why officers shot him. a major crime task force made up of several napa county police agencies is conducting the investigation. we will bring you more information as it becomes available. today marks a sad anniversary in morgan hill. it was a year ago when sierra lamar went missing on her way to school. despite her searches for her, there is no sign of her body. >> this morning the family will have a balloon release to mark the hard breaking anniversary and follow that volunteers will hit the grounds searching for the teenager just as they have done every saturday since she vanished one year ago. it happened on march 16th last year when the 15-year-old was on her way to school but never made it to the bus. despite countless searches by

law enforcement and volunteers, there is still no sign of sierra. but in a field just yards from her school bus stop her clothes were found folded neatly in a bag. in may of last year a 21-year-old man was arrested ard charged in her abduction and pushed. still her father tells abc news he's holding out hope she is found alive. the sheriff's department said a homicide. as a parent i'm not going to believe that until i know for sure. >> this is a case that you might imagine still has a lot of public interest. the santa clara county sheriff's department told abc7 news they are still getting tips every week, between 15 to 20 tips, and some of those calls sometimes come from as far as across the country. reporting live, kira klapper, abc7 news. >> thank you, kira. a violent bank robbery suspect

who was released from jail in richmond is the subject of an fbi manhunt this morning. police are confident they arrested the right man, but the man had to be released because authorities missed a deadline to charge him. abc news reporter allen wong explains why he is feared even more now. >> police say this is 22-year-old gary casdell fite jr., he jumped over the countter in pinole, stuck a gun to the teller's head and made off with more than $3,000. he was quickly arrested but was back on the streets just three days later because of a missed deadline. law enforcement has 72 hours to file charges after an arrest or the suspect is released. the workday ends officially at 5:00 p.m. fite was arrested at 4:56 on friday, which means the district attorney had to file charges by 5:00 p.m. on tuesday. for some reason they thought they had until wednesday. the contra costa county

sheriff's department said fite did not have any outstanding warrants, so they had to release him. >> they shouldn't have let him go. if you rob a bank, there's evidence. why? >> inefficiency. it's totally irresponsible. totally irresponsible. we have enough crazy people around. >> the senior deputy d.a. for contra costa county told abc7 news we took the time because we thought we had the time. the pinole police chief said his department was aware on our deadline but on our end we should have been more definitive to push the time issue and we didn't. now the fbi said it's urgently trying to recapture a man who could be dangerous, desperate, and willing to fight for the freedom that was mistakenly handed to him. police say gary casdell fite is 5'8", 180 pounds and he has ties to oakland, vallejo, antioch and reno, nevada. reporting from the west county detention center in richmond, i'm allen wong, abc7 news.

>> new this morning, two east bay police agencies are trading cash for guns today. fremont police are holding a gun buy back for residents of fremont, newark and union city and pittsburg police will buy guns from pittsburgh or bay point residents. proof of residency is required. up to $200 will be paid for rifles, shotguns and handguns. assault weapons are forth $300 until the money runs out. those events take place from 10:00 this morning until 3:00 in the afternoon. the fremont event will take place at the fire department training facility on stevenson boulevard. the pittsburgh event is at city hall on pacific avenue. guns must be unloaded and transported in the trunk of your car. in pinole police are investigating a scary attempted kidnapping that happened in

broad daylight. a twelve-year-old girl told her a man asked her if she wanted a ride when she walked home from school yesterday afternoon. when she said no she claims the man grabbed her wrist but she escaped. the man is described as young, thin with short hair, a brown gotee, and a piercing in his right eyebrow. the state department of social services has shut down a livermore daycare center pending on investigation. livermore police say the sunnyside preschool is closed for licensing violation. social service officials were at the school yesterday and a notice on the front door now says closed for business. the notice sites health and safety code regulations concerning the protection of children from physical or mental abuse. police in union city are warning bankcard users to be aware of suspicious card readers. a sophisticated system to steal pin numbers was discovered at the citibank on dakota road this week. a customer noticed something suspicious about the card reader which was at the door that allows access to an indoor atm lobby.

police found a pin reader installed on the inside of a false face plate attached to the system. they warn they target gas stations, atms and anywhere card readers are used. a missing scotts valley man has been found in a utah library. salt lake city police say matthew austin abraham is now in their custody and undergoing a medical evaluation for a severe injury. this is an image ever him from a surveillance camera after he was dropped off. this is where he was found. he and someone he met on the bus were trying to find out who he was. >> he had a couple different names that he thought he might be so there was some confusion

about his identity. this person helped him, went to the library, they did some internet research and were able to find a news article from california matching one of those names that he thought maybe who he is. >> the two contacted a police agency here and authorities then got in touch with salt lake city police to verify abraham's identity. a defamation lawsuit against a san francisco sheriff's officer ross mirkarimi reemphasize my and his wife was dismissed. it was filed by a neighbor. they claim mirkarimi and his wife, falsely accused them of various crimes last year. madison triggered the investigation by giving police video she took of a crying lopez and a bruised arm that lopez said resulted from a fight with mirkarimi on new year's eve. lisa argen is joining us now with a look at the forecast. a very important forecast because there are outdoor and st. patrick's day festivities today. >> yeah. we have plenty of fog out there now, reducing some visibility around the bay. here's a look at emeryville where the temperatures are pretty mild, in the low 50s. going for a high today in the

reduced, but within the next, oh, 72 hours or so we will be picking up some returns. we have rain on the way for the beginning of spring. on wednesday the vernal equinox and we will look for the rain to continue really starting on tuesday into wednesday. right now we are looking at cool conditions up in santa rosa and napa. low to mid-50s with upper 40s in fairfield. it's 50 hayward. pretty mild there. los gatos 49. you see a little fog down on the deck there at the bay bridge. elsewhere san francisco we are looking at lower 50s to mid-50s. oakland 52. san carlos 50. we have a little bit of fog on the peninsula. 50 santa cruz. the fog will linger at our shoreline for quite some time but then we will get into the sunny skies at our beaches. partial sunshine, i should say. elsewhere the patchy fog should last through about 8:00. maybe a patch over the east bay through 9:00. and then we will have breezy condition the rest of the day.

more sunshine for st. patrick's day, the official day. although the parade and many festivities are today. here's a look at visibility. a quarter mile in livermore, half moon bay three miles. you notice from san carlos, mountain view and san jose, not bad, but we have the cloudy skies there. we are looking at low pressure to the east of us. high pressure off the coast. this setup brings the breezy conditions and still the jet stream, a little bit of rain well to the north. eventually that will be pushing to the south and we will get a look at the wet weather system heading our way into tuesday. but dry conditions for the weekend. so if you like it sunny and you have some plans, outdoor plans for the weekend, it should be a good couple of days. we will start our computer animation tonight. you will notice that the clouds to the north and the rain up in oregon stays to the north. once again we will break out into sunshine and breezy conditions right on through the afternoon on sunday.

so expect high temperatures today around the bay ranging in the upper 50s half moon bay. 70 for our friends in san jose. vallejo, 68 in san francisco. of course, st. patrick's day celebrating today downtown with all the green. as you head on through your morning hours the fog lifts here, 11:00 59 degrees. 64 at 1:00 and by 3:00 we will reach our high temperature with sunny and mild conditions, mid-60s. 62 for about 5:00. so looking at the next several days, keeping the low 70s in the forecast. increasing clouds on monday. tuesday and wednesday the rain should stay with us with only a half-inch expected, though. warming up thursday and friday. so you have heard of the ides of march, which was yesterday. today will be the brides will be marching through downtown san francisco. so, yeah, check it out by lefty oh deal's and union square.

you see it banked up along the san mateo coast. at 8:00 still a patch over the bay, a little bit in the south bay. it will take until 10:00. by noontime it will burn back and we will see mostly sunny conditions today. temperatures this morning ranging from the mid-40s to around 50. we will look for sunny skies, upper 50s at our coast to the mid-70s around the bay. talking about a very pleasant evening. some fog moves back into the bay and we will look for almost a repeat performance tomorrow. i'll detail that for you and a look at some rain coming our way in just a pit. katie. >> sounds good, lisa. thank you. >> the california federation of teachers is calling on all school districts in large budget reserves to use the money to stop layoffs. abc7 news. >> here the story. >> the california teachers association estimates the number

of layoff notices handed out to public school teachers this week could be as low as 2600 statewide. that's down 87% from the 20,000 pink slips issued last year. >> we think it is outrageous. >> the other union, the california federation of teachers, can believe the notices are going out at all given the higher taxes approved by proposition 30 last year that was supposed to save schools from more budget cuts. >> for schools now to be issuing layoff notices review let's plates the spirit in which prop 30 was promoted to the public. >> megan got a pink slip again. she thought she was safe this year considering her district now has a 31% reserve. >> i don't understand why our district doesn't see that the budget pie is expanding and this should have resulted in a change in their actions. however, they are acting as though the sky is still falling. >> there's a lot of uncertainty still out there.

>> capital advisers president kevin gordon said prop 30 only prevented further cuts to schools. it doesn't give them any more money. it is still how clear how hard the government's sequestration cuts will hurt districts. ortiz even if governor brown's plan to shake up school financing will get legislative approval. >> districts don't have a choice. >> in law there's a statutory requirement on march 15th to do the layoffs and if you don't do them you won't have that opportunity later in the school year. >> since most layoff notices are rescinded weeks later when the state's budget picture is clearer, one state senator wants to save everybody the heartache and move the deadline to june 1st in an effort to keep good teachers from leaving. >> they will go off and find another job or they go out and leave the district if they can find something else. >> the california federation of teachers is calling on all school districts with large budget reserves to use the money to stop layoffs. abc7 news. new this morning president obama is promoting a plan to

find alternative fuel. in his weekly address the president says he wants to put $200 million a year into a trust fund for research without adding to the deficit. he says federal revenue from offshore oil drilling leases could pay the cost. he invisions the day when americans are far less oil dependent. >> scientists are designing new engines that are energy efficient. developing cheaper batteries to go farther on a single charge and devising new ways to fuel our cars and trucks with new sources of clean energy like advanced biofuels and natural gas so drivers can one day go coast-to-coast without using a drop of oil. >> republicans focus their message on balancing the budget. house budget committee chairman paul ryan of wisconsin said the gop has a plan to balance the federal budget in ten years through spending cuts alone. a former san francisco supervisor wants larry ellison to make up a multimillion-dollar shortfall projected for the america's cup races this summer.

the billionaire founder of or -- oracle is sponsoring the cup finals here in september. fundraising efforts have lagged and participation from international teams has not met projections. former supervisor aaron said the city should not beliable for the $10 million to $20 million deficit. >> a promise that this was going to be a race that would raise $1.4 billion in the economy is -- and provide thousands of jobs, that has turned out not to be the case. san francisco taxpayers are getting left holding the bill. he is lobbying ellison through an online petition drive at causes.com. new this morning san francisco residents could see monthly garbage bills go up by more than 21% starting this summer. recology, the company that collects the garbage, is asking for six dollars more a month

from the typical household. a set of 32-gallon bins would go up to just under $34 per month. apartment dwellers would pay less. a series of public hearings on the proposal begins next month with a final decision expected by summer. >> this morning pg&e says crews will be venting natural gas from a pipeline in san francisco. people in the calhollow area may smell gas once the venting begins. police say it will last about 15 minutes. gas service will not be interrupted by the pipeline inspection work. pg&e says anyone concerned about smelling gas can call them and verify the source. the gas should quickly dissipate into the atmosphere. san jose is ramping up its police force. 43 new recruits graduated yesterday from the police academy. while city officials are celebrating the first graduates in four years, police union members say the numbers are not enough. the story from abc7 news reporter thomas ramone. >> 43 brand new san jose police officers marched into their

graduating ceremony at parkside hall. here they will get their brand new badges and be sworn in. this is the first police academy class since 2009. the resident john said it's about time more officers hit the streets. >> we are in desperate need of policemen. my goodness, they better hire them all back, as far as i'm concerned. >> these recruits have gone through six months of rigorous training. mark is celebrating with his family. he used to work in manufacturing. he's been waiting for an academy to open up for the past two years. >> as far as being a police officer, doing that job. i started going to school and take classes for it and it finally opened up applications i put mine in immediately. >> the graduation of these recruits is a small step to try to fill the hundred of vacancies in the department since the budget cuts forced massive layoffs. the mayor said the officers will help deal with the rising tide of property and violent crime. >> it's nice not to be a huh shrinking department and not layoff officers as we had to do two years ago and to finally see growth. >> that's not true. we've already had ten resignations this year with another 15 in the final stages

you might have to wait a little bit for the sun around hayward and fremont throughout the midmorning hours. but then santa cruz looking at a mild day today. starting out with the cloud around the bay. look for breezy i think ks the rest of the weekend." today being slightly warmer and we look for rain to arrive by tuesday night. so here's a look at what's going on right now. we are looking at just some clouds around the bay and they will kind of linger here into the east bay for part of the morning hours. but after about 11:00 we are clear and it looks like more sunshine. but that breeze setting up along the short line. so about a quarter mile visibility in livermore right now. we've improved up in santa rosa. four miles half moon bay and 8 miles san jose. the satellite picture shows high pressure in command off the coast that's keeping this weak weather system to the north of us. a system will slide down

tomorrow, providing a little morph a sea breeze. otherwise a dry pattern holds for the weekend. we are looking at pretty nice condition from north to south with 80 in between here at fresno, and low 60s for southern california. look at the upper 60s southern sierra. 67 in the northern sierra. no new snow in the forecast for the mountains. so we will look for a little bit morph a breeze with a weak system headed our way tomorrow. but by the afternoon once again early afternoon we are sunny and the breeze holds on at our coast. today high temperatures ranging from 68 in oakland, palo alto with 70s returning in the north bay. 74 in santa rosa. look for 70 down around san jose, as well as morgan hill. santa cruz warming up to 72 degrees today. the clouds hanging along the san mateo coast. otherwise look for a couple degrees of cooling for st. patrick's day although the break today, should be a beautiful day. increasing clouds on monday. here comes rain late on tuesday. wednesday the first day of

>> welcome back. let's take a look now at your winning numbers from last night's $11 million mega-millions draw. 4, 8, 17, 22, 32, and the meganumber is 8. nobody correctly picked all six. now tuesday night's jackpot is estimated at $13 million. new this morning, the release of a new movie about apple computer co-founder steve jobs is being pushed back with no new opening date announced. jobs stars ashton kutcher, playing one of the most revered entrepreneurs of the 20th century. it was originally going to open on april 19th to coincide with apple's 37th anniversary, but the hollywood reporter said open road films needed more time to mark the movie, which already premiered at the sundance film festival. it was partly shot in the historic palo alto garage where jobs first set up shop. some artifacts from alcatraz that you won't find on the island are going on display but you only have one chance to see them.
