people say it went up flames so fast and it was so scary. now take a look at this, the moment that it happened. it was captured on surveillance video, a car backing up to the pump and hit. the man who was working at the gas station said he heard a very loud kaboom. those who were up ing say it was terrifying. the fire not -- not only burned the station, also two cars that were trying to get gas. the owners of those cars took off running. our reporter alan wang caught

up with the driver who hit the pump. >> reporter: can you tell us what happened? >> accident, i don't know. >> reporter: did you lose control? was the car functioning properly? >> i don't know what happened. >> reporter: police later said that the driver told them that he accidentally hit the accelerator instead of the brake. police say it doesn't appear that alcohol was a factor. this happened at 5:30 in the afternoon yesterday in martinez on alhambra road. the good and amazing news is that no one was hurt. amy hollyfield, abc7 news. this morning a veteran san jose firefighter is home from the hospital after suffering a heart attack while fighting a fire last month. 41-year-old frank ryan was released yesterday where he had been recovering since august 30th. he collapsed as fire crews were tackling a tough three alarm fire.

ryan was in critical condition and did not regain consciousness for five days. he received around the clock support from fellow firefighters who went to the hospital and raised money for his family members to fly to san jose. palo alto police added patrols and sent out uncover officers to search for a man they suspect of attacking three women. latest incident happened yesterday morning on palo alto park the woman was jogging when a man grabbed her from behind and tried to pull her down. police alerting visitors and have posted fliers. this is different in a sense it is more isolated, at a time of day where there aren't as many people around, very little possibility for witnesses to see what happened. >> they believe it is the same person who has committed two similar crimes in the past month groping women at the stanford shopping center and fulton street.

a mayor wants the city council to ask attorney general harris to investigate the death of a parolee shot by police. offered fired 30 shots killing mario romero and wounding his friend as they sat in their car. police say romero reached for a weapon. the shooting sparked several angry protests. california's ban on foie gras will remain in place for now. a group of restaurant owners and producers wanted a los angeles judge to lift the ban until the courts rule. but the judge refused. critics of the ban say it is too vague and interferes with interstate commerce. supporters argue the force-feeding of ducks and geese to enlarge lives is animal cruelty many series of i-team investigations led to the ban which went into effect last july 1st. california's planned high
