>> good morning, everyone. thanks for joining us. i'm carolyn tyler. let's start with a quick first look at our weather with meteorologist frances dinglasan in for lisa argen. >> good morning, everyone. here's looking out toward the bay bridge, san francisco and the low clouds in the distance. we've seen some sprinkles during the morning hours. temperatures right now in the 40s and live doppler 7hd tracking the storm over the last few hours, starting to exit the bay area, moving southeast. but during the morning hours we will still get a chance of sprinkles. looking pretty dry right now for the most part. just some cloud cover in the north bay. let's head to the east bay where we are getting light returns and light rain through parts of emeryville right now. i-5 and 580 is where we are

getting some light rain. south bay we are starting to see some rain move down toward gilroy. there was some rain earlier in san jose but that's starting to clear up, as well. look for some light rain, as well, over 152. now we will start to see some breaks this afternoon, but rain is in the forecast again this week. i'll let you know when with the accuweather seven-day forecast coming up. carolyn. >> thank you, frances. the national hockey league lockout is coming to an end after 113 long days. negotiators reached a tentative deal in the we hours this morning. abc7 news reporter kira klapper joins us live outside san jose's shark tank. kira, i know fans and nearby businesses have to be rejoicing. >> absolutely, carolyn. no doubt they are rejoicing. sharks fans have been doing without their beloved team since the lockout began september 15th. of course, downtown businesses have taken a hit. they have lost a ton of business in the last three and a half months.

and even though it has taken nearly four months, one long night last night may have changed it all. league and union representatives met face-to-face with a federal mediator in new york city for 16 hours. it was a marathon negotiating session that stretched from yesterday afternoon until, as carolyn mentioned, early this morning. they have agreed on a ten-year deal that irons out pension and revenue issues. but before hockey can be resumed, the contract has to be approved by the majority of the union ownens and a majority of 770 players and votes. gary bet man explains what happens next. >> we have to go through a ratification process. the board of governors has to approve it on the league side. obviously the players have to aprove, as well. we're not in a position right now to give you any information about schedule, when we are starting. >> both sides were up against a

january 11th deadline. that's this friday. if somehow a deal isn't ratified which then, it would cancel the season outright. but, of course, the new deal is expected to be approved and the commissioner says a 48-game season and the stanley cup playoffs will, in that case, be salvaged. reporting live in san jose, kira klapper, abc7 news. >> and they could start playing as early as later this month, kira? >> yes, exactly. >> all right. thank you. we have some developing news this morning. a 22eer old man is dead following an early morning crash in san jose. it happened after 2:30 this morning on south first street under the 280 overpassing. police say the silver bmw swerved, hit two light poles and rolled over. an officer stationed around the corner heard the crash but when he arrived the driver was already dead. police say it will be difficult to pinpoint the cause of the crash because apparently there are no witnesses, which is rare.

>> they will try to get a speed on the car, try to see, recreate how the accident happened the best we can. but with no witnesses it is very difficult. >> the coroner's office will conduct an autopsy to determine if alcohol or drugs were involved. the car will be taken to a police facility where investigators will brick it down to try to answer questions for the driver's family about exactly what happened. a 16-year-old girl shot last night near a high school in milbrae is hospitalized in stable condition this morning, according to a san mateo county sheriffs spokesperson. around 10:30 last night the teenager from south san francisco was shot in the stomach and leg in front of a home right across the street from cappuccino high school. officers were on scene late last night. they were gathering evidence and looking for suspects, but so far no arrests have been made.

oakland police are investigating a a shooting that left two people injured. police responded to 68th and mccarver boulevard yesterday of a neighbors reported hearing gunshots they said a local cable technician ran to her for cover after the shots were fired. >> comcast was here he said can i come in and he came in and jumped on the floor. >> and the kids? >> my kids were already on the floor. >> a short time later police responded to a car crash less than a mile away. investigators believe that is where the victims crashed their car catch being shot. two men in the car managed to take themselves to the hospital. their injuries are not considered life-threatening. new this morning, sonoma county sheriff's deputies are look for a hitchhiker they say stabbed a driver who gave him a lift last night.

that was near gurneville. the santa rosa press democrat reports the driver had a child in his car when he picked up that hitchhiker near the stump town brewery on river road, and it happened around 7:30 last night. now investigators are not sure why, but say the hitchhiker stabbed the driver twice before i was able to get him out of the car. the deputies say the suspect is known locally but only by a nickname which they are declining to release. vallejo police are offering a $10,000 reward to catch the driver of a honda civic that hit and critically injured a pedestrian on christmas eve. the unidentified 54-year-old vallejo resident was crossing broadway street at hogan avenue when the incident occurred. the driver ran from the crash and an all-out search and underway. just three weeks after the sandy hook elementary massacre a gun show was held not far from the city of newtown. there was pressure from newtown officials to not hold the show, but organizers say this is how they make a living. some gun shows an hour away from

newtown cancelled or rescheduled. gun dealers everywhere report strong sales since the november election and specially since sandy hook. >> a piedmont man's young daughter has motivate the him to get guns off the street. her reaction to the sandy hook incident prompted him to start his own cash for weapons program. we explain. nicky jordan lives in piedmont. she's actually glad she's alive anywhere. >> one of the girls who didn't live in the husband got out the gun and put it to my head and pulled the trigger. >> that happened when she was ten. she said the girl laughed, saying the safety was on, then 17 years later she said her brother was shot by his best friend. >> my brother was shot through the head so i never got to see him again, and i raised him and it was the most horrific experience of my entire life. ripped out my heart. >> tom said he wants to prevent what jordan experienced from happening to anyone.

he has a ten-year old daughter who attends a school in piedmont. after the sandy hook shootings she told her dad what happened in class. >> she told me she was crying in school and she didn't know why. and i just put two and two together so i knew it was affecting her. >> he said he decided to start the kind of gun buy back program like the ones in san francisco and oakland last month. >> now she's calling this the gun drive and she's all behind it and is excited that we are collecting guns. it's really doing the job i wanted it to do, make her feel like we are doing something which i hope we are. >> piedmont isn't a high crime area but he's gotten attention because he's donated $1,000. he will pay $200 per gun surrendered. >> i think it's an incredibly generous offer. i think certainly, you know, we have to think about the safety of our children. >> piedmont councilman jeff wheeler said the city has a voluntary gun collection program which has collected 37 weapons in the past five years. if the plan works out with the police and city officials, he

says it should be adopted. >> we certainly don't want to have criminals breaking into homes and getting a hold of guns. that can happen. >> in piedmont, thomas ramone, abc7 news. >> coming up next, a happy reunion. a woman together again with her doing more than two months after super storm sandy. why animal rescue officials are putting out an urgent call for help. and the peninsula community comes together to try to

including her house in hurricane sandy. >> to lose possessions is one thing but to lose your family is horrible. if it wasn't for them i don't even want to think what would have happened. >> she had no way to care for midnight and her kitten, keri. then she found this place. >> they basically saved my family. >> a temporary boarding facility for four-legged victims of sandy. they reacted quickly, starting up the shelter, helping nearly 16,000 animals in sandy-affected areas. yesterday there were 19 happy reunions. but there are still 130 displaced pets at this emergency shelter waiting to be claimed. >> at some point it's not the best environment for a pet to be in an emergency facility. >> as time ticks on, these cute animals can't remain in these cages. >> the ultimate goal being to get them back home with their families, but if that's not possible, then it's to get them into a foster where they can at least start feeling that sense of normalcy, being with family

members. >> robin was living in rockaways in queens, new york when everything she owned also got washed away. she hopes to bring her two dogs home in the next two weeks. >> when i'm able to bring my girls home, it will be christmas, new year's and my birthday all in one package. >> abc's john reporting. more news back here at home, fans after popular peninsula ice rink are rallying against a plan to close it. the ice center of san mateo is slated to close on june 1st. the landlord wants to transform the location at the bridge point shopping center into more retail space. but long-time fans of the rink are petitioning the landlord for a change of heart. i mean, it's where most of our skaters, they come here almost every day. their parents drop them off. they feel safe here and for most of our skaters they are sad. they aren't sure what they are going to do, what their coaches are going to do, where they will

january 6th. we have a live look right now at the golden gate bridge. traffic very light so far this morning. you see one or two raindrops on the camera lens there, but those are leftover drops from a storm that has come and gone. frances dinglasan is here now with more on the accuweather forecast. >> yes. we are waking up to camp weather. i'll show you another live shot of the low clouds still lingering over the bay area and bringing us a chance of morning showers. in fact, we go to live doppler 7hd to show you this storm tracking south down past monterey bay heading toward central california, taking the areas of green, the areas of rain with it. as you see it's moving south now past san jose. so it is looking pretty dry right now for the north bay. i don't expect any more rain there today. we are still seeing some pockets of light showers and light rain in livermore, along manning

road. as you head here along 580 and tesla road and also some light showers right now heading towards watsonville and along 101 south of gilroy into hollister. so we will be keeping an eye on the storm for you, as well. temperatures in the 40s, 47 in san francisco. so it's quite a mild start. 47 in mountain view and 46 in san jose. so we still might see a lingering shower during the morning hours. i'll show you where you can expect them. then we will trial get some afternoon sunshine today. dry and warmer monday and tuesday. but there is some more rain on the way. i'll tell you when in just a minute. here's the area of low pressure heading down toward central california, taking the rain with it. that will take away the showers by this afternoon. we have high pressure building over the pacific giving us some nice, warmer dry weather monday, into tuesday. our forecast model does show that we could still see some showers as the rain whips around

in a counter clockwise motion and continues to move south. so we could still see some in the east bay just light rainfall into lunchtime. then after that it's looking pretty clear. we have some partly cloudy conditions. but sunshine, as well, this afternoon. rainfall totals. this kind of tells the story of a storm that just kind of slid south along the coast. so the north bay got over .3-inch in santa rosa, san rafael. oakland about a quarter of an inch and san francisco over .3. but redwood city only goat .0107 and host the rain was along the coastal mountains. today your highs will be in mainly the low 50s. 53 in san rafael, breezy condition along the coast. 54 oakland and look for 54 in san jose. more low 50s around monterey bay with 53 in watsonville, 54 gilroy. here's the accuweather seven-day

forecast. just a few spotty showers mainly south of the golden gate later on this morning. so north bay you are pretty much dry. then sunshine and mostly sunny conditions monday. temperatures coming up on tuesday into the low 60s. okay, there's that chance of rain wednesday late into thursday. still looking like a fairly weak system at this point, but then dry again for friday and saturday. >> you said the temperatures are above normal that we are looking at? >> right now we are near normal but they will be above normal on monday, and tuesday definitely. >> thank you, frances. this morning lance armstrong's attorney is denying reports the former cyclist is planning to admit to doping charges. >> in a follow-up story the times says the u.s. anti-doping agency could use armstrong's admission to go over other cyclists suspected of using performance-enhancing drugs.

in maryland. the obamas returning from their rayian holiday which was interrupted by the fiscal cliff negotiations. president obama's weekly although address repeated that he will not negotiate raising the debt limit to raise bills congress has already racked up. you may recall last year that resulted in the nation's credit rating taking a dive. and the congressional debate over taxes versus spending is anything but over. we are talking about looking at the tax code, putting everything on the table from the standpoint of closing loopholes. and we know that we can do that. special subsidies for big oil, for example, $38 billion right there. >> and meanwhile republican leaders coming off the fiscal cliff agreement feel the issue of taxation is now resolved and it's time to focus on reducing the federal deficit by spending less. senate majority leader mitch mcconnell made that clear this morning when he appeared on

abc's "this week" with george stephanopoulos. >> the tax issue is finished, over, completed. that's behind us. now the question is what are we going to do about the biggest problem confronting our country and our future? and that's our spending addiction. it's time to confront it. the president surely knows that. he has mentioned it both publicly and privately. the time to confront it is now. >> tensions within the republican party have penetrated the highest levels in the gop leadership with anger over dozens of republicans who supported the tax increase as part of the fiscal cliff agreement. pocketbook issues closer to home. if you are planning to be in san francisco today, be prepared to pay to park. new rules take effect today with drivers who fail to feed the meters on sundays getting warnings for now and later hefty tickets. we have the details.

ed high noon will mark the end of free parking on a sunday in san francisco. for the christian community, it's not a welcome change. >> so many people have left the city because it's such an expensive place to live and their only connection with the city is their congregations. >> he said sunday metered parking is another hurdle for members of some congregations. the end of what would otherwise be a free day in the city. he said he also has concerns about the way the decision was made by the san francisco mta. >> at the outset, it came to our knowledge after the fact that there was a stakeholders group that really put this and implemented this policy. it was not the voice of one member of the faith community around that table. so we see it as a real gross infraction of due process. >> paul rhoads, a spokesman, said the safe community was a strong voice in the meetering process. because church services often start in the morning, the mta decided to limit when they will start charging.

>> all of the meters won't start enforcing until noon and that will last until 6:00 and all the meters have a four hour time limit. no citations are issued for the next three sundays. instead enforcement officers will issue warnings. this is a program that will expected to bring in about $2 million a year, but the mta said it was all started because of complaints that some drivers take up some spaces all day long. >> so this is something that is really meant to ensure that parking is available for people who come into san francisco. this will make it easier for visitors to come into san francisco and find a parking space. >> up until now there's only been a handful of parking enforcement officers assigned to sunday duty and they usually only deal with parking complaints. but because of sunday metered parking now, they said they will likely have to assign more officers. in san francisco, abc7 news. oakland police show off a new strategy for combating gun violence but do they have the manpower to make it work? abc7 news reporter mark matthews

has the story from a neighborhood that has seen more than its share of shootouts. >> at 84th avenue and dowling this was the sound neighbors heard new year's eve. the sound of a gun fight reported by shot spotter mike phones and able to find the cars from the response team. >> the particular case is an alert came in and less than 22 seconds. >> the quick response led to arrest of a man armed with an assault weapon loaded with 100 rounds of ammunition. >> goes to show given technology and the right amount of resources in the correct direction we can make a dent in violent crime. >> two hours after taking this gun off the streets, the shots spotter team arrested two more men armed with another assault rifle. that one night they had 200 shots spotter alerts within two hours. >> if i had more people i think our chances of apprehending many of those would have been a lot higher. >> that's one of the big

challenges facing the department. in 2010 oakland laid off more than 100 officers. new year's eve was the first time the shot spotter response team had been on the streets in six months. >> it's great having technology. but you have the technology and we don't have anybody to respond or respond correctly, we around -- are aren't going to catch the guy. >> oakland's mayor said she wants to build up the force but residents say the answer isn't just more police. >> i just think it's bigger than that. >> she said gun violence and crime in her neighborhood is a complex problem. >> it's going to take more than just police. more of like a rebuilding of oakland. >> we talk about more cooperation from the community with police, more police who know and understand the people who live in their patrol areas and more jobs as an alternative to gangs. jobs is what the mayor of oakland was talking about. that was in a closed-door public safety meeting. she said she wants 100 officers a year graduating from the police academy and she wants

those numbers sustained over the next five years. at police headquarters in oakland, mark matthews, abc7 news. >> until any new cadets are ready, the effort to put more patrols on the streets of oakland could come from a controversial plan being talked up at city hall to spend half a million dollars to hire ten alameda county sheriff's deputies plus a sergeant. this comes after city leaders laid off oakland police officers to save money. today san francisco chronicle reports the oakland police officers association objects to spending the money on outside help. police union president said the money should be used instead to hire more oakland police officers right now. new this morning a taxi cabdriver is hospitalized in stable condition after being stabbed by a customer outside of the bart station last night.

police say the man got into a cab at a taxi stand outside the bart station on 40th street just before 7:00. the two got into some sort of argument and that's when list say the man stabbed the driver, then ran off. the petaluma city council starts the new year tomorrow with a formal vote on a new anti-smoking ordinance. in december the council tentatively approved a ban on smoking in places including all hotel rooms, private apartments, condos, outdoor spaces, including balconies, court yards, bus stops and on commercial sidewalks. the tough new regulations are intended to protect people from the hazards of second-hand smoke. the santa rosa press democrat reports petaluma's ordinance slightly more stringent than a sonoma county ban pass bid supervisors last year. now the san francisco's exploratorium is moving to a new location on the embarcadero. the city's recreation and parks department is look for a new tenant for the old location in the marina district. the 80,000 square foot building at the palace of fine arts rented for $490,000 a year. it could take a year or two to

find a suitable tenant with requests for proposals going out this spring. the san francisco chronicle reports the rec and park department wants to keep the theater in place but leader of the maybeck foundation will analyze potential new uses for the facility. coming up, the provocative bay area bus ad that is raising some eyebrows. what it has to do with the real meaning of the word jihad. also here is a look at live look from our roof cam. showing you the bay bridge there in the distance. if you are driving along there, no need to turn on the windshield wipers. we did have a bit of a rain storm this morning, but that has moved on. frances dinglasan will have your forecast in just a few minutes.

think. it's a campaign to try to educate residents about the real meaning of the word. it began in chicago. it's now reached the bay area. abc7 news reporter explains. >> my jihad is to stay fit debite my busy schedule. what's yours? that's the statement on the side of this muni bus. it's part of an educational campaign created by c.a.r.e., the council on american islamic relations. the group has put 35ads on buses rolling through san francisco. >> the intention of the campaign is to educate our fellow americans about what the word jihad means. >> she is the executive director of c.a.r.e.'s bay area office. >> a common misconception of the word jihad is it means armed struggle or holy war. and that is something that has been perpetrated by many who have made careers out of pushing anti-muslim sentiment. >> i asked muni riders if they knew the definition of jihad. >> religious war. >> a holy war. >> webster defines it as a holy war, but there's a second definition that is more

welcome back. we want you to see all the snow there and realize that chains are required on i-80 and at 50, as you head to tahoe. how are they doing with their snow total? >> they are doing really well. they had light snow this morning and still a chance after couple inches mainly south of i-50 later on today. but scattered snow showers in the afternoon. for us which are starting to see just more cloudy skies, less rain right now. that's been changing quite a bit in the last few hours as we look at the live view in san francisco of coat tower on telegraph hill. with live doppler 7hd you can see we aren't picking up much rainfall right now north of the golden gate, even north of the san mateo bridge. the rain is mainly confined to the east bay and south bay. picking up a little cell just over here and 101 on fully road.

so that rain might be reaching the ground. also light rain over watsonville, 101 and along 101 from gilroy to pruneville. but for most of us it's looking fairly dry. also if you are heading to the tahoe area, bring your chains, as carolyn mentioned. they are still expecting some scattered snow showers into the afternoon with some snow mainly south of i-50. temperatures in the 40s. 47 san francisco, 45 in concord and 46 in san jose. look for upper 40s, as well, if you are heading out the door shortly around monterey bay, 47. morning showers are still in the forecast. spotty, though. this afternoon we will see sunshine but we have dry and warmer weather in store for us for the beginning of the work week monday and tuesday. so here's why. the storm system headed south toward central california. then we have this area of high pressure bringing us the drier

days into wednesday. things change, though, wednesday night. the forecast model, i'm just showing you this because there's still a chance of a light shower in the east bay down towards monterey bay. but then by this afternoon it's less likely and we will see just some partly cloudy conditions but also some clearer skies with some breaks of sunshine. temperatures will be in the 50s. lock for low 50s in san francisco and san rafael. 54 santa rosa, 54 in oakland, as well, and in san jose. it's actually a very narrow band of temperatures. more mid-to low 50s around monterey bay. could be breezy along the coast, 54 santa cruz. now overnight lows, not as mild as this morning. but there will be much more comfortable than what we experienced last week. temperatures in the upper 30s and 40s. 46 the mild spot in san francisco, 41 in richmond. look for upper 30s tonight in napa and fairfield and also in morgan hill. here's the accuweather seven-day

forecast. so the showers, there is still a chance of them this morning, east bay, south bay. this afternoon partly sunny conditions and sunnier on monday. temperatures climbing up above average on tuesday into the low 60s. a chance of showers, have your umbrella ready wednesday night into thursday and then dry again friday and saturday. >> but as you mentioned last week the nights were so cold. >> yeah. we had a real cold snap last week. i think it will be milder the next few nights. >> thank you, frances. whether it's from overactivity or improper technique, a growing number of young athletes seem to be falling victim to repetitive motion injuries. medical experts say there are ways to prevent long-term damage. here's abc7 health and science reporter carolyn johnson. >> good left-handed pitchers are hard to come by. but ten-year-old ei don't know can also bat, catch and even play soccer well. >> i love sports. >> but in may playing pitcher and catcher nearly cost him his

throwing arm. repetitive motion coupled with year around play mean little rest and recovery for young athletes. that increases the use of overuse injuries. his left elbow was on fire. >> it hurt pretty bad. >> he was in what's called a sidearm throw. he kind of drops the elbow to get the three through instead of bringing it nice and through kind of overhand getting the elbow up and around. >> the doctor at children's hospital, los angeles, treats both children and professional athletes. the sensor are tracking his precise movement patterns. she will then use motion analysis to make at judgments to his technique. >> our main goal is to work to identify these issues before an injury happens. >> he know knows how to protect his elbow but his results show he's in danger of a future knee injury. they will show him proper running, jumping and stopping techniques. >> other tips, don't play through the pain. stop and rest. make sure you are hydrated.
