at 5:00 we continue to follow our breaking news. >> a fire broke out in a building that houses both residen residences and buildings. >> firefighters are worried about a loose wall. take a look behind me. i know it is dark. see if you can get a glimpse of the loose wall that looks like it could give any minute. it has a fire escape on the

front of the building. firefighters are worried it is going to come down and hurt someone so they are working with city crews to get it blocked off and removed. take a look at the huge fire that caused all of this damage. firefighters say it spread quickly. it started at a home on mckinnon and then traveled around the corner to 3rd street here in san francisco's bay view district just before 1:00 this morning. it caused severe fire damage to three buildings. water damage to two homes. those are flooded. then one building suffered damage on the outside of it. all of these buildings are homes except for one. there is one business here. it's called the new club long island. all of the people escaped their homes safely but they say it was scary. >> went to bed and heard an explosion. we thought it was like shooting or something. we didn't pay attention to anything. and then woke up my wife and went and picked a window and i seen particles coming from the

sky so i went to the other window and i saw the fire. i woke her up and got some clothes and got out as quick as we could. >> reporter: he says he is still looking for signs of his cat. but everyone got out okay. everyone was out by the time firefighters got here. two firefighters were hurt. one fell off his ladder. suffered bumps and bruises. another suffered from minor smoke inhalation and is expected to be fine. firefighters are trying to pump water out of the two homes that are flooded from the firefighters trying to put out the fires, trying to get that water out of their homes. they're also trying to figure out what started this fire. reporting live from san francisco, abc 7 news. >> thank you. here's sue with the effect on traffic. >> right now traffic is not affected. it is in the bay view district, 3rd and mckinnon, but we have muni issues around the area. i wanted to update you on this

accident in bakeville westbound 80 at cherry glenn two rvs now moved off to the shoulder. seeing a little slowing past the scene but crews are on the scene there. and a look out of your drive out of antioch beginning to slow now as you make your way toward pittsburgh and railroad avenue and on into concord. all right. for that delay on muni due to the fire, the outbound t-third metro line will be affected. they are shuttle busing to the end of the line outbound only from 25th. so that is the deal with muni. expect delays on the t 3rd metro. no other muni delays now throughout the system. it is early. all other mass transit is getting off to a great start this morning. here's your forecast. good morning, sue. hi, everyone. we are looking at live doppler 7 hd and noticing a lot of cloud cover. upper full moon with a sweep on top of mount helena anticipating the possibility of some showers not only today but tomorrow. mainly over the higher elevations. it's a very weak system. we have clouds around. we just need the lift that will

on same sex marriage. yesterday prop 8. today the defense of marriage act. the law was signed in 1996 and denies federal benefits to legally married same sex couples. let me show you the plaintiff. she is 83-year-old edith windsor who married her partner in canada back in 2007. when her wife died windsor paid more than $363,000 in estate taxes. the widow of a heterosexual spouse would not have had to do so. former president bill clinton signed that law in 1996 but now says it doesn't honor the nation's principles of equality and fairness. there are more than 1,000 federal benefits same sex couples cannot access, including the nearly 18,000 couples married in california before prop 8 took effect. yesterday one of the justices said this is uncharted territory for the high court going into the same sex marriage issues. i will be inside today for what

promises to be another day of fascinating debate. i'll bring you live reports tonight at 4:00, 5:00, and 6:00. by the way, i will also be tweeting before and after the hearing at c tyler abc 7. live in washington, d.c., here we go again, second day of hearings. abc 7 news. >> thank you so much. as you know, california's ban on same sex marriage got its day at the nation's highest court yesterday. huge crowds rallied outside the high court yesterday. inside the justices had hard-hitting questions for the critics and supporters of prop 8, california's ban on same sex marriage. the justices mus also decide if prop 8 backers even have the right to be in court since the state is not defending the voter-approved ban. the justice are expected to issue rulings in both cases by june. >> on the other side of the question san francisco's archbishop also in washington made an appeal for proposition 8

on behalf of children. he says it's the simple principle that children deserve and a mother and a father and society needs the institution that connects children to their parents. he went on to say only a man can be a father and only a woman can be a mother. to grow up without one or the other is always a deprivation. this is not discrimination, he goes on to say, for the sake of the children, please. at 5:07 now, an unsettling issue springing up on the new span of the bay bridge, the eastern span. giant bolts are stretching and breaking. "the san francisco chronicle" reports officials will meet today to figure out what to do. at least 30 of the bolts or rods have snapped on the new eastern span. caltrans is considering replacing all 288 rods. they're about 2.5 inches thick and run up to 17 feet. it is unclear how much it will cost or how long the work would take. caltrans insists the bridge will be safe and will open on time,

labor day weekend. happening now, it's the first day of the golden gate bridge toll plaza that drivers can roll right through without having to fumble for their wallet. the last of the toll takers closed their booths after midnight when electronic toll taking kicked in. that is where our reporter is live this morning. >> reporter: good morning. yes, it is an historic morning. the golden gate bridge now all electronic. take a look for yourself. we'll show you live pictures. traffic now picking up for the first time this morning since we've been out here. you'll notice nobody is stopping. nobody is paying cash. everyone is zipping right through. without the human toll takers the bridge district is saving $16 million over eight years, but things are still pretty emotional for the humans involved. if you take a look at this video from midnight as the last car came through and paid cash, that last car very symbolic, a vintage packard, the same one that crossed the golden gate bridge on opening day in 1937. but no more of that.

the signs now read, do not stop. the speed limit is 25 miles an hour. cheryl butler adams has only been a toll taker for a couple months now. last night was her last night. she says even in those few months this job turned out to be a lot more than she thought it ever would. >> five months this week. it was never an opportunity that i did not give some direction or advice or point something out. so i think that was interesting. i didn't know that i would be an ambassador for the city. >> reporter: now, for drivers this morning, remember, you have four ways to pay your toll. you can have a fast track account, which most drivers do. you can set up a pay by plate account, which would be based on your license plate. you can pay one time online and if you do none of those you will get a bill in the mail. now, as for the humans who are no longer here this morning, 17 out of the 28 toll takers have

a live look here at the embarcadaro in san francisco. across the bay. we've got some clouds out there this morning, which means a warmer morning, but not so warm in the afternoon. the question is, when will the rain return? oakland city attorneys are asking a federal judge to deny his hand picked overseer for the police department fringe benefits that could boost his pay to well over $300,000. the city filed the request after being unable to come to terms with former baltimore police commissioner thomas frasier. the oakland tribune reports he wants to be paid -- earlier this month he was appointed to the post of compliance director to make sure the police completed court-ordered reforms. the judge ordered the city to pay him a base salary of $270,000 and benefits similar to those of top city officials. we're hearing an apology from the former cia director david patraeus for the romantic

affair that led to his resignation. >> how deeply i regret and apologize for the circumstances that led to my resignation from the cia and caused such pain to my family, friends, and supporters. >> praise spoke before the reserve officer training corps in los angeles last night. he told the crowd he knows he is seen in a different light now but will try to move forward with stronger values and make it up to loved ones. petraeus resigned in november after an affair with his biographer. developing news from overseas where at least one person has been killed after a large earthquake struck taiwan. a 6.0 quake hit central taiwan yesterday. it shook buildings, damaging some. a 73-year-old woman died when a temple in a rural village collapsed. 19 people have been injured mostly by falling objects. a real head shaker out of philadelphia this morning. the mother and daughter are accused of trying to cheat the subway system in new york and in

the process leaving a baby behind. the 15-year-old mom and her mother are seen on surveillance video pushing a baby carriage to where the cashier's booth is. as the baby's mother goes through the booth she slipped her pass back to her mother who was going to use it at another station to avoid suspicion but the handoff, apparently the two forgot the baby and left the baby there. the cashier noticed the stroller and called 911. officers said the pair was frantic about leaving the baby behind. because of that police are not going to charge them with fare evasion. that was in fact philadelphia. you hear a lot about crazy things like that in new york so it kind of slipped out but isn't that unbelievable? >> it is. the sacramento county board of supervisors is opposing a state senate bill that could extend the last call for alcohol at bars and restaurants to 4:00 a.m. sacramento supervisors voted to oppose the state senate measure after the sheriff's department

said it worried about an increase in drunk driving. the sacramento bee reports officials said they were also concerned about being -- about the patrol for drunk drivers at the same time the morning commute begins. the bill's supporters say extending liquor sales to 4:00 a.m. would help the bottom line of many businesses. for your commute you may want to know if there is any rain, sprinkles, fog to cloud your visibility. >> didn't see anything. >> kind of bright, too. despite the cloud cover. full moon and sun up at 7:02. plenty of cloud cover though. we'll see a few peeks of sun here and there and the possibility for rain not only today, tomorrow, and also in the extended outlook. nothing to show you on doppler. we are talking about some very mild temperatures with mid 40s the coolest spot up in napa at 45. 51 by the delta. a little breezy out there. upper 40s for livermore, hayward, and los gatos and up around the bay with the cloud cover, very mild. so the light jacket this afternoon, temperatures aren't going to come up that much due

to the cloud cover so less sun and the possibility of a few rain drops. low 50s oakland, san francisco. good morning, san jose. 50 half moon bay. santa cruz in the upper 40s. more cloud cover today. a chance of sprinkles and a chance of showers tomorrow. a series of weak systems will be rotating through the bay area throughout the next couple days but the best chance of rain comes our way on the weekend when the cut-off low aims right toward central california. so here we're looking at radar and satellite composite and notice much of the activity to the north but we are in a broad, west flow. that zonal flow allowing these weak systems to rotate through. we'll be at the tail end of both today and tomorrow's system. where we get a little lift, higher elevations, north and east bay, the best chance of a shower today. everyone else will see clouds around cool conditions throughout the rest of the afternoon. notice the cloud cover. a few breaks here and there. 3:00 this afternoon and through the overnight hours more clouds. by tomorrow you'll notice still

welcome back. the panera restaurant chain is kicking off a new charitable venture today that could soon make its way across the country. all 48 of the chains, st. louis area stores, are now selling a new menu item, turkey chili for whatever the customer is willing and able to pay. they'll take a dollar or even a penny. they also hope some folks will pay more than the menu price and that will be used for people who can't pay the full price. >> menu item on a sliding scale. interesting. >> that's right. what you can pay. >> see if it comes to the paneras here. what you pay for health insurance may be about to go up but you might get better

mateo area. a fire this morning at a building that houses residences and businesses. we'll go live to the scene at mckinnon avenue and 3rd streets. firefighters do have some fears. >> reporter: firefighters don't know what the cause was yet. the building inspector, though, is now here. he is yellow tagging some of the buildings. they are worried there might be some collapsing going on there was so much damage done. take a look at this huge fire. it spread quickly. firefighters got the call at about -- just before 1:00 this morning that one building was on fire when they got here it had spread to two others. in total they had three buildings with major fire damage. two with water damage. one had some damage to the outside of it. this is in this bay view. it started on mckinnon street and spread to homes on 3rd street. all of the people got out okay but some pets are missing. >> we're still waiting over here. our pets are still there.

two cats still there. we told the firefighters. they went in there looking for them and couldn't find them. so we'll see. >> when firefighters say water damage, check out what they mean. it means that the homes are about flooded. the bottom floor of two homes had standing water in them. firefighters are trying to pump them out right now. all but one of the buildings were homes. the other was a bar. the new club long island bar that also had some damage. two firefighters were hurt in this fire. one fell off the ladder. they say he had bumps and bruises. another had minor smoke inhalation and was treated. he is going to be okay. about 20 people are now working with the red cross trying to figure out where they're going to live now, what they do next. and firefighters still haven't figured out the cause of this fire. live in san francisco, abc 7 news. >> thanks. 5:35 now.

new this morning a contra costa county sheriff's deputy is recovering after his patrol car crashed while responding to a call the car ending up on its side. the crash happened just before midnight on richmond parkway in unincorporated san pablo. officials say the deputy apparently hit the center divider after passing another vehicle and he suffered minor injuries but is expected to be okay. happening now, day two in the historic battle for gay rights. before the nation's highest court. at 7:00 our time the justices will take up the federal defense of marriage act known as doma defining marriage as between one man and one woman. the 1996 law prevents same sex couples even those legally married in states that allow it from collecting federal benefits. today's case involves an 83-year-old woman from new york who was denied the benefits of marriage following a 42-year partnership. today's landmark marriage case comes just one day after the justices considered a california case on whether gays

and lesbians have a fundamental right to marry. the supreme court is expected to issue a ruling by june in both cases. huge crowds rallied outside the high court yesterday. inside the justices had hard-hitting questions for the critics and supporters of prop 8, california's ban on same sex marriage. besides the merits of the case the justices must also decide if prop 8 backers even have the legal right to defend the measure since the state has decided not to. abc 7 is in washington, d.c. covering the historic hearings. right now she is on her way into the courtroom and will have live reports this afternoon starting at 4:00. she is also tweeting updates from her twitter account at c tyler abc 7. a new problem on the new eastern span of the bay bridge. caltrans and bay area transportation officials wii meet today to figure out what to do with at least 30 of the giant bolts holding the span which have snapped. the san francisco chronicle reports caltrans is considering

replacing all 288 bolts on the new eastern span. the bolts are also called rods and were made in the u.s. they measured 2.5 inches in diameter and from 9 to 17 feet long. it's unclear right now how much it will cost or how long it would take to replace them. caltrans insists the bridge will be safe and will open on time labor day. starting this morning drivers crossing the golden gate bridge to get into the city won't need any cash to go through the toll. while before they didn't have to have cash but now absolutely cannot use cash. here is a live look at the golden gate bridge. this is coming into san francisco. headlights definitely heading south. you can see folks who already crossed. this is the first morning there aren't any human toll takers there since the iconic span opened in 1937. at midnight the last car, a vintage packard, was the last to cross and pay cash. the car also crossed the bridge on the day that the bridge opened 76 years ago. in addition to the all electronic tolls now the speed limit has also been raised to 25

5:44 on this wednesday. new this morning police are beefing up patrols at the richmond b.a.r.t. station in the wake of a fatal shooting. ape officer will be placed inside the station during peak morning and afternoon hours while two richmond police officers patrol the area around the station. officers could also be put on the trains for the next few weeks to make riders feel safer. two weeks ago a 34-year-old man was shot and killed at the richmond b.a.r.t. station entrance during rush hour commute. this morning an 8-year-old girl is recovering after being hit in the leg by a 20-inch arrow. it happened at berkeley hall of science. nadine hinson was playing on a life sized whale on a trip with about 60 third graders. police are trying to determine

we're getting first reports of an accident this one 580 in livermore westbound right at first street. you can see some very slow traffic approaching that scene there and also slow out of tracey and up toward the altamont through the wind mill pass. that looks like it's rounding out to be a fairly typical commute for you out of the central valley. here is a live look at the golden gate bridge this morning. history in the making with the toll takers now nonexist ent and traffic not stopping all the way through. looks like it's light. no delays here. all fast track or no cash i guess, all electronic at this point in time. >> thank you. new this morning the city of san francisco is one step closer to getting into the app business with a new taxi app to help hail cabs. the municipal transportation agency approved a plan to build a network to collect taxi data and form an online dispatch service. the agency board says the app would allow taxi can pleases to better compete with private car services that have sprouted in san francisco. the idea has critics, though.

5:53. good morning to you. new this morning south san francisco is taking a bold step on the issue of gun control. tonight the city council is scheduled to consider a proposed ordinance to prohibit the sale of hollow point ammunition or other ammo designed for use by
