>> with us now is a professor of law at santa clara university and an expert on constitutional law. they could decide just to make a decision that affects california and proposition 8 and that justices could decide a broader decision what. are issues zitding that? >> there is a range of possibilities here for outcome.

dismissing the case as you said, possibly making a ruling only for californians striking that proposition 8 or suggesting that marriage, same-sex marriage has to be constitutional everywhere in the united states. i think that the issue is really about how broad the justices want to make their ruling based on questioning and answering today, it's -- it's suggesting that only two or three justices seem ready and most seem reluctant. >> it did seem several were questioning whether the court should be taking this case. based n comments you heard you get a sense it's just a handful of them, perhaps just four wanted to take this on. >> it's thoord tell only four justices are needed to grant a hearing. certainly the questioning suggests several were reluctant to be hearing this case z question had whether

>> let's move on to other news. a standoff between police and s.w.a.t. teams in a motel room ended after more than five hours when a man in trouble with the law gave himself up. police say the 29-year-old man is wanted on a parole violation after serving time on a weapons charge. the woman, police say is his girlfriend was taken into custody. there, you can see them leading him away. it started about sock this morning. >> oakland police on the lookout for a man suspected of trying to kidnap and sexual assault a 9-year-old girl. they released video showing a man walking by that, is him on the sidewalk there. police believe he grabbed a 9-year-old on 94th avenue yesterday evening. and while carrying hear way they say he inappropriately touched her. the girl screamed the family and neighbors rushed to her rescue and chased him off. her father is happy she is

>> the man who served as president clinton's top advisor now says he hopes the high court will legalize same-sex marriage. leon panetta called the move politics. the former dpeens secretary and cia director sat down with mark matthews. i asked what was the thinking inside of the white house, september, 1 the 996 when the president signed defense of marriage act denying same-sex couples right to marry. >> president clinton had run into problems with don't ask, don't tell. >> panetta says the president was in the final stretch of the reelection campaign and felt the country wasn't ready to accept gay marriage.

the cups were taken away from the children could drink from them. >> a homeland security agent charged with child pornography was in court to hear charges against him. it's a story abc 7 news first broke this month. vic lee was there. >> gilbert lamb did not enter a plea. most of the hearing focused on the evidence against the 38-year-old agent. lamb was first arrested almost a year and a half ago on charges of exchanging child porn on the internet. investigators say they found 83 egg images at his home. >> reaction of this defendant given it was a homeland security agent are deplorable.

>> u.s. attorney turned the case over to the da which decided to prosecute lamb. he was rearrested and held on $250,000 bail. lamb's lawyer lucy mcallister asked the judge to release him on his own recognizance and says her client was in the a flight right after this expect was free on bail during the initial investigation, he did not escape. >> potential for further investigation was not only high, it was true. owe went to work every day, like form normal, innocent until proven guilty. >> mcallister challenged prosecutor charges that lamb actually shared the files reportedly containing child porn. >> she indicated she does not have evidence and doesn't vefdz of locations where files
