went back to the laundromat and he doused her and set her on fire. >> the governor will hold a news conference in sacramento to discuss improvements to mental health care in prisons and overcrowding. officials asked judges to modify an order capping the number of inmates that can be held prisons because they want permission to house 6,000 additional inmates. they say if this is rejected, dangerous felons could be released early after the panel blamed overcrowding for violations of inmate rights. >> the f.b.i. is expected to resume excavating a well in a search for victims of the speed freak killers. agents are taking over the search at the qualify the sheriff. heavy machinery will be used to cover soil but most digging is done by hand. the remains of five people have been found in the area, all

dispensary that calls itself as the nation's largest has won another round to stay open amid a federal crackdown. a judge in san francisco refused to order the health center to stop selling pot while the government tries to prove the establishment is illegal and must close. the landlords in oakland and san jose argue they remain at risk as long as pot is sold on their premises because the u.s. tone has threaten the to seize the properties. the city of oakland is suing federal prosecution saying they promised to leave the dispensaries alone if state and local laws are on bayed. >> oakland international airport officials are looking to make a fix on a section of runway more permanent. a pilot reported an issue on the 10,000' long runway yesterday that led to a shutdown for two hours. an operations crew found a small section of the pavement cracked

and fallen apart creating a hole 2' in diameter and 4" deep. there were no flight cancellations and only slight delays with planes taking more time to taxi. >> and now nonstop service between the bay area and tokyo, but the boeing 787 dreamliner used by the airline is facing new safety concerns. an electric fire on a three week old 787 in boston yesterday delayed the jet as the jet was being serviced shortly after passengers and crew got off. recently electrical and power problems forced emergency landings in texas and new orleans on other 787's. starting friday the dreamliner will fly nonstop five time as week between san jose and tokyo. >> it is 4:37. a "spare the air" day the third in the winter season.

the air quality management district says stagnant air will trap smoke and other pollution near the ground and that means trouble for people with breathing problems. officials recommend bicycling or walking rather than driving and there is a ban on burning wood and wood products in fire places, stoves, or outdoor fire pits. repeat violators face fines up to $500. >> and "spare the air" is good and now, folks, guess who is here? >> it is cold out there, the air is just being compressed because of high pressure and all cold air is cooling near the surface, so that is why we have a "spare the air" day. 38 right now in santa rosa, san francisco is 47 and 38 in livermore and 39 in antioch and 44 in san jose. the big problem this morning is

pockets of dense fog. less than a quarter mile in fairfield and novato and this is just moving around and shifting to the southeast locations as we move through the morning. morning fog. temperatures urgely in the 40's. warmer by lunch into the 60's. partly cloudy overnight tonight. it will be warmer for your tuesday today and then we start to cool it down with a chance of a few sprinkles north on wednesday and cold showers on thursday. >> right now we have light traffic conditions out there with no major problem advisory. the toll plaza at the bay bridge you can see it fog free and light traffic. no problems as you head to the upper deck into san francisco. san mateo bridge we have bunching up on the flat section moving to the high-rise but it is smooth sailing between hayward and foster city.

>> as we always are when the balloon is being dragged. >> hope that is not a bad omen. >> "spare the air" is possibly an omen. >> tomorrow the air quality improves. we have dense fog an the bay area but not as widespread this morning as kristen said. the national weather service canceled the dense fog advisory posted for this morning. that is a sign we are seeing improvement. beautiful shot there as we look live from the rooftop camera toward the financial district in san francisco. out the door, 39 right new in napa. you are going to find temperatures across the bay area, 44 in san rafael, and 47 in san francisco, and mountain view down to san jose seeing patchy fog with temperatures at 44 and 41 in los gatos and antioch is at 39. the visibility is trying to improve.
